Book excerpt: L’Accord général sur les tarifs douaniers et le commerce (GATT) est né en 1947 de la signature portant application provisoire des dispositions de la Charte de la Havane relatives à la « politique commerciale » (partie IV). Cette Charte prévoyait initialement la création d’une Organisation internationale du commerce qui n’a finalement vu le jour qu’en 1995 et a pris le nom d’Organisation mondiale du commerce (OMC). Dans les années 50, en plus de participer à ce projet visant à libéraliser les échanges commerciaux à l’échelle universelle, six Etats d’Europe de l’Ouest ont institué la Communauté européenne du charbon et de l’acier (CECA) et la Communauté économique européenne (CEE). Depuis cette époque, les institutions créées par les traités instituant ces Communautés sont chargées de mener une politique commerciale qui a été élaborée en fonction des engagements consentis dans le cadre du GATT. La CECA et la CEE ont depuis été réunies pour constituer l’actuelle Communauté européenne. Les règles du GATT ont aussi été adaptées à la construction communautaire par des dérogations et des exceptions accordées à la Communauté européenne et à ses Etats membres. En outre, sans être partie contractante du GATT, la Communauté européenne a participé aux activités menées dans le cadre de cette organisation internationale informelle avant de devenir, conjointement avec ses Etats membres, l’un des 128 Membres originels de l’OMC. Cette étude traite des interactions entre le droit élaboré dans le cadre du GATT/OMC et la politique commerciale extérieure menée par la Communauté européenne et ses Etats membres depuis la fin de la seconde guerre mondiale.

La santé publique renvoie à l'action collective, au niveau d'une communauté, en vue de préserver le bien-être physique des individus. Loin d'être isolées, les deux sphères juridiques interagissent et s'influencent mutuellement à plusieurs niveaux. Le sujet rend donc nécessaire l'étude de la place réservée aux questions de santé publique dans le système juridique de l'OMC. L'approche transversale adoptée permet de comprendre que la santé publique n'est pas confinée au rang d'exception ou d'objectif national légitime justifiant un régime dérogatoire. Les médicaments et les services de santé, piliers de toute politique nationale de santé, sont bien inclus dans les disciplines commerciales de droit commun. Néanmoins, cette maîtrise des accords commerciaux multilatéraux sur la santé publique, aussi contraignante soit-elle, correspond en partie aux orientations suivies volontairement par les Etats. Au final, la prudence est de mise pour l'OMC elle-même, eu égard à la sensibilité des sujets de santé publique et à la délicate articulation avec d'autres organisations internationales à vocation économique ou sanitaire.
