Book excerpt: Depuis la loi d'orientation en faveur des personnes handicapées du 30 juin 1975, la Cour s'est déjà exprimée à cinq reprises sur la mise en œuvre de cette politique : dans ses rapports publics annuels de 1982, 1987 et 1998, ainsi que dans deux rapports publics particuliers intitulés " Les politiques sociales en faveur des personnes handicapées " (novembre 1983) et " La décentralisation en matière d'aide sociale " (décembre 1995). Afin de dresser un nouveau bilan sur la mise en oeuvre de cette " obligation nationale ", la Cour des comptes publie en 2003, année européenne des personnes handicapées, un rapport public particulier intitulé " La vie avec un handicap ". Dans ce rapport, la Cour dresse un état des lieux, qui fait ressortir la difficulté de définir la notion de handicap, de recenser les publics concernés et de chiffrer avec précision l'effort financier public à l'égard des personnes handicapées. La Cour examine par ailleurs la situation de handicap aux différents âges ; elle constate notamment que les dispositifs, les services et les équipements s'adaptent mal ou lentement à l'évolution des besoins. La Cour relève enfin la nécessité d'améliorer le pilotage, compte tenu des limites de la programmation, du caractère incomplet du dispositif juridique, de l'insuffisance de l'encadrement de la gestion des établissements qui accueillent des personnes handicapées et de l'absence du handicap dans les priorités de recherche. En conclusion, la Cour recommande à l'Etat de définir une démarche partenariale avec les collectivités territoriales et les organismes sociaux, fondée sur une rénovation des modes d'action. Elle demande également à l'ensemble des acteurs concernés de tout mettre en couvre pour que soient évités les défauts ou les ruptures de prise en charge des personnes handicapées.
