The Act creates an independent body tasked with establishing the causes of accidents on the railways. This body, which would be called the Rail Accident Investigation Branch, would be established on a similar model to that which already exists in the marine and aviation sectors. The Act provides for a Regulatory Board to replace the Rail Regulator, in line with standard practice for the regulation of utilities. It also creates a police authority for the British Transport Police Force ("BTP"), transferring responsibility to the new police authority. The Act introduces alcohol limits and related measures for crews on water-borne vessels. The Act is divided into seven parts, each part covering the following in detail: investigation of railway accidents; Office of Rail Regulation; British Transport Police; shipping: alcohol and drugs; aviation: alcohol and drugs. It applies to the whole of the UK.

It is important to have a separate justice system to ensure that wherever in the world a serviceman is, if he commits a crime or a disciplinary infraction, he knows he will be dealt with according to military law. The prosecution of civilians subject to Service discipline and young offenders is also included. Until 2006, each Service had its own disciplinary system and disciplinary act. The Armed Forces Act 2006 introduced a uniform system for the three Services, harmonizing the offences and methods of disposal. This was an enormous undertaking, which has been largely successful. The legislation still remains a complex area, which is daunting to those who are unfamiliar with the system. This handbook attempts to cover the key provisions. To make the task of advising clients a little easier, by “speaking the same language,” a useful list is included of some common acronyms used in the Services. Bearing in mind the volume of law and regulation, this book is principally designed to give some useful background information about the Service disciplinary system and provide an insight into the main offences charged at summary hearing and court martial. It is a sort of “road map” of the military justice system, which complements the excellent Manual of Service Law and Judge Advocate General’s guidance.

Book excerpt: Despite a decline in traditional rail freight markets (especially coal and steel), and loss of market share to other modes, the overall growth in freight in recent years has allowed rail freight to maintain its volume. The Commission has introduced three packages of directives to stimulate further growth in this market (the first should have been implemented in the 15 member states, the second is to be implemented by 2005, and the third is yet to be adopted). This report reviews the background to the packages, and offers a provisional analysis of their effect so far. The quality of service offered to customers of rail freight movement in Europe falls seriously short of standards required in a competitive environment. Liberalisation of the UK market since 1994 has, however, resulted in better performance and a growing market share for rail freight. The Committee has reservations about some parts of the third package of directives, particularly the proposal to require all train drivers to hold an international rail driving licence, and the proposal for compulsory compensation to rail freight customers for poor quality service. The report also examines problems with the Channel Tunnel, the only direct rail link between the UK and mainland Europe.
