The question of safety on British railways is one of great importance as well as of considerable interest, and this was in the Author's mind when he commenced investigations. We were then passing through anxious times in that direction as the annual report of the Board of Trade showed that the year 1906 was the worst since 1874 as to casualties to passengers in train accidents. The perusal of these pages will show that the accidents of a former generation were mostly due to a weakness of the Machine and not so much to errors of the Man. The Machine is now perfected, and these pages will, without doubt, force the reader to the conclusion that present day accidents are due to failures of the Man. A private communication containing the verdict and penalty is sent to the accused party. This, of course, he keeps to himself, and the incident is closed."

It is, on the contrary, merely what its title signifies, - a collection of notes on railroad accidents. In the course of ten years service as one of the railroad commissioners of Massachusetts, I was called upon officially to investigate two very serious disasters, - that at Revere in 1871, and that at Wollaston in 1878, - besides many others less memorable. In connection with these official duties I got together by degrees a considerable body of information, which I was obliged to extract as best I could from newspapers and other contemporaneous sources. I have felt the utmost hesitation in publishing so crude and imperfect a performance, but finally decide to do so for the reason that, so far as I know, there is nothing relating to this subject in print in an accessible form, and it would, therefore, seem that these notes may have a temporary value. The author, whose experience in connection with accident cases has during the past thirty years been somewhat extensive, believes that a book of this kind and scope will be acceptable to those who have hitherto been obliged to rely upon treatises which have taken one extreme view or the other as to the side of the plaintiff or defendant. The author aims to be always just, and, while attacking fraud on the one hand and on the other giving due prominence to the incapacitating effects of real injury, seeks to show in hysterical and unconsciously exaggerated cases where the neurotic predisposition exists, just how much the accident has to do with the alleged suffering and future condition of the litigant. In this attempt the patient's proper claims are protected while at the same time an effort is made to prevent the railway from being mulcted, or, at least, to show that it is not entirely accountable. The time has certainly come for some one who is initiated, and has sufficient knowledge, to urge the proper and honest presentation of medical facts in court by the plaintiff as well as the defendant, for it does not do to pervert medical truths which in their way are quite as well settled as the axioms of the law.
