Book excerpt: In dealing with the numerous tasks of railroad regulation, governmental control has probably met its severest test in its establishment of a general level of rates. Other problems of regulation, the correction of unjust discrimination, valuation of carrier's property for rate-making purposes, abandonment and extension of service, the long and short haul controversy, safety and health regulations, and the establishment of cooperative routing arrangements with competing lines and carriers, to name a few, receive the attention of the Interstate Commerce Commission, but here we wish to deal with the stated task of the I.C.C. with respect to the exercise of control over rates and the resulting general level of rates. This control has as its aim the establishment of rates which will provide for the carriers under honest, efficient and economical management sufficient revenue to insure adequate and efficient rail service and to attract needed capital. A broad and comprehensive view is necessary to determine the relative weights to be accorded to the need for a healthy railroad system as a vital social instrument among the various agencies which provide transportation facilities and the necessity for the railroads to be viewed as another in the aggregate of the nation's industries which must share the common fate of instability in a progressive economy. Into this rate-making ability which aims to secure for the carriers adequate but not excessive earnings, we wish to inquire in this paper.
