Book excerpt: This book untangles a web of ideas about politics, religion, exile, and community that emerged at a key moment in Jewish history and left a lasting mark on Jewish ideas. In the shadow of their former member Baruch Spinoza’s notoriety, and amid the aftermath of the Sabbatian messianic movement, the Spanish and Portuguese Jews of seventeenth-century Amsterdam underwent a conceptual shift that led them to treat their self-governed diaspora community as a commonwealth. Preoccupied by the question of why and how Jews should rule themselves in the absence of a biblical or messianic sovereign state or king, they forged a creative synthesis of insights from early modern Christian politics and Jewish law and traditions to assess and argue over their formidable communal government. In so doing they shaped a proud new theopolitical self-understanding of their community as analogous to a Christian state. Through readings of rarely studied sermons, commentaries, polemics, administrative records, and architecture, Anne Albert shows that a concentrated period of public Jewish political discourse among the community’s leaders and thinkers led to the formation of a strong image of itself as a totalizing, state-like entity—an image that eventually came to define its portrayal by twentieth-century historians. Her study presents a new perspective on a Jewish population that has long fascinated readers, as well as new evidence of Jewish reactions to Spinoza and Sabbatianism, and analyses the first Jewish reckoning with modern western political concepts.

This collection explores what concepts of holiness were operative in different periods of Jewish history and bodies of Jewish literature and offers preliminary reflections on their theological and philosophical import today. The contributors illumine some of the major episodes concerning holiness in the development of the Jewish tradition. They are challenged to think about the problems and potential implicit in Judaic concepts of holiness, to make them explicit, and to try to retrieve the concepts for contemporary theological and philosophical reflection. Not all of the contributors push into philosophical and theological territory, but they all provide resources for the reader to do so. Holiness is elusive but it need not be opaque. This volume makes Jewish concepts of holiness lucid, accessible, and intellectually engaging.

What forms of government have Jewish leaders, both with and without actual political power, favored? Not surprisingly, many options have been offered theoretically and in practice. Perhaps more surprisingly, democracy has been at the heart of most systems of governance. Biblical Israel was largely a monarchy, but many writers of the Bible were critical of the excesses that almost always arise when human kings take charge: the general populace loses its freedom. In rabbinic Judaism, the majority ruled, and many principles that support modern democratic institutions have their basis in interpretations offered by the classical rabbis. This is true even though rabbinic Jews did not govern democratically. When Jews did have some degree of self-governance, democratic principles and institutions were often upheld. At the same time, so most communal leaders insisted, God-the ultimate judge-ultimately judges everything and everyone. Modern Israel provides the first instance of an independent Jewish nation since the Hasmonean monarchy of the second and first centuries BCE. On an almost daily basis, common features uniting democracy and Judaism, as well as flash point of controversy, are highlighted there. Different overlapping legal systems constantly interfere with one another, both on an international level, in complex transnational contexts such as the European Union or human rights law, but also in the context of cultural diversity or conflicts between religious norms and civil institutions, between minorities and the power of the state. On the other hand, the neutrality of law is also under growing pressure, be it from different global transnational players, or from within nation states where calls are made to adapt law to the will of "the people." The heated European debate on the "refugee crisis" has made it manifest that law is more necessary than ever and yet fundamentally contested, perhaps even caught in contradictions and self-limitations. At the same time, the current perspective on legal problems allows us to address issues of diversity and the role of Europe in the globalized world more clearly. The articles of this book take these recent developments and debates as a starting point to discuss from the perspective of different disciplines the pressing question of how to live together in the new millennium and how to figure the long history of law before, besides, and after the dominant paradigm of state law.

The minhagim played a decisive role in the history of the Jewish communities and in the formation of traditions of religious rulings. He frames the contest between non-Zionist Agudat Yisrael and religious-Zionist Mizrahi as the product of wide-ranging social and cultural struggles within Orthodox Judaism and demonstrates that at the core of their conflict lay deep tensions between rabbinic authority and political activism.
