Book excerpt: El régimen económico matrimonial en el Derecho común constituye una obra eminentemente práctica dirigida a los distintos aplicadores del derecho (abogados, jueces, notarios o registradores). Contiene un manejo riguroso y selectivo de la doctrina del Tribunal Supremo, consiguiendo elaborar un muy cuidadoso y exhaustivo análisis de toda la problemática que plantea la institución; con el necesario añadido de la doctrina de la Dirección General de los Registros y del Notariado, cuya competencia y cualificación en el tema investigado son indiscutibles. El trabajo que se presenta al lector no se limita a recopilar sentencias y resoluciones para sistematizarlas, trabajo harto frecuente hoy día, sino que se contrastan unas y otras, se estudian y analizan, se hacen ver sus contradicciones y, en multitud de supuestos, se plantean soluciones útiles para el tráfico jurídico. La obra se compone de nueve capítulos. El primer capítulo está dedicado a la economía familiar y al régimen de las disposiciones comunes aplicables a todo régimen económico matrimonial contenidas en los artículos 1315 a 1324 del Código Civil, con una especial atención a los actos destinados al ejercicio de la potestad doméstica y a los posibles actos dispositivos sobre la vivienda familiar. Un segundo capítulo está destinado al estudio de las capitulaciones matrimoniales como instrumento por el que se establece, modifica o extingue el régimen económico matrimonial, con dedicación especial al estudio del artículo 1317 del Código Civil y el sistema de modificación del régimen mediante el otorgamiento de capitulaciones matrimoniales. A continuación, nos encontramos con el núcleo fundamental de la obra en los capítulos tres a siete dedicados a la sociedad legal de gananciales, régimen preponderante en los territorios de Derecho común. El estudio de su configuración jurídica ocupa el capítulo tres, dedicando el cuarto a un minucioso y detallado estudio del activo ganancial, con múltiples ejemplos y situaciones. El capítulo quinto queda dedicado al pasivo ganancial y al régimen de responsabilidad por deudas en el seno de la sociedad de gananciales. El sexto se encarga de los actos de gestión, administración y disposición sobre los bienes gananciales, con un estudio pormenorizado de las distintas excepciones al principio de cogestión establecido en el artículo 1375 del Código Civil. Concluye el estudio de la sociedad de gananciales con el capítulo siete dedicado a la disolución y liquidación del régimen, con una parada obligada en la configuración jurídica de la denominada comunidad postganancial y el régimen de liquidación establecido en la Ley de Enjuiciamiento Civil. Los dos últimos capítulos están dedicados al régimen de separación de bienes, con particular estudio de la contabilización del trabajo para el hogar como contribución a la satisfacción de las cargas del matrimonio, y al régimen de participación en las ganancias, régimen ciertamente residual en nuestro ordenamiento. Puede verse, en fin, que la obra hace un examen minucioso y completo de la práctica derivada de la aplicación de las normas propias del Derecho común correspondientes al régimen económico matrimonial. Manuel Rivera Fernández es Catedrático de Derecho Civil en la Universidad de Sevilla desde el año 2009. Ha investigado sobre las materias centrales del Derecho Privado siendo autor de numerosas monografías y artículos científicos. A destacar sus trabajos en el campo del Derecho Patrimonial referidos a la reserva de dominio, la ejecución hipotecaria o la responsabilidad civil de la Administración Pública en el ámbito sanitario. El Derecho de la persona también ha sido objeto de su atención, esencialmente, en sus trabajos sobre la Ley Orgánica de Protección Jurídica del Menor. Gift-giving is everywhere governed by social and customary norms before it encounters the law and the giving of gifts takes place largely outside of the marketplace. As a result of these two characteristics, the law of gifts provides an optimal lens through which to examine how different legal systems engage with social practice. The law of gifts is well-developed both in the civil and the common laws. Richard Hyland's study provides an excellent view of the ways in which different civil and common law jurisdictions confront common issues. The legal systems discussed include principally, in the common law, those of Great Britain, the United States, and India, and, in the civil law, the private law systems of Belgium and France, Germany, Italy, and Spain. Professor Hyland also serves a critique of the dominant method in the field, which is a form of functionalism based on what is called the praesumptio similitudinis, namely the axiom that, once legal doctrine is stripped away, developed legal systems tend to reach similar practical results. His study demonstrates, to the contrary, that legal systems actually differ, not only in their approach and conceptual structure, but just as much in the results.

It presents a comprehensive view of divorce as a psychosocial, economic and legal phenomenon and contains a review of the research literature about divorce and its consequences for parents and children. Moreover, it describes divorce by proposing conceptual frames and explanatory models.
