Pourtant lois et reglements ont instaure une veritable penurie sur le marche. Un droit de l'urbanisme peremptoire et plethorique est concu pour rarefier les terrains constructibles au lieu d'en augmenter le nombre. Le systeme HLM ne donne pas a ses locataires un bail mais une attribution a vie transmissible aux enfants. 4 millions de logements sont rendus immobiles par ce systeme. L'Etat y affecte pourtant la moitie de ses aides - 25 milliards d'euros - au detriment de la grande pauvrete comme de l'accession tres sociale. Le credit hypothecaire assure le developpement de la propriete dans la plupart des grands pays. Il est bloque en France par l'absence de reforme administrative des hypotheques, l'immobilisme notarial, la frilosite des banques. Les risques lies au developpement de la propriete des petits revenus sont pourtant extremement faibles: les pauvres sont toujours meilleurs payeurs que les riches. Dans le logement comme ailleurs, c'est la rupture qu'il faut imposer pour creer un marche dynamique, social et juste de la construction.
