Book excerpt: The present “revolution” in biological technology is leading lawyers to fundamentally reconsider the laws of human reproduction .What is at stake is not only the transmission of life but also the transmission of a certain order of the things on which society is based. This is the reason why the law has always sought to regulate the transmission of life. Covering themes from Canon and medieval Roman Law to the 1804 ‘Code civil’, the work includes twenty-three articles on the history of law about a number of modern-day questions. They deal with the close connections long maintained between marriage and procreation; with natural and legal "filiation" especially regarding the very delicate problems of evidence; with the institution of legitimation but also of the child as a person. There is also an article on the important matter of the "conceived child".

Book Disabilities and the Disabled in the Roman World

Download or read book Disabilities and the Disabled in the Roman World written by Christian Laes and published by Cambridge University Press. This book was released on 2018-04-12 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Almost fifteen per cent of the world's population today experiences some form of mental or physical disability and society tries to accommodate their needs. But what was the situation in the Roman world? Was there a concept of disability? How were the disabled treated? How did they manage in their daily lives? What answers did medical doctors, philosophers and patristic writers give for their problems? This book, the first monograph on the subject in English, explores the medical and material contexts for disability in the ancient world, and discusses the chances of survival for those who were born with a handicap. It covers the various sorts of disability: mental problems, blindness, deafness and deaf-muteness, speech impairment and mobility impairment, and includes discussions of famous instances of disability from the ancient world, such as the madness of Emperor Caligula, the stuttering of Emperor Claudius and the blindness of Homer.

Book The Historical and Institutional Context of Roman Law

Download or read book The Historical and Institutional Context of Roman Law written by George Mousourakis and published by Routledge. This book was released on 2017-03-02 with total page 448 pages. Available in PDF, EPUB and Kindle. Book excerpt: Roman law forms an important part of the intellectual background of many legal systems currently in force in continental Europe, Latin America and other parts of the world. This book traces the historical development of Roman law from the earliest period of Roman history up to and including Justinian's codification in the sixth century AD. It examines the nature of the sources of law, forms of legal procedure, the mechanisms by which legal judgments were put into effect, the development of legal science and the role of the jurists in shaping the law. The final chapter of the book outlines the history of Roman law during the Middle Ages and discusses the way in which Roman law furnished the basis of the civil law systems of continental Europe. The book combines the perspectives of legal history with those of social, political and economic history. Special attention is given to the political development of the Roman society and to the historical events and socio-economic factors that influenced the growth and progress of the law. Designed to provide a general introduction to the history of Roman law, this book will appeal to law students whose course of studies includes Roman law, legal history and comparative law. It will also prove of value to students and scholars interested in ancient history and classics.

Book Villainy in France 1463 1610

Download or read book Villainy in France 1463 1610 written by Jonathan Patterson and published by Oxford University Press. This book was released on 2021-04-15 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Obscene poetry, servants' slanders against their masters, the diabolical acts of those who committed massacre and regicide. This is a book about the harmful, outward manifestation of inner malice—villainy—in French culture (1463-1610). In pre-modern France, villainous offences were countered, if never fully contained, by intersecting legal and literary responses. Combining the methods of legal anthropology with literary and historical analysis, this study examines villainy across juridical documents, criminal records, and literary texts. Whilst few people obtained justice through the law, many pursued out-of-court settlements of one kind or another. Literary texts commemorated villainies both fictitious and historical; literature sometimes instantiated the process of redress, and enabled the transmission of conflicts from one context to another. Villainy in France follows this overflowing current of pre-modern French culture, examining its impact within France and across the English Channel. Scholars and cultural critics of the Anglophone world have long been fascinated by villainy and villains. This book reveals the subject's significant 'Frenchness' and establishes a transcultural approach to it in law and literature. In this study, villainy's particular significance emerges through its representation in authors remembered for their less-than respectable, even criminal, activities: François Villon, Clément Marot, François Rabelais, Pierre de L'Estoile, Christopher Marlowe, Ben Jonson, John Marston, and George Chapman. Villainy in France affords legal-literary comparison of these authors alongside many of their lesser-known contemporaries; in so doing, it reinterprets French conflicts within a wider European context, from the mid-fifteenth century to the early seventeenth century.

Book Redress for Victims of Crimes Under International Law

Download or read book Redress for Victims of Crimes Under International Law written by Ilaria Bottigliero and published by Springer. This book was released on 2013-11-11 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Paradoxically, victims of ordinary crimes such as fraud, theft or assault, can obtain redress through regular domestic channels, whereas victims of such major atrocities as genocide, war crimes or crimes against humanity, have been left mostly uncompensated. Until recently, a pervasive climate of impunity for international crimes relegated victims to the political and legal periphery. Over the last few years however, the international community has begun to recognize that, just as crimes under international law cannot be considered ordinary crimes, victims of these crimes cannot be considered ordinary victims. In this book, Dr. Bottigliero explores the origins, evolution and practice relating to victims' redress in domestic law, regional and universal human rights regimes, humanitarian law, the law of State responsibility, United Nations practice, and international criminal law including the International Criminal Court. She argues that the international community must now move beyond incomplete and fragmented approaches towards a much more comprehensive redress regime for victims of crimes under international law, and she recommends means by which to enhance the coherence, effectiveness and fairness of victims' redress.
