Book excerpt: Mortgage discrimination has been at the centre of housing policy research in the United States for the past two decades. Despite increasing levels of regulation to eliminate this practice, a furious debate remains over whether it exists at all. Increasingly sophisticated research has produced ambiguous results. There is no evidence to suggest that mortgage market discrimination is a problem in Canada. However, because it exists in many other areas of society, there is no reason to assume that the mortgage lending process is immune. Because discrimination may potentially eliminate otherwise credit-worthy borrowers, standard economic theory argues that profit maximizing lenders will not discriminate. Discrimination may, however, result from lack of experience or understanding of certain groups of borrowers. For example, lenders who are conservative in the face of uncertainty may discriminate inadvertently. In other cases, lenders may be willing to forego profit if discrimination is practised for personal, cultural or social reasons. This paper examines the concept of discrimination in residential mortgage lending, reviews and evaluates the approaches that have been developed to detect the existence of discrimination in the U.S., and presents a possible research program suitable for lending firms and governments in Canada.

Book excerpt: The recent subprime mortgage crisis has brought to the forefront the possibility of discriminatory lending on the basis of race or gender. I explore these claims using approximately 10 million observations collected by the federal government in 2006 through the Home Mortgage Disclosure Act. I address two possible theories of discrimination: (1) structural discrimination, which is that any discriminatory lending patterns are picking up the fact that minority borrowers went to different lenders, and (2) individual discrimination, which is the possibility that individual lenders discriminated against identically situated borrowers. The results provide some evidence of both. However, a sensitivity test to examine the effect of missing controls (such as credit score) finds that these racial differences could be explained by a 50% difference in negative credit attributes between blacks and whites under structural discrimination, and 17% difference under individual discrimination.

Despite 30 years of legal prohibition under the Fair Housing Act, however, there is evidence of continuing discrimination in American housing, as documented by several recent reports. In 1998, the Department of Housing and Urban Development (HUD) funded a $7.5 million independently conducted Housing Discrimination Survey (HDS) of racial and ethnic discrimination in housing rental, sales, and lending markets (Public Law 105-276). This survey is the third such effort sponsored by HUD. Its intent is to provide a detailed understanding of the patterns of discrimination in housing nationwide. In 1999, the Committee on National Statistics (CNSTAT) of the National Research Council (NRC) was asked to review the research design and analysis plan for the 2000 HDS and to offer suggestions about appropriate sampling and analysis procedures. The review took the form of a workshop that addressed HUD's concerns about the adequacy of the sample design and analysis plan, as well as questions related to the measurement of various aspects of discrimination and issues that might bias the results obtained. The discussion also explored alternative methodologies and research needs. In addition to addressing methodological and substantive issues related specifically to the HDS, the workshop examined broader questions related to the measurement of discrimination.

Book excerpt: In the fall of 1978 the Federal Home Loan Bank Board collected detailed information on mortgage applications received by Federally-insured Savings and Loan Associations in three SMSAs. This study analyzes the applications for evidence that Associations discriminated against applicants becuase of their age, race, sex, marital status or the location of the property. The study finds no evidence that property appraisals are discriminatory and little or no evidence that the terms offered on approved mortgages are discriminatory. The study does find statistically significant evidence that black and Hispanic applicants are more likely to be denied than are comparable white applicants. To some extent the differences may be due to worse credit records, a factor which can be incorporated into the analysis only imperfectly because of data limitations. The study finds no evidence that the age, sex, or marital status of the applicant or the location of the property affect the likelihood of rejection.
