Book Understanding Due Process in Non Criminal Matters

Download or read book Understanding Due Process in Non Criminal Matters written by Ricardo Lillo Lobos and published by Springer Nature. This book was released on 2022-07-20 with total page 283 pages. Available in PDF, EPUB and Kindle. Book excerpt: How we understand what procedure is due as a fundamental or constitutional right can have a critical impact on designing a civil procedure. Drawing on comparative law and empirically oriented methodologies, in this book the author provides a thorough analysis of how procedural due process is understood both in national jurisdictions and in the field of international human rights law. The book offers a suitable due process theory for civil matters in general, assessing the different roles that this basic international human right plays in comparison with criminal justice. In this regard, it argues that the civil justice conception of due process has grown under the shadow of criminal justice for too long. Moreover, the theory answers the question of what the basic requirements are concerning the right to a fair trial on civil matters, i.e., the question of what we can and cannot sacrifice when designing a civil procedure that correctly distributes the risk of moral harm while remaining accessible to people with complex and simple legal needs, in order to reconcile the requirements of procedural fairness with social demands for justice. This book makes a valuable contribution to the field of civil justice, legal design, and access to justice by providing an empirically based normative theory regarding the right to a fair trial. As such, it will be of interest to a broad audience: policymakers, practitioners and judges, but also researchers and scholars interested in theoretical questions in jurisprudence, and those familiar with empirical legal studies, comparative law, and other socio-legal studies.

Book Linking the Formal and Informal Economy

Download or read book Linking the Formal and Informal Economy written by Basudeb Guha-Khasnobis and published by OUP Oxford. This book was released on 2006-09-21 with total page 316 pages. Available in PDF, EPUB and Kindle. Book excerpt: The concepts of formal and informal remain central to the theory and practice of development more than half a century after they were introduced into the debate. They help structure the way that statistical services collect data on the economies of developing countries, the development of theoretical and empirical analysis, and, most important, the formulation and implementation of policy. This volume brings together a significant new collection of studies on formality and informality in developing countries. The volume is multidisciplinary in nature, with contributions from anthropologists, economists, sociologists, and political scientists. It contains contributions from among the very best analysts in development studies. Between them the chapters argue for moving beyond the formal-informal dichotomy. Useful as it has proven to be, a more nuanced approach is needed in light of conceptual and empirical advances, and in light of the policy failures brought about by a characterization of the 'informal' as 'disorganized'. The wealth of empirical information in these studies, and in the literature more widely, can be used to develop guiding principles for intervention that are based on ground level reality.

This comparative study examines the strategies of re-politicization and socialization employed in contemporary Argentine film and theatre produced in the wake of the 1976-83 dictatorship. It focuses on the socio-political facets of performance across a range of films and dramatic compositions. The book highlights the manner in which the trope of performance represents the place in which film and theatre experiment with generic and mediatic hybridization. Each chapter takes as its point of departure a series of politically motivated appropriations made by cinema and theatre from neighboring genres/media. In each case, genre is shown to take on the role of mediator between competing aesthetic forms: between aesthetics and politics; aesthetic performance and social performance; reality and fiction; postmodern heterogeneity and an increasingly present modern anxiety regarding the perceived need to preserveartistic purity/autonomy, thus restoring what is specific to theatre and cinema's type of communication. Philippa Page has managed the cultural programme at the Maison de l'Argentine in the Cité Internationale Universitaire, Paris and continues to research in the field of Argentine performance studies.
