Book excerpt: Based on existing research, there is little to no evidence to suggest a significant correlation between stock prices and Environmental, Social, and Governance (ESG) factors. This short-term event study looks at 85,878 negative ESG articles published from 2007 to 2022 about over 5,521 companies. My objective was to provide evidence that companies are being punished for negative ESG news by using a comparably larger dataset, over a longer period of time. Aggregating the data across industries and categories, I found that a negative ESG article correlates to a cumulative 6.5 basis point decrease in a company's stock price the next day. Moreover, there is some indication that the impact will grow in the coming years. Drilling down by category, governance-related categories generally dominated the results. Articles related to social and environmental issues had bigger impacts when classified by industry. Ultimately, the results highlight the importance of genuine and thorough ESG management by companies.

Book excerpt: Using enforcements of the Foreign Corrupt Practices Act, we test the hypothesis that socially responsible (ESG) firms receive lower sanctions from prosecutors. Since virtually all cases are settled by bargaining, we estimate sanction specifications derived from a Nash Bargaining model. To account for ESG firm bribes potentially being unobservably less egregious, we instrument ESG with regulation pages in the state of the firm's headquarters. Our instrumented estimates point to ESG firms receiving 14.3 million dollars or 65% lower sanctions, all else equal. Consistent with our exclusion restriction, pages of state laws are uncorrelated with revenues from bribes.

Book excerpt: This survey examines the vibrant academic literature on environmental, social, and governance (ESG) investing. While there is no consensus on the exact list of ESG issues, responsible investors increasingly assess stocks in their portfolios based on nonfinancial data on environmental impact (e.g., carbon emissions), social impact (e.g., employee satisfaction), and governance attributes (e.g., board structure). The objective is to reduce exposure to investments that pose greater ESG risks or to influence companies to become more sustainable. One active area of research at present involves assessing portfolio risk exposure to climate change. This literature review focuses on institutional investors, which have grown in importance such that they have now become the largest holders of shares in public companies globally. Historically, institutional investors tended to concentrate their ESG efforts mostly on corporate governance (the “G” in ESG). These efforts included seeking to eliminate provisions that restrict shareholder rights and enhance managerial power, such as staggered boards, supermajority rules, golden parachutes, and poison pills. Highlights from this section: · There is no consensus on the exact list of ESG issues and their materiality. · The ESG issue that gets the most attention from institutional investors is climate change, in particular their portfolio companies’ exposure to carbon risk and “stranded assets.” · Investors should be positioning themselves for increased regulation, with the regulatory agenda being more ambitious in the European Union than in the United States. Readers might come away from this survey skeptical about the potential for ESG investing to affect positive change. I prefer to characterize the current state of the literature as having a “healthy dose of skepticism,” with much more remaining to be explored. Here, I hope the reader comes away with a call to action. For the industry practitioner, I believe that the investment industry should strive to achieve positive societal goals. CFA Institute provides an exemplary case in its Future of Finance series (www.cfainstitute.org/research/future-finance). For the academic community, I suggest we ramp up research aimed at tackling some of the open questions around the pressing societal goals of ESG investing. I am optimistic that practitioners and academics will identify meaningful ways to better harness the power of global financial markets for addressing the pressing ESG issues facing our society.

Wright Mills Book Award presented by the Study of Social Problems A classic ethnography that reveals how urban police criminalize black and Latino boys Victor Rios grew up in the ghetto of Oakland, California in the 1980s and 90s. A former gang member and juvenile delinquent, Rios managed to escape the bleak outcome of many of his friends and earned a PhD at Berkeley and returned to his hometown to study how inner city young Latino and African American boys develop their sense of self in the midst of crime and intense policing. Punished examines the difficult lives of these young men, who now face punitive policies in their schools, communities, and a world where they are constantly policed and stigmatized. Rios followed a group of forty delinquent Black and Latino boys for three years. These boys found themselves in a vicious cycle, caught in a spiral of punishment and incarceration as they were harassed, profiled, watched, and disciplined at young ages, even before they had committed any crimes, eventually leading many of them to fulfill the destiny expected of them. But beyond a fatalistic account of these marginalized young men, Rios finds that the very system that criminalizes them and limits their opportunities, sparks resistance and a raised consciousness that motivates some to transform their lives and become productive citizens. Ultimately, he argues that by understanding the lives of the young men who are criminalized and pipelined through the criminal justice system, we can begin to develop empathic solutions which support these young men in their development and to eliminate the culture of punishment that has become an overbearing part of their everyday lives.

Approaching punishment and responsibility from a philosophical perspective, Erin Kelly challenges the moralism behind harsh treatment of criminal offenders and calls into question our society’s commitment to mass incarceration. The Limits of Blame takes issue with a criminal justice system that aligns legal criteria of guilt with moral criteria of blameworthiness. Many incarcerated people do not meet the criteria of blameworthiness, even when they are guilty of crimes. Kelly underscores the problems of exaggerating what criminal guilt indicates, particularly when it is tied to the illusion that we know how long and in what ways criminals should suffer. Our practice of assigning blame has gone beyond a pragmatic need for protection and a moral need to repudiate harmful acts publicly. It represents a desire for retribution that normalizes excessive punishment. Appreciating the limits of moral blame critically undermines a commonplace rationale for long and brutal punishment practices. Kelly proposes that we abandon our culture of blame and aim at reducing serious crime rather than imposing retribution. Were we to refocus our perspective to fit the relevant moral circumstances and legal criteria, we could endorse a humane, appropriately limited, and more productive approach to criminal justice.
