Large swaths of research about accountability still focuses on scarcely read annual reports as video footage of police encounters are watched and discussed by citizens regularly. In this Element, we seek to further a predictive model of accountability by understanding the norms and expectations associated with the implementation of Body-Worn Cameras. Specifically, this research examines when police departments release, or do not release, footage to the public and the expectations civilians have about the release of that footage. Indirectly, the norms and expectations associated with this technology have broad implications for societal values and the relationship between civilians and law enforcement. Our findings suggest the relationship between law enforcement and civilians is central to the implementation of this policy, and more broadly, accountability.

The focus of current development is primarily aimed at public and cor porate safety applications including the monitoring of railway stations, airports, and inaccessible or dangerous environments. Future research effort, however, has already targeted citizen-oriented applications such as monitoring assistants for the aged and infirm, route-planning and congestion-avoidance tools, and a range of environment al monitoring applications. The latest generation of surveillance systems has eagerly adopted re cent technological developments to produce a fully digital pipeline of digital image acquisition, digital data transmission and digital record ing. The resultant surveillance products are highly-fiexihle, capahle of generating forensic-quality imagery, and ahle to exploit existing Internet and wide area network services to provide remote monitoring capability.

To this point, most decision-makers have simply defaulted to those minimum protections established by existing constitutional jurisprudence and the practical limits of the technology. In recent years, however, technological advances and social changes have ushered in new and more pervasive forms of public video surveillance with the potential to upset the existing balance between law enforcement needs and constitutional rights and values. The Constitution Project's Liberty and Security Initiative has therefore formulated guidelines to assist local and state officials charged with authorizing, designing, and managing public video surveillance systems. These guidelines will help communities meet the challenge of reconciling Americans' strong and legitimate interest in protection against terrorism and other dangers with their longstanding and constitutionally-enshrined commitment to individual freedom. In addition, these guidelines can lower the overall cost of a video surveillance system by identifying unnecessary or ineffective aspects of the design and reducing the likelihood of legal challenge to public video surveillance.

Book excerpt: Many liberals consider CCTV surveillance in public places - particularly when it is as extensive as it is in England - to be an infringement of important privacy-based rights. An influential report by the House of Lords in 2009 also took this view. However there has been little public, or academic, discussion of the underlying principles and ethical issues. What rights of privacy or anonymity do people have when abroad in public space? What is the rationale for these rights? In what respect does CCTV surveillance compromise them? To what extent does the state's interest in crime prevention warrant encroachment upon such privacy and anonymity rights? This book offers the first extended, systematic treatment of these issues. In it, the author develops a theory concerning the rationale for the entitlement to privacy and anonymity in public space, based on notions of liberty and dignity. She examines how CCTV surveillance may compromise these rights, drawing on everyday conventions of civil inattention among people in the public domain. She also considers whether and to what extent crime-control concerns could justify overriding these entitlements. The author's conclusion is that CCTV surveillance should be appropriate only in certain restrictively-defined situations. The book ends with a proposal for a scheme of CCTV surveillance that reflects this conclusion.
