Book excerpt: As major purchasers of goods and services from the private sector, public entities have significant market power allowing them to influence corporate behaviour by attaching environmental and/or social criteria to public contracts. The power of public procurement as a market instrument makes it an attractive tool for the promotion of goals such as environmental protection and social inclusion. By modifying their purchasing behaviour and favouring environmentally friendly and socially responsible products and services, public purchasing bodies can make a significant contribution to the overarching EU objective of fostering sustainable development. Hence, public procurement has great potential to serve as a front-runner and driver for the necessary transformation of business. However, this chapter also points to the inherent limitations of public procurement law in view of the overarching EU objective of sustainable development. The design of the public procurement directives limit the possibilities to integrate environmental and social concerns, including, notably, the link to the subject matter requirement. Further, public procurement law effectively only regulates a small portion of the market and does not impose any obligations upon companies that do not deliver goods, works or services to public bodies. It is thus crucial to underline the importance of combining rules on sustainable public procurement with corresponding efforts in other areas of law, such as company law. Public procurement law is a significant piece but nevertheless only one piece of the jigsaw puzzle of sustainability, and it would have a greater impact and be more effective if it were a part of a broader, holistic reform for sustainability.

Book excerpt: Federal laws, regulations, and executive orders have imposed requirements for federal agencies to move toward the sustainable acquisition of goods and services, including the incorporation of sustainable purchasing into federal agency decision making. Since the federal government is such a significant player in the market, its move to incorporate sustainable procurement practices could have a profound impact on the types of products being developed for the market as a whole. The General Services Administration (GSA) has played a key role in furthering sustainable procurement practices throughout the federal government. GSA is responsible for formulating and maintaining government-wide policies covering a variety of administrative actions, including those related to procurement and management. GSA has several ongoing activities related to sustainable procurement to assess the feasibility of working with the federal supplier community - vendors and contractors that serve federal agencies to measure and reduce greenhouse gas emissions in the supply chain while encouraging sustainable operations among suppliers. GSA has also been actively developing programs to assist federal agencies in making sustainable procurement decisions. As federal agencies cannot directly fund the development of sustainable procurement tools, they are particularly interested in understanding how to foster innovation and provide incentives for collaboration between developers and users of tools for sustainable purchasing throughout the supply chain. The training of procurement professionals is also a priority for these agencies. To assist efforts to build sustainability considerations into the procurement process, the National Research Council appointed a committee to organize a two-day workshop that explored ways to better incorporate sustainability considerations into procurement tools and capabilities across the public and private sectors. The workshop was designed to help participants assess the current landscape of green purchasing tools, identify emerging needs for enhanced or new tools and opportunities to develop them, identify potential barriers to progress, and explore potential solutions. The workshop provided an opportunity for participants to discuss challenges related to sustainable purchasing and to developing new procurement tools. Sustainability Considerations for Procurement Tools and Capabilities reviews the presenters' recommendations and tools currently used in sustainable procurement, such as databases for ecolabels and standards, codes, or regulations and other nontechnological tools such as policies, frameworks, rating systems, and product indexes.

Also, propositions are presented in order to incorporate sustainability attributes in the procurement and supply management systems. Based on our experiences with consultancies and projects in partnership with governments, business platforms and academic researches, a survey was conducted with about 50 institutions, among public bodies and businesses, organizing lessons learnt and calling attention for facilitators and barriers of institutional consumption aimed at sustainability. Among the institutions we surveyed, we picked up the examples described in this work. Finally, in Chapter 5, under an integrated perspective of sectors and actors, including individual consumers, we made a critical analysis of the advancements and challenges faced in the past years, and point to guidelines for the future of the so-wanted 'inclusive green economy', considering institutional procurement as an essential tool to (re)build a global scenario that is more favorable to sustainable development.

Book excerpt: Green purchasing - or eco-procurement - by local and central governments has long been recommended in documents such as Agenda 21 to be a key - although sometimes supplemental-ingredient in the achievement of more environmentally responsible economies. Certainly, sustainable consumption cannot be considered a realistic goal without the full engagement of public authorities. Many initiatives have been undertaken in OECD countries, most successfully in Japan and Denmark where green public purchasing has been proven to be workable and highly effective, while, in other countries, city municipalities have successfully pioneered the development of sophisticated public environmental purchasing policies. However, for the vast majority of countries and their major cities, the potential for green public purchasing remains woefully untapped. A key question is what would be the environmental impact if the majority of cities in Europe replicated the success stories of those leading the way? Public procurement has, after all, been an important tool in achieving other public policy goals such as defence. Why should it not be used as a tool to defend the environment? The RELIEF project, funded by the EU's "City of Tomorrow and Cultural Heritage" programme was established to answer exactly this question: to define the true potential of eco-procurement and to develop a strategy for change in Europe. Buying into the Environment is the result of the research segment of the project which has now been completed. A further stage-to design a Europe-wide action plan will follow in 2004. The book, organised under the auspices of the International Council on Local Environmental Initiatives (ICLEI) analyses national approaches already tested, and provides in-depth surveys on the pioneer cities such as Hamburg, Malmo and Zurich. Serious attention is given to city-specific hurdles which have been faced and overcome. The most relevant product groups for eco-procurement such as construction, transport, energy, information technology, furniture and food. are also analysed. Uniquely, the book also provides calculations on the environmental benefits potentially achievable through greener purchasing. Tools were developed and tested by the RELIEF researchers on the environmental assessment of products, public buying power and on evaluations of market conditions in order to provide scenarios for the application of green purchasing at a European level. The conclusions are that there is huge potential for both local and central governments to adapt their behaviour patterns and purchase in a more environmentally responsible way. For example, 18% of the EU's Kyoto Protocol commitment could be achieved if major cities in the European Union purchased green electricity. The results are complemented by new ideas on how best to foster innovation in public contractual arrangements-to encourage the development of products such as super-energy-efficient computers and fuel cells-and how the legal system may require adaptation and reform. The results presented in this book will provide an indispensable resource for municipalities, governments, researchers and business practitioners looking for answers on how public procurement can have a fundamental and manifestly positive effect on the environment.

Book excerpt: This chapter discusses the relationship between public procurement and company law within the context of the overarching EU objective of sustainable development. The EU recognises the importance of business to achieve sustainability and the relevance of public procurement law as a policy strategy instrument in this context, but it does not yet fully recognise the importance of company law. Reform of public procurement law is seen as an essential part of the EU's 2020 Strategy, with public procurement being mentioned several times: as a potential driver to stimulate innovation and resource-efficiency, and as an integral part of an industrial policy for a global, low-carbon economy. While public procurement is also mentioned as a tool to ensure efficient use of public funds, company law is only regarded in the economic context, as something to be simplified to facilitate single-market access for SMEs and encourage entrepreneurship. However, company law does have a crucial role to play in the transformation towards sustainability because it provides the legal framework for the internal workings of the company, including its decision-making. Indeed, the argument can be made that without a reform of the legal infrastructure for the internal decision-making in companies, sustainability is very difficult, if not impossible, to achieve. This Chapter draws on a research-based reform proposal for EU company law and corporate governance. The Chapter proceeds with a brief presentation of the reform proposal for sustainable companies and discusses the potential role of public procurement in that context. On this basis the Chapter considers whether ideas from the reform proposal can be promoted by public procurement as a potential front-runner and a driver for the necessary transformation of business, identifying possibilities but also significant limitations. The Chapter then goes on to discuss whether there are any lessons to be learned for public procurement from the insights derived from international company law research on how to internalise environmental and social externalities in the decision-making in companies; and conversely whether innovative approaches in the new public procurement directives can inspire a further development of the reform ideas for company law itself. The chapter concludes with some reflections on the interaction between public procurement law and company law.

Book excerpt: Since the end of the 1990s, Sustainable Public Procurement (SPP) is discussed as a policy instrument to further sustainability in the economy and society. SPP is an approach that integrates social, environmental and economic considerations in all stages of the public procurement process, from pre-qualification to contract compliance. The concept of SPP includes raising awareness, removing adverse budgetary incentives and promoting product standards. There are many arguments in favour and against SPP. The discussion in this paper concludes that SPP is desirable because the effect on the environment could be substantial, the government's credibility to promote sustainability is enhanced, and the effectiveness of other environmental policies is expected to increase. In developing countries, SPP does not receive adequate attention. By financing projects and programs in developing and transition countries, International Financial Institution like the Asian Development Bank and the European Bank for Reconstruction and Development set rules on public procurement and thus have the potential to influence procurement practices. In the paper at hand, procurement policies, rules and regulations from ADB, EBRD, UNCITRAL and WTO are screened and examined whether they support and further SPP in developing countries. In addition, representatives from the development banks and national procurement agencies expressed their experiences. In ADB's and EBRD's operations and project design, sustainability is an important element, however, the sustainability of procurement in not treated as a priority. There are several documents that promote or indicate the need of sustainability in public procurement but on an application-level pure economic consideration (e.g. lowest price) are often predominant. ADB integrates sustainability mainly in technical specifications where as EBRD's focus is more on award criteria. However, in none of the examined develop.
