Book excerpt: This report, by the Public Administration Select Committee, examines the issue of alleged breaches of the Ministerial Code, and follows a more comprehensive report on the main aspects of ministerial conduct and the code, published in 2001 (HCP 235, 2000-01, ISBN 0102087016). For this Committee the enforcement of the Code is still an issue to be resolved. Already, the Committee on Standards in Public Life has undertaken a review of ethics and standards in public life, with the Code as part of that review. Since that review began a number of Ministers, including David Blunkett, Tessa Jowell and John Prescott have all been the focus of possible breaches of the Ministerial Code, with David Blunkett forced to resign because of his failure to heed the Code in regard of business interests. The Committee has set out a number of conclusions and recommendations, among them are: that the Prime Minister should judge the right course of action when a Minister is seen to have broken the code, but the Committee believes that an independent investigatory capacity can be created which would promote public confidence in the Code; that it be independent of the Executive; concern itself exclusively with establishing the facts and undertaken by an official connected to the Houses of Parliament; and once the investigation is complete make its findings available to Parliament and the public. Further, that the Ministerial Code should be amended to require Ministers to declare all their business interests where a possible conflict may arise with their ministerial duties and pass this information to their permanent secretaries.
