Book excerpt: Mit dieser Veröffentlichung erfülle ich einen wiederholt geäußerten Wunsch meiner ehemaligen Schüler, die als Juristen oder Ermittlungs beamte von Polizei und Gendarmerie in der Praxis stehend, manchmal das Bedürfnis empfinden das nachzulesen, was ihnen im Unterricht seinerzeit geboten worden war. Obwohl so die Arbeit vorwiegend für den Praktiker bestimmt ist, habe ich den streng lehrmäßigen Aufbau der Vorlesung beibehalten. Nur so sehe ich die Möglichkeit, psycho logische Bildung zu verbreiten und das bloße Anlesen von Kenntnissen zu vereiteln. Für mein Vorgehen war die Erkenntnis maßgebend, daß bei der hohen Komplexität aller psychischen Vorgänge die bloße Routine und das Handeln nach Gebrauchsanweisung notgedrungen in die Irre führen müssen. Es ist daher unerläßlich, bei der Darstellung von Einzel erkenntnissen stets auch den Blick auf das Ganze zu wahren. Das aber hat eine strenge Systematik zur Voraussetzung. Damit glaube ich zugleich ein Buch geschaffen zu haben, das mit Vorteil auch von dem gelesen werden kann, den es erstmalig in die Psychologie des Strafverfahrens einführt. Um die Lesbarkeit zu er leichtern und die Darstellung flüssig zu halten, wurden Anmerkungen unter dem Strich nach Möglichkeit vermieden. Wer tiefer in die Materie einzudringen wünscht, sei auf die kurze Literaturzusammenstellung am Ende des Buches verwiesen.

Book excerpt: This book examines the emergence and early development of forensic psychology in Germany from the late nineteenth century until the outbreak of the Second World War, highlighting the field’s interdisciplinary beginnings and contested evolution. Initially envisaged as a psychology of all those involved in criminal proceedings, this new discipline promised to move away from an exclusive focus on the criminal to provide a holistic view of how human fallibility impacted upon criminal justice. As this book argues, however, by the inter-war period, forensic psychology had largely become a psychology of the witness; its focus narrowed by the exigencies of the courtroom. Utilising detailed studies of the 1896 Berchtold trial and the 1930 Frenzel trial, the book asks whether the tensions between psychiatry, psychology, forensic medicine, pedagogy and law over psychological expertise were present in courtroom practice and considers why a clear winner in the “battle for forensic psychology” had yet to emerge by 1939.

We are adding to this collection a bibliography listing all criminological It seems to us monographs published in German within the last five years. that a systematic survey of the literature is highly suitable for completing the picture outlined in the various articles. This should provide some idea of the focal points and tendencies of the present thinking and of the efforts at institutionalization in German criminology. Last but not least, this col lection may help to revise the opinion that criminology in the German speaking world is still largely biologically oriented. The editors are aware of the scholarly and editorial risks connected with the publication of such a volume. Nevertheless they believe that these risks have to be faced in order to provide information about the present crimino logical thinking in the Federal Republic of Germany and to illustrate its close links with the international scene. We hope that this book will be accepted by the international public as a contribution to a "comparative criminology". Should this venture find an interested audience, similar volumes could follow in regular intervals.
