Book excerpt: After a promising start as a prosperous and liberal democratic nation at the end of the nineteenth century, Argentina descended into instability and crisis. This stark reversal, in a country rich in natural resources and seemingly bursting with progress and energy, has puzzled many historians. In Civilizing Argentina, Julia Rodriguez takes a sharply contrary view, demonstrating that Argentina's turn of fortune is not a mystery but rather the ironic consequence of schemes to "civilize" the nation in the name of progressivism, health, science, and public order. With new medical and scientific information arriving from Europe at the turn of the century, a powerful alliance developed among medical, scientific, and state authorities in Argentina. These elite forces promulgated a political culture based on a medical model that defined social problems such as poverty, vagrancy, crime, and street violence as illnesses to be treated through programs of social hygiene. They instituted programs to fingerprint immigrants, measure the bodies of prisoners, place wives who disobeyed their husbands in "houses of deposit," and exclude or expel people deemed socially undesirable, including groups such as labor organizers and prostitutes. Such policies, Rodriguez argues, led to the destruction of the nation's liberal ideals and opened the way to the antidemocratic, authoritarian governments that came later in the twentieth century.

Book excerpt: The duel, and the codes of honour that governed duelling, functioned for decades in many European and Latin American countries as a shadow legal system, regulating in practice what legislators felt free to say and what journalists felt free to write. Yet the duel was also an act of potentially deadly violence and a challenge to the authority of statutory law. When duelling became widespread in early twentieth-century Uruguay, legislators facing this dilemma chose the unique and radical path of legalization. The Pen, the Sword, and the Law explores how the only country in the world to decriminalize duelling managed the tension between these informal but widely accepted “gentlemanly laws” and its own criminal code. The duel, which remained legal until 1992, was meant to ensure civility in politics and decorum in the press, but it often failed to achieve either. Drawing on rich and detailed newspaper reports of duels and challenges, parliamentary debates, legal records, private papers, and interviews, David Parker examines the role of pistols and sabres in shaping the everyday workings of a raucous public sphere. Book excerpt: This volume addresses an important historiographical gap by assessing the respective contributions of tradition and foreign influences to the 19th century codification of criminal law. More specifically, it focuses on the extent of French influence – among others – in European and American civil law jurisdictions. In this regard, the book seeks to dispel a number of myths concerning the French model’s actual influence on European and Latin American criminal codes. The impact of the Napoleonic criminal code on other jurisdictions was real, but the scope and extent of its influence were significantly less than has sometimes been claimed. The overemphasis on French influence on other civil law jurisdictions is partly due to a fundamental assumption that modern criminal codes constituted a break with the past. The question as to whether they truly broke with the past or were merely a degree of reform touches on a difficult issue, namely, the dichotomy between tradition and foreign influences in the codification of criminal law. Scholarship has unfairly ignored this important subject, an oversight that this book remedies.

In a time when representative democracies were under threat, 15M came to life as a virtuous and democratic response to the slide into far-right populism and authoritarianism. More than a social movement, 15M became a mode of being with transformative, democratizing potential. In Democracy Here and Now, Pablo Ouziel offers a grounded analysis of 15M. At the time of the movement and during the ensuing encampments, Ouziel travelled extensively, speaking to participants, and keeping an ongoing record of his conversations. Presenting an original participatory mode of research, the book reveals six types of intersubjective, "joining hands" relationships that 15M has brought into being and works to carry on in creative ways. The book shows how the movement’s way of being and temporality persists in Spain following the square occupations, while 15M citizens continue to learn and move forward in less perceptible ways. Democracy Here and Now sheds light on a deeply relational, intersectional, and eco-social mode of democracy, and shows how 15M’s ongoing democratization practices are exemplary of similar grassroots movements around the world, broadening our understandings of what it means to be democratic in the here and now.
