Depuis, sous la pression de la " crise " qui a frappé les économies occidentales après le premier choc pétrolier, nombreux sont ceux qui considèrent que l'Etat providence est devenu incompatible avec la croissance économique ou le plein emploi. Le credo néolibéral suggère que la route de la croissance, de l'emploi et de la prospérité est pavée de flexibilité et de dérégulation. Le degré de protection sociale octroyé par le jeu de la réglementation du marché du travail et par les transferts sociaux contribuerait à limiter l'ajustement du marché dans un contexte où le niveau de chômage est élevé, du fait des rigidités qu'il générerait. Contrairement à ce que prêche le credo néolibéral, ce livre démontre que " la grande contradiction " entre protection sociale et performance économique n'est pas une caractéristique immuable des économies postindustrialisées et avance une théorie économique de la solidarité.

Book excerpt: D'inspiration bismarckienne, le système de protection sociale français a profondément évolué ces dernières décennies (CSG, lois de financement de la sécurité sociale, protection universelle maladie, nouvelle branche consacrée à l'autonomie), devenant progressivement plus universaliste, au point de se traduire en matière de gouvernance et de financement par davantage d'étatisation. Ces profonds changements appellent une réflexion renouvelée et invitent à redéfinir les principes de bonne gouvernance pour l'État et les partenaires sociaux. De surcroît, alors que le financement de la Sécurité sociale reposait largement à l'origine sur les cotisations sociales, la part de la fiscalité est aujourd'hui devenue considérable et conduit à s'interroger sur la distinction entre impôt et cotisation, ainsi que leur compatibilité avec la performance économique et l'adhésion des assurés au système de protection sociale. Le colloque du 12 février 2021 analyse tous ces enjeux. La première table ronde s'intéresse à la gouvernance de la protection sociale à travers la place des partenaires sociaux et le rôle de l'État, notamment en matière de gouvernance de la branche maladie et du mode d'organisation de la nouvelle branche relative à l'autonomie. La seconde table ronde examine les transformations qui touchent au financement de la protection sociale. Elle s'interroge sur la place respective des impositions et des cotisations, sur la nature des prélèvements dédiés à la protection sociale (CSG, TVA sociale), et sur la question des liens entre les modalités de financement de la protection sociale, son organisation et sa gouvernance. Cet ouvrage enrichi de notes et d'annexes offre une vision concrète et documentée des transformations et des enjeux actuels auxquels est confrontée la protection sociale.

Book excerpt: This book represents a first attempt to investigate the relations between Law and Agroecology. There is a need to adopt a transdisciplinary approach to multifunctional agriculture in order to integrate the agroecological paradigm in legal regulation. This does not require a super-law that hierarchically purports to incorporate and supplant the existing legal fields; rather, it calls for the creation of a trans-law that progressively works to coordinate interlegalities between different legal fields, respecting their autonomy but emphasizing their common historical roots in rus in the process. Rus, the rural phenomenon as a whole, reflects the plurality and interdependence of different complex systems based jointly on the land as a central point of reference. “Rural” is more than “agricultural”: if agriculture is understood traditionally as an activity aimed at exploiting the land for the production of material goods for use, consumption and private exchange, rurality marks the reintegration of agriculture into a broader sphere, one that is not only economic, but also social and cultural; not only material, but also ideal, relational, historical, and symbolic; and not only private, but also public. In approaching rus, the natural and social sciences first became specialized, multiplied, and compartmentalized in a plurality of first-order disciplines; later, they began a process of integration into Agroecology as a second-order, multi-perspective and shared research platform. Today, Agroecology is a transdiscipline that integrates other fields of knowledge into the concept of agroecosystems viewed as socio-ecological systems. However, the law seems to still be stuck in the first stage. Following a reductionist approach, law has deconstructed and shattered the universe of rus into countless, disjointed legal elementary particles, multiplying the planes of analysis and, in particular, keeping Agricultural Law and Environmental Law two separate fields.

Increased uncertainty and exclusion intensify the need for social security. Both the public and private sectors are redefining their roles, reshuffling responsibilities between states, markets, families, and individuals. Social Security in the Global Village investigates the new challenges for social security in an increasingly globalized world and analyzes strategies of adjustment. A group of internationally renowned experts in this field assess the variety of effects that globalization has had on national social security schemes. A common theme of a first set of chapters is the relationship between common pressures of globalization and the role of national institutional frameworks in shaping the impact of these pressures on social security. Countries are dealing in different ways with these challenges and follow diverse pathways of adjustment that quite often contradict widespread assumptions about the effects of globalization. A second set of chapters is devoted to challenges in selected policy areas: migration, labor markets, and social cohesion issues. Book excerpt: This volume on labour flexibility invites readers to question the effects of labour market institutional and organisational reforms on social cohesion. The Council of Europe suggests reconciling social cohesion with the inevitable changes wrought by globalisation, namely the reorganisation of the parameters governing competition. This reconciliation should take into account the essential political value of democratic security, to be found firstly in employment; the high social and societal cost of precariousness attests to this. However, security should not imply rigidity. It should rather translate into societal recognition of a "right to transition" which calls for co-responsibility on the part of all social actors and stakeholders. Reconciliation is more than a political duty, it is a prerequisite for the stability necessary for social sustainability. It should therefore raise awareness of the need to find new ways of fairly sharing the costs and benefits such transitions create. -- Council of Europe.

La qualité de la mise en œuvre a une grande importance et la faiblesse de l’un des éléments constitutifs de la chaîne de mise en œuvre affectera négativement l’ensemble de celle-ci et réduira les impacts du ou des programmes qui lui sont associés. 3. Les systèmes de mise en œuvre évoluent dans le temps, de manière non linéaire et leur point de départ est important. 4. Dès le début de la mise en œuvre, des efforts devront être déployés pour « garder les choses simples » et pour « bien faire les choses simples ». 5. Le premier segment de la chaîne, à savoir l’interface entre les futurs bénéficiaires et l’administration, est souvent son maillon le plus faible. Son amélioration peut nécessiter des changements systémiques, mais ceux-ci contribueront considérablement à l’efficacité globale et atténueront les risques d’échec de cette interface. 6. Les programmes de protection sociale ne fonctionnent pas dans le vide et, par conséquent, leur système de mise en œuvre ne doit pas être développé en vase clos. Des opportunités de synergies entre institutions et systèmes d’information existent et les saisir peut améliorer les résultats des programmes. 7. Au-delà de la protection sociale, ces systèmes de mise en œuvre peuvent aussi améliorer la capacité des gouvernements à fournir d’autres prestations ou services, comme les subventions à l’assurance maladie, les bourses d’études, les tarifs sociaux de l’énergie, les allocations logement et l’accès aux services juridiques. 8. L’inclusion et la coordination sont des défis omniprésents et permanents. Pour les relever, il faut donc améliorer de façon continue les systèmes de mise en œuvre à travers une approche dynamique, intégrée et centrée sur la personne.

Morocco has benefitted from a stable macroeconomic regime and the deficit is narrowing following the pandemic and energy crisis with the government debt ratio is around 70% of GDP. Morocco has embarked on major reforms to encourage investment and to extend health insurance and social protection, but a stronger convergence path will be needed to achieve the vision in the New Development Model. Morocco’s labour productivity gap with the frontier remains large, although it has narrowed. FDI flows have been strong, but domestic private investment is low, and Moroccan firms face obstacles in performing better. Morocco’s young population is an asset, but the labour market suffers from high youth unemployment and low female employment. Emigration is significant. Widespread informality leads to low wages, poor-quality jobs and weak skills. Morocco has made an ambitious commitment to reduce carbon emissions by 45% by 2030 compared to 2010 and to net zero by 2050, benefiting from the country’s potential for renewables-based generation.
