This book provides a critical assessment of the role that international law plays in this process, by explaining and evaluating the various legal instruments that have been negotiated in this area, as well as key trends in global ocean governance. Starting with a detailed analysis of the United Nations Convention on the Law of the Sea, the book considers the main treaties and other legal texts that seeks to prevent, reduce, and control damage to the marine environment caused by navigation, seabed exploitation, fishing, dumping, and land-based activities, as well as emerging pressures such as ocean noise and climate change. The book demonstrates how international institutions have expanded their mandates to address a broader range of marine environmental issues, beyond basic problems of pollution control to include the conservation of marine biological diversity and an ecosystems approach to regulation. It also discusses the development of diverse regulatory tools to address anthropogenic impacts on the marine environment and the extent to which states have adopted a precautionary approach in different maritime sectors. Whilst many advances have been made in these matters, this book highlights the need for greater coordination between international institutions, as well as the desirability of developing stronger enforcement mechanisms for international environmental rules.

Through an analysis of domestic political economies, the book explains how states have protected millions of square kilometers of ocean space while remaining highly responsive to the interests of businesses. It argues that states design environmental policies above all around two key features of a given space: (1) the composition of extractive versus non-extractive industry interests; and (2) the salience of various industry interests, defined as the degree to which businesses would suffer tangible and significant costs in response to new environmental regulations. Through an analysis of large marine protected area advocacy campaigns in Australia, Palau, and the United States, this book demonstrates how the political economy of a given marine space shapes how governments align their environmental and economic goals, sometimes strengthening conservation but more often than not undermining it. In addition, climate change is already having an impact on some marine ecosystems. This book discusses some of the major threats facing marine ecosystems by cons- ering a range of topics, under chapters discussing biodiversity (Chapter 1), fisheries (Chapter 2), aquaculture (Chapter 3), pollution (Chapter 4) and the impacts of increasing greenhouse gas emissions (Chapter 5). It goes on to explore solutions to the problems by discussing equitable and sustainable management of the oceans (Chapter 6) and protecting marine ecosystems using marine reserves (Chapter 7). Presently, 76% of the oceans are fully or over-exploited with respect to fishing, and many species have been severely depleted. It is abundantly clear that, in general, current fisheries management regimes are to blame for much of the widespread degradation of the oceans. Many policy-makers and scientists now agree that we must adopt a radical new approach to managing the seas – one that is precautionary in nature and has protection of the whole marine ecosystem as its primary objective. Book excerpt: Marine and coastal resources provide millions of people with their livelihoods, such as fishing and tourism, and a range of critical additional ‘ecosystem services’, from biodiversity and culture to carbon storage and flood protection. Yet across the world, these resources are fast-diminishing under the weight of pollution, land clearance, coastal development, overfishing, natural disasters and climate change. This book shows how economic instruments can be used to incentivize the conservation of marine and coastal resources. It is shown that traditional approaches to halt the decline focus on regulating against destructive practices, but to little effect. A more successful strategy could be to establish schemes such as payments for ecosystem services (PES), or incorporate an element of financial incentives into existing regulatory mechanisms. Examples, both terrestrial and marine, from across the world suggest that PES can work to protect both livelihoods and environments. But to succeed, it is shown that these schemes must be underpinned by robust research, clear property rights, sound governance structures, equitable benefit sharing, and sustainable finance. Case studies are included from south and east Asia, Latin America, Africa and Australia. The book explores the prospects and challenges, and draws lessons from PES and PES-like programmes from across the globe.
