Book excerpt: New forms of organising work, non-standard forms of employment and new forms of self-employment are contributing to the diversity in the labour market across the Member States. They can be observed in the heterogeneity of the forms of employment that are distinct from those based on individual permanent employment contracts, which have dominated employment relationships for decades. Moreover, they influence the time dedicated to work and related income, both of which may be distinct from individual permanent employment contracts. The purpose of this report is to acknowledge this diversity by exploring how this diversity is classified under national social security law and by identifying any resulting problems for social security coordination when non-standard employed and self-employed workers move within the EU. Possible solutions are put forward on how to overcome these obstacles in order to guarantee the freedom of movement of non-standard workers. The present report neither analyses the diversity from a labour law perspective, nor does it try to propose solutions formodifying or abolishing this diversity.

The creation of the European Economic Area and near accession of the candidate Members (East European countries) has further increased the relevance of this law. This book describes EU social security law, beginning with the rules relevant to migrant workers. Coverage includes Regulations 1408/71 and 574/72 and the case law of the Court of Justice of the EC. The book analyses the contributions of these judgments to the developments of coordination law and to the realisation of the objective of free movement of workers. In this respect the relation of the Regulation and the EC Treaty, which is shown in for instance the Kohll and Decker judgments, is analysed. Special attention is paid to the Proposal for Simplification and Modernisation of Regulation 1408/71. A second main part of EU social security law is the law on equal treatment of men and women. The Court of Justice issued several main decisions, of which the Barber judgment is a wellknown example. Since then, the case law has been further developed and this book helps the reader to understand the present state of affairs. A separate chapter analyses the combat against social exclusion of the EU and the instruments developed for this purpose. This is the completely revised and updated fourth edition of an authoritative book.

The aim of this work is, first, to clarify the impact of the globalisation process on social security systems and, second, to formulate substantive and technical proposals for the adaptation of existing social security schemes to an altered socio-economic context and for the elaboration of international legal instruments aimed at an effective substantive and procedural protection of social security as a fundamental right.The report is divided into three parts. The first part is concerned with the social impact of globalisation and its consequences for social security systems in the high-income economies. The first article of this section considers the nature of globalisation as well as its social impact. It spells out some fundamental challenges facing social security systems. The following article elaborates further on one specific challenge, that is: the need for social security to adapt to the increased territorial mobility of workers.The second part looks at the effects of globalisation on social security in relation to middle- and low-income countries and examines the extent to which existing arrangements in these countries are able to provide adequate income protection to me majority of the population. For the group of middle-income countries, the relevance of globalisation for the privatisation of pension systems is analysed as well as the consequences with respect to their main social functions, i.e. the provision of old-age income security and income redistribution. This is done so through a comparative analysis of Latin American countries that have implemented pension policy reform. The following two articles consider the experience of social security systems in low-income countries. In the first article the impact and challenges of globalisation for existing formal and informal social security arrangements in low-income countries are explored and options are suggested for alternative approaches to social security provision that are better suited to the circumstances of low-income countries. The arguments have been illustrated with evidence from Cote d'Ivoire, a country with a socio-economic situation and social security framework that is typical for the majority of low-income countries. The second article discusses in greater depth the link between informal economic and social security in Sub-Saharan Africa.Finally, the third part calls for a global approach to social security. To this end, the first article in this section outlines a possible strategy for a generalised social protection at the global level based on the human damage theory while the last chapter of this work is concerned with the international legal instruments most appropriate for a better substantive and procedural protection of social security as a basic human right.

Boundaries count: they are essential in bringing together individuals, groups, and territorial units, and for activating or strengthening shared ties between them. If the profile of boundaries changes over time, we might expect significant consequences on bonding dynamics, i.e. on the way solidarity is structured in a given politicalcommunity.The book addresses these two questions in a broad historical and comparative perspective. The first chapter sets out a novel theoretical framework which re-conceptualizes the welfare state as a 'bounded space' characterized by a distinct spatial politics. This reconceptualization takes as a starting point the 'state-building tradition' in political science and in particular the work of Stein Rokkan. The second chapter briefly outlines the early emergence and expansion of European welfare statestill World War II. Chapters 3 and 4 analyse the relationship between domestic welfare state developments and the formation of a supranational European Community between the 1960s and the 2000s, illustrating how the process of European integration has increasingly eroded the social sovereignty of thenation-state.
