Book Brownfields Tax Incentive Extension

Download or read book Brownfields Tax Incentive Extension written by Mark E. Anthony Reisch and published by . This book was released on 2006 with total page 5 pages. Available in PDF, EPUB and Kindle. Book excerpt: The brownfields tax incentive expired on December 31, 2005. Enacted in 1997, the provision allowed a taxpayer to fully deduct the costs of environmental cleanup in the year the costs were incurred (called "expensing"), rather than spreading the costs over a period of years ("capitalizing"). The provision was adopted to stimulate the cleanup and development of less seriously contaminated sites by providing a benefit to taxpaying developers of brownfield properties. Two bills that received congressional attention contained extensions of the provision; in one case (H.R. 4297,P.L. 109-222), the bill was dropped in conference, and in the other (H.R. 5970), the bill passed the House but failed in the Senate. Nevertheless, in each of its budget proposals since FY2003, the administration has suggested that Congress make the tax incentive permanent. Information on the extent of use of the brownfields tax incentive cannot be determined from federal income tax returns. However, to take advantage of the tax break, a developer had to obtain a certification from the state environmental agency that the site qualified as a brownfield. CRS surveyed the agencies of all states in 2003 to ask how many applications they had received and approved. Twenty-seven states reported that they had received brownfield tax incentive applications, for a total of 161 application, of which 147 were approved. The other 23 states reported that they received no requests for certification.

Book Brownfields Programs and Tax Incentives are Stimulating the Redevelopment of Brownfields Properties in North Carolina and South Carolina

Download or read book Brownfields Programs and Tax Incentives are Stimulating the Redevelopment of Brownfields Properties in North Carolina and South Carolina written by Farah Rodenberger and published by . This book was released on 2014 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Article addresses (1) liability that developers face for cleanup costs associated with brownfield sites, which are contaminated properties as defined by statutes and regulations, regardless of whether they have caused or contributed to the contamination at the sites; (2) federal, North Carolina, and South Carolina brownfield programs offering some liability protection to developers; and (3) tax incentives enacted to encourage developers to redevelop these brownfield sites. The Article begins with a discussion of potential liability under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) (more commonly known as the Superfund law). The Article then reviews federal tax legislation (including the Taxpayer Relief Act, enacted in 1997, and the Small Business Liability Relief and Brownfields Revitalization Act, enacted in 2002) to boost funding for assessment and cleanup of brownfields, to enhance state response programs, and to clarify Superfund liability. The Article similarly reviews North Carolina and South Carolina brownfield programs and tax incentives serving to address assessment and cleanup of brownfields, Superfund liability, and liability protections. The Article notes that business developers are wary of brownfields primarily because of the possibility of facing environmental liability and the high costs associated with environmental cleanups. The Article comments that brownfield revitalization legislation offers certain protections against liability and permits developers to perform less costly cleanups determined by land use restrictions and other factors, and financial incentives to develop brownfields in the form of deductions, tax exclusions, and other tax incentives. The author recognizes that business developers rarely select business locations based solely on the availability of brownfield programs and tax incentives, and also consider factors such as population, education, existing infrastructure, and access to transportation. The author concludes, however, that all other factors being equal, federal, North Carolina, and South Carolina brownfield programs and tax incentives may ultimately determine the final selection of a location for business.
