Available in PDF, EPUB and Kindle. Book excerpt: Every four years, Congress gathers to count electoral votes and certify a winner of the presidential election. That process is usually uneventful. No longer--on January 6, 2021, supporters of former President Donald Trump stormed the Capitol, seeking to overturn President-elect Joe Biden's victory. There is a law meant to prevent the chaos of that day: the Electoral Count Act of 1887 (the "ECA").1 This book will examine the ECA and argue that it is badly in need of reform.

Book Proposals for Presidential Election Reform

Available in PDF, EPUB and Kindle. Book excerpt: The National Popular Vote (NPV) initiative proposes an agreement among the states, an interstate compact that would effectively achieve direct popular election of the President and Vice President without a constitutional amendment. This book monitors the NPV's progress in the states and identifies and provides an analysis of further developments as warranted. When Americans vote for President and Vice President, they are actually choosing presidential electors, known collectively as the Electoral College. It is these officials who choose the President and Vice President of the United States. The complex elements comprising the Electoral College system are responsible for one of the most important processes of the American political and constitutional system: election of the President and Vice President. A failure to elect, or worse, the choice of a chief executive whose legitimacy might be open to question, could precipitate a profound constitutional crisis that would require prompt, judicious, and well-informed action by Congress. This book discusses the contemporary issues for Congress and how the Electoral College works in contemporary presidential elections.

This book was released on 2014-12-12 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The electoral college method of electing the President and Vice President was established in Article II, Section 1 of the Constitution, as revised by the Twelfth Amendment. It provides for election of the President and Vice President by electors who are themselves elected by the voters. A majority of 270 of 538 electoral votes is necessary to win. For further information on the electoral college system's operations, see CRS Report RL32611, The Electoral College: How It Works in Contemporary Presidential Elections, by Thomas H. Neale. The electoral college has been the subject of reform proposals since 1800. Constitutional and structural criticisms have centered on several of its features: it is not fully democratic, providing indirect election of the President; it can lead to the election of candidates who win the electoral college but fewer popular votes than their opponents or to contingent election in Congress if no candidate wins an electoral college majority; it results in electoral vote under- and over-representation between censuses; and that "faithless" electors can vote against the people's express choice. Legislative and political criticisms include the general ticket system, currently used in all states except Maine and Nebraska, which is said to disenfranchise voters who prefer the losing candidates in the states; various asserted "biases" that are alleged to favor different states and groups; and the electoral college "lock," which was once claimed to provide an advantage to Republican candidates, but is now said to favor Democrats. Electoral college reform options include the following: end it, mend it, or leave it alone. Proposals to end the electoral college almost always propose direct popular election, with the candidates winning the most popular votes nationwide elected. Almost all reform proposals would eliminate electors and award electoral votes directly by one of several methods: the general ticket system; the district system that awards electoral votes on a congressional-district and statewide-vote basis; and the proportional system that awards state electoral votes in proportion to the percentage of popular votes gained by each candidate. Despite more than 30 years of legislative activity from the 1940s through the late 1970s, proposed amendments never managed to win the constitutionally required two-thirds vote in both houses of Congress. Since 2004, some of the reforms identified above have been attempted in the states. District plan initiatives have been offered in California, Pennsylvania, Michigan, Virginia, and Wisconsin. Proportional plans have been proposed in Colorado and Pennsylvania. Nebraska has considered returning to the general ticket system. None of these, however, has been enacted to date.

Book excerpt: The United States Constitution provides for indirect election of the President and Vice President by a group of officials known collectively as the electoral college. For additional information on contemporary operation of the system, consult CRS Report RS20273, The Electoral College: How It Works in Contemporary Presidential Elections. Critics contend that the electoral college is archaic and undemocratic, that it provides an unfair advantage to less populous states; that the "winner-take-all" provision, by which most states award all their electoral votes to the candidates winning the most popular votes, deprives many voters of any influence in the election; and that the system has the potential to elect a President who receives more electoral votes, but fewer popular votes, than his principal opponent. Further, they assert, the contingent election process, by which Congress elects the President and Vice President if no candidates receive an electoral college majority, is even less democratic. For additional information on contingent election, consult CRS Report RS20300, Election of the President and Vice President by Congress: Contingent Election. Supporters maintain that the electoral college is an integral element of the federal system, that the need to accrue state-by-state majorities is a strong support of the two party system, and that the system has delivered clear electoral mandates in all but four elections since 1804. Following the closely contested presidential election of 2000, in which the winning candidates for President and Vice President gained fewer popular votes than their major party opponents, there was renewed congressional interest in electoral college reform. For additional information on electoral college contingencies and broader aspects of reform proposals, consult CRS Report RL30804, The Electoral College: An Overview and Analysis of Reform Proposals. Seven proposals to reform the electoral college system were introduced in the 107th Congress. H.J.Res. 3 (Representative Green of Texas), and H.J.Res. 5 (Representative Delahunt), eliminating the electoral college and substituting direct popular election of the President; H.J.Res. 1 (Representative Clyburn), H.J.Res. 18 (Representative Engel), and H.J.Res. 37 (Representative Clement) incorporating the "district" method of awarding electoral votes; and H.J.Res. 17 (Representative Engel), providing for proportional award of electoral votes. H.J.Res. 25 (Representative Leach) was a hybrid plan. No action was taken on these measures, other than referral to the House Committee on the Judiciary. Instead, attention in the 107th Congress focused on election administration reform. Book Proposals for Electrical College Refoirm

Download or read book Proposals for Electrical College Refoirm written by Charles T. Canady and published by DIANE Publishing. This book was released on 2000-08 with total page 58 pages. Available in PDF, EPUB and Kindle. Book excerpt: Hearing on reform of the electoral college. At present, when American vote for President, they are not actually casting their vote for President, but rather for a group of electors pledged to vote for a particular ticket. There are potential problems with this system. It is possible that the person who actually wins the electoral vote may receive fewer popular votes than his opponent. It is also possible that due to a strong third party candidate, no candidate will receive a majority of the electoral votes, and the election of the President would be carried out by the House of The proposals would amend the Constitution to abolish the Electoral College and provide for the direct election of the Pres. and V.P.

Book Counting the Vote

Download or read book Counting the Vote written by Joe Hribar and published by . This book was released on 2007 with total page 134 pages. Available in PDF, EPUB and Kindle. Book excerpt: "With each presidential election comes talk of a fundamental and significant change to our democracy. Every four years brings about discussion between political pundits and casual conversation between office coworkers. All this talk is about reforming, or in some cases dismantling, the Electoral College. Over the past several decades, numerous proposals to reform the Electoral College have been advanced. Adopting any one of these proposals would certainly have far-reaching effects on our future, but what about our past? What would have happened in 1960, for instance, if instead of the winner-take-all method of assigning electoral votes, a district method were in place? Would Kennedy still have won? Or how about in 2000, if a proportional method were used, could the mess in Florida have been prevented? This thesis seeks to answer these questions. Divided into three main sections, this thesis explains what the Electoral College is and how it works, details several proposals to reform the system, and allows users to explore how a reform proposal could have changed the outcome of a past presidential election"--Abstract.
