It provides for election of the President and Vice President by electors who are themselves elected by the voters. A majority of 270 of 538 electoral votes is necessary to win. The electoral college has been the subject of reform proposals since 1800. Constitutional and structural criticisms have centered on several of its features: it is not fully democratic, providing indirect election of the President; it can lead to the election of candidates who win the electoral college but fewer popular votes than their opponents or to contingent election in Congress if no candidate wins an electoral college majority; it results in electoral vote under- and over-representation between censuses; and that "faithless" electors can vote against the people's express choice. Legislative and political criticisms include the general ticket system, currently used in all states except Maine and Nebraska, which is said to disenfranchise voters who prefer the losing candidates in the states; various asserted "biases" that are alleged to favor different states and groups; and the electoral college "lock," which was once claimed to provide an advantage to Republican candidates, but is now said to favor Democrats. Electoral college reform options include the following: end it, mend it, or leave it alone. Proposals to end the electoral college almost always propose direct popular election, with the candidates winning the most popular votes nationwide elected. Almost all reform proposals would eliminate electors and award electoral votes directly by one of several methods: the general ticket system; the district system that awards electoral votes on a congressional-district and statewide-vote basis; and the proportional system that awards state electoral votes in proportion to the percentage of popular votes gained by each candidate. Despite more than 30 years of legislative activity from the 1940s through the late 1970s, proposed amendments never managed to win the constitutionally required two-thirds vote in both houses of Congress. Since 2004, some of the reforms identified above have been attempted in the states. District plan initiatives have been offered in California, Pennsylvania, Michigan, Virginia, and Wisconsin. Proportional plans have been proposed in Colorado and Pennsylvania. Nebraska has considered returning to the general ticket system. None of these, however, has been enacted to date.

Critics contend that the electoral college is archaic and undemocratic, that it provides an unfair advantage to less populous states; that the "winner-take-all" provision, by which most states award all their electoral votes to the candidates winning the most popular votes, deprives many voters of any influence in the election; and that the system has the potential to elect a President who receives more electoral votes, but fewer popular votes, than his principal opponent. Further, they assert, the contingent election process, by which Congress elects the President and Vice President if no candidates receive an electoral college majority, is even less democratic. Supporters maintain that the electoral college is an integral element of the federal system, that the need to accrue state-by-state majorities is a strong support of the two party system, and that the system has delivered clear electoral mandates in all but four elections since 1804. Following the closely contested presidential election of 2000, in which the winning candidates for President and Vice President gained fewer popular votes than their major party opponents, there was renewed congressional interest in electoral college reform. Seven proposals to reform the electoral college system were introduced in the 107th Congress. H.J.Res. 3 (Representative Green of Texas), and H.J.Res. 5 (Representative Delahunt), eliminating the electoral college and substituting direct popular election of the President; H.J.Res. 1 (Representative Clyburn), H.J.Res. 18 (Representative Engel), and H.J.Res. 37 (Representative Clement) incorporating the "district" method of awarding electoral votes; and H.J.Res. 17 (Representative Engel), providing for proportional award of electoral votes. H.J.Res. 25 (Representative Leach) was a hybrid plan. No action was taken on these measures, other than referral to the House Committee on the Judiciary. Instead, attention in the 107th Congress focused on election administration reform. Despite occasional close elections, this system has delivered uncontested results in 46 of 50 elections since adoption of the 12th Amendment, effective in 1804. Throughout this period, nevertheless, it has been the subject of persistent criticism and many reform proposals. Related measures fall into two basic categories: those that would eliminate the electoral college and substitute direct popular election of the President and Vice President, and those that would retain the existing system in some form and correct perceived defects. For additional information on electoral college contingencies and broader aspects of reform proposals, please consult CRS Report RL30804, The Electoral College: An Overview and Analysis of Reform Proposals, by L. Paige Whitaker and Thomas H. Neale. Three proposed constitutional amendments to change or replace the electoral college system were offered in the 108th Congress. Section 4 of H.J.Res. 28 (Representative Jesse Jackson, Jr., and others) sought to "ensure that each Elector votes for the candidate for President and Vice President who received a majority of the popular vote in the State." H.J.Res. 103 (Representative Gene Green and others) and H.J.Res. 109, (Representative Jesse Jackson, Jr., and others) and H.J.Res. 112 (Representative Zoe Lofgren) proposed replacing the electoral college system with direct popular election. In addition, another bill related indirectly to the electoral college system. H.R. 4867 (Representative Peter Deutsch and others) would have changed the requirements for congressional objections to the validity of electoral votes at the joint session of Congress at which electoral votes are counted and certified. No action beyond committee referral was taken during the 108th Congress on these measures. A state electoral college reform proposal also attracted attention in the 2004 elections. In Colorado, voters rejected a state constitutional amendment that would have replaced the existing general ticket system with a rounded proportional method of allocating electoral votes. This report remains available to Congress, but will be not be updated.
