Available in PDF, EPUB and Kindle. Book excerpt: In 1925 Leonard Rhinelander, the youngest son of a wealthy New York society family, sued to end his marriage to Alice Jones, a former domestic servant and the daughter of a "colored" cabman. After being married only one month, Rhinelander pressed for the dissolution of his marriage on the grounds that his wife had lied to him about her racial background. The subsequent marital annulment trial became a massive public spectacle, not only in New York but across the nation--despite the fact that the state had never outlawed interracial marriage. Elizabeth Smith-Pryor makes extensive use of trial transcripts, in addition to contemporary newspaper coverage and archival sources, to explore why Leonard Rhinelander was allowed his day in court. She moves fluidly between legal history, a day-by-day narrative of the trial itself, and analyses of the trial's place in the culture of the 1920s North to show how notions of race, property, and the law were--and are--inextricably intertwined.

Set against Iceland's stark landscape, Hannah Kent brings to vivid life the story of Agnes, who, charged with the brutal murder of her former master, is sent to an isolated farm to await execution. Horrified at the prospect of housing a convicted murderer, the family at first avoids Agnes. Only Tv=ti, a priest Agnes has mysteriously chosen to be her spiritual guardian, seeks to understand her. But as Agnes's death looms, the farmer's wife and their daughters learn there is another side to the sensational story they've heard. Book The Murder of Mary Ashford

Available in PDF, EPUB and Kindle. Book excerpt: Historical true crime comes to life with this fictionalized account of a nineteenth-century murder that changed the course of British legal history. England, 1817. In the small hours of May 27th, a young servant girl from the village of Erdington left a party in the company of a man with a bad reputation. A few hours later, Mary Ashford’s lifeless body was found drowned in a pond. Despite a seemingly solid alibi, Abraham Thornton is soon on trial for his life—only to be acquitted at the direction of the judge. Public opinion across the country is outraged, with everyone convinced that a murderer has evaded the gallows. In a last-ditch effort to find justice, Mary’s brother uses an archaic legal process to prosecute Thornton again, only to find himself confronted with an extraordinary challenge. In court, Thornton throws down a gauntlet and demands his legal right to trial by combat . . . and the outcome will alter the course of English legal history. A many-layered fictionalized account, The Murder of Mary Ashford examines the particulars of this famous case while exploring the birth of forensic investigation, the meaning of sexual consent, and the struggle of a modern state to emerge from its medieval heritage.

Book Restitution and the Politics of Repair

Download or read book Restitution and the Politics of Repair written by Magdalena Zolkos and published by Edinburgh University Press. This book was released on 2020-09-21 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: Analyses the social imaginary of undoing, repair and return underpinning the international norm of restitution-makingApproaches restitution not just as a legal norm of property return, but as a social imaginary and a cultural-psychoanalytic 'scene' of undoing, repair and returnBrings together philosophic-political, socio-legal and cultural-psychoanalytic approaches to the study of restitutionOutlines a heterogeneous and multifaceted idea of restitution emergent in modernity, and looks at the peripheries of the modern restitutive tradition in the search for alternatives and counter-traditionsThis book takes a unique approach grounded in political and cultural discourse to develop a political theory of restitution. Challenging assumptions about restitution in the Western legal and political tradition, where it has become nearly synonymous with reacquisition and where legal studies focus on material objects and claims to their ownership, Zolkos argues that the development of restitutive norms has been auxiliary to the emergence of modern state sovereignty, and excavates the restitutive tradition's mythical-religious substrate. Bringing together texts from within and outwith the Western canon of political theory and philosophy, including the writings of Grotius, Durkheim, Freud, and Klein, as well as Mary Shelley's Frankenstein, the book undertakes a dual task: reading literary texts as a political theorising of restitution, and reading political or sociological texts as literary narratives with distinctive 'restitutive tropes' of repair, undoing and return.

Available in PDF, EPUB and Kindle. Book excerpt: The concept of surplus captures the politics of production and also conveys the active material means by which people develop the strategies to navigate everyday life. Surplus: The Politics of Production and the Strategies of Everyday Life examines how surpluses affected ancient economies, governments, and households in civilizations across Mesoamerica, the Southwest United States, the Andes, Northern Europe, West Africa, Mesopotamia, and eastern Asia. A hallmark of archaeological research on sociopolitical complexity, surplus is central to theories of political inequality and institutional finance. This book investigates surplus as a macro-scalar process on which states or other complex political formations depend and considers how past people—differentially positioned based on age, class, gender, ethnicity, role, and goal—produced, modified, and mobilized their social and physical worlds. Placing the concept of surplus at the forefront of archaeological discussions on production, consumption, power, strategy, and change, this volume reaches beyond conventional ways of thinking about top-down or bottom-up models and offers a comparative framework to examine surplus, generating new questions and methodologies to elucidate the social and political economies of the past.
