Book excerpt: Property Rights in the Late Medieval Discussion on Franciscan Poverty contributes to our understanding of the history of the concept of individual natural rights by tracing the controversies surrounding the Franciscan ideal of absolute poverty from the 1250s to the 1320s. Virpi Makinen, Th.D., analyzes the complex legal, moral, and theological arguments for and against the Franciscan ideal of giving up all rights over property - an ideal that the Franciscans argued was in perfect imitation of Christ and the Apostles. Makinen pays particular attention to the concepts of rights, especially to the distinctions between dominion (dominium), right (ius) and factual use (usus facti). She discusses the arguments made by both the defenders of the Franciscan claim of apostolic poverty (Bonaventure and Bonagratia of Bergamo) and the attackers, most of whom were secular clerics (such as William of Saint-Amour, Gerard of Abbeville, Henry of Ghent, and Godfrey of Fontaines). Makinen then analyzes the support the Order received from the papacy, and how this support was undermined by Pope John XXII's vehement attack on the Franciscans in the 1320s. The book shows how the debate concerning Franciscan poverty gave rise to a new language of rights, which paved the way to the idea of individual natural rights.

Collective Action and Property Rights for Poverty Reduction: Insights from Africa and Asia examines how these two types of institutions, separately and together, influence quality of life and how they can be strengthened to improve the livelihoods of the rural poor. The product of a global research study by the Systemwide Program on Collective Action and Property Rights (CAPRi) of the Consultative Group on International Agricultural Research, this book draws on case studies from East Africa and South and Southeast Asia to investigate how collective action and property rights have contributed to poverty reduction. The book extends the analysis of these institutions beyond their frequently studied role in natural resource management by also examining how they can reduce vulnerability to different types of shocks. Essays in the volume identify opportunities and risks present in the institutions of collective action and property rights. For example, property rights to natural resources can offer a variety of advantages, providing individuals and groups not only with benefits and incomes but also with assets that can counter the negative effects of shocks such as drought, and can make collective action easier. The authors also demonstrate that collective action has the potential to reduce poverty if it includes more vulnerable groups such as women, ethnic minorities, and the very poor. Preventing exclusion of these often-marginalized groups and guaranteeing genuinely inclusive collective action might require special rules and policies. Another danger to the poor is the capture of property rights by elites, which can be the result of privatization and decentralization policies; case studies and analysis identify actions to prevent such elite capture.

These rules, both formal and informal, ease the flow of information and lessen transaction costs to facilitate such exchange. In this way, property rights foster economic growth. As social institutions, however, property rights are constructed in many ways and are not always efficient. In fact, in some contexts property rights can hinder economic and social exchange. Several scholars attribute persistent poverty in developing countries to such inefficient property rights (North 1990, Desoto 2000) Specifically, some scholars contend that as exchange increases and grows more complex, informal property rights are less effective in monitoring and enforcing agreements (Sen 1999; Easterly and Levine 2002; Rodrik 2004). They argue that formal property rights are needed to increase the benefits of cooperative solutions or the costs of defection. On that basis, policymakers, academics and others increasingly promote formal property rights as a means to reduce poverty. This poverty strategy, however, assumes that a primary goal of poverty reduction is to increase personal and national income through greater production of private goods. What happens then when one pursues a poverty-reduction strategy where the goal is to produce superior public goods such as improved education, greater access to quality health care or less domestic violence? Do the strategies complement each other or could they potentially conflict with each other? This thesis explored this potential poverty-alleviation paradox by using a case study methodology to examine the different conditions in which formal and informal property rights support a social infrastructure to alleviate poverty. The findings were mixed, but suggest that informal property rights play a significant role in the creation of social capital, which support formal property rights as well as help the most vulnerable people cope. The findings related to the role of social capital in the creation of public goods was unclear but suggest that a distinction between weak and strong ties may be important.

Book excerpt: Over the past three decades, average household wealth in the United States has declined among all but the richest families, with a near 80 percent drop among the nation's poorest families. Although the national debate about inequality has focused on income, it is wealth—the private assets amassed and passed on within families—that provides the extra economic cushion needed to move beyond mere day-to-day survival. Assets for the Poor is the first full-scale investigation into the importance of family wealth and the need for policies to encourage asset-building among the poor. Assets for the Poor shows how institutional mechanisms designed to encourage acquisition of capital and property favor middle-class and high-income families. For example, the aggregate value of home mortgage tax deductions far outweighs the dollar amount of the subsidies provided by Section 8 rental vouchers and public housing. Banking definitions of creditworthiness largely exclude minorities, and welfare rules have made it nearly impossible for single mothers to accumulate savings, let alone stocks or real estate. Due to persistent residential segregation, even those minority families who do own homes are often denied equal access to better schools and public services. The research in this volume shows that the poor do make use of the assets they have. Cash gifts—although small in size—are frequent within families and often lead to such positive results as homebuying and debt reduction, while tangible assets such as tools and cars help increase employment prospects. Assets for the Poor examines policies such as Individual Development Account tax subsidies to reward financial savings among the poor, and more liberal credit rules to make borrowing easier and less costly. The contributors also offer thoughtful advice for bringing the poor into mainstream savings institutions and warn against developing asset building policies at the expense of existing safety net programs. Asset-building for low-income families is a powerful idea that offers hope to families searching for a way out of poverty. Assets for the Poor challenges current thinking regarding poverty reduction policies and proposes a major shift in the way we think about families and how they make a better life.
