Book Compensating Landowners in the Vicinity of Airports

Download or read book Compensating Landowners in the Vicinity of Airports written by Magdalena Habdas and published by Taylor & Francis. This book was released on 2023-11-22 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: The purpose of this book is to consider the neighbour conflict arising between airports and neighbouring owners of land, particularly with residential uses, as well as to assess the existing solutions applied to manage or resolve that conflict. The book explains why the neighbour conflict between the airport and landowners is of a particular kind and what legal instruments are applied to address it in an attempt to balance the interests of opposing parties. Readers will develop an understanding of how the law operates when damage is caused by a legal act of the government and what the limits of compensable loss are. In addition, the reader will discover the economic foundations of possible solutions and why not all market losses are legally compensable. Key features of this book include: a consideration of key legal concepts such as neighbour law, nuisance, protection of property, land use restrictions, liability, and compensation to inform a unique analysis of neighbour law in the context of conflict between airports and neighbouring landowners; practical guidance on an airport’s legal liability towards neighbouring landowners; a comparative analysis of airport’s liability, compensation claims, their scope and economic effects; a comparative overview of planning and environmental solutions applied in a variety of jurisdictions; a discussion of valuation methods and challenges when loss of property value is the measure of compensation. The Author’s intention is to promote conscious and civil relations among market participants, as opposed to opportunistic and speculative behaviour. This book is important reading for lawyers, academics, PhD students and postgraduate students dealing with land use regulations, environmental law, compulsory purchase, eminent domain and expropriation issues, compensation for property restrictions, as well as with aviation law and legal aspects of airport operations.

Book Housing Law in Poland From the Cooperative Model to Flat Ownership

Download or read book Housing Law in Poland From the Cooperative Model to Flat Ownership written by Aleksandra Sikorska-Lewandowska and published by . This book was released on 2018 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Poland, the housing system is currently based on cooperative apartments and the ownership of premises. This is due to historical conditions, because in the post-war period it was decided to foster cooperative housing; while the development of private property was impeded. After 1989, there were rapid economic and social changes, which also affected the real estate sector. It became possible to buy cooperative flats for ownership. The construction of new apartments was rapidly started and a development market was established. The owners of tenement houses made efforts to return the taken property, many of them regained the buildings, although their technical condition was very bad. There is a shortage of apartments in Poland, both available for purchase and for rent. In this chapter, I intend to present the current ownership status of apartments in Poland and the process of changes that took place, but did not solve the problems.

Available in PDF, EPUB and Kindle. Book excerpt: Despite the common belief that they are found only in the common law tradition, trusts have long been known in mixed jurisdictions even where they have a civilian law of property. Trusts have now been introduced by legislation in a number of civilian jurisdictions, such as France and China. Other recent developments include the reception of foreign trusts through private international law in Italy and Switzerland and the inclusion of a chapter on trusts in Europe's Draft Common Frame of Reference. As a result, there is a growing interest in the ways in which the trust can be accommodated in civil law systems. This collection explores this question, as well as general issues such as the juridical nature of the trust, the role and qualifications of the trustee and particular developments in specific jurisdictions.

Book Postmortal succession on the example of Polish law in a comparative perspective

This book was released on 2024-02-12 with total page 201 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents numerous instruments which create postmortal succession on the example of Polish law. Alongside the solution in inheritance law, one may apply specific inheritance (e.g. of agricultural farms) that benefits only such heirs who meet additional requirements, as well as undertake legal acts that allow to decide on heritability (or non-heritability) character of rights and duties (e.g. within the contract of mandate or company contracts). There are also numerous legislative instruments that allow for succession otherwise than by inheritance so that particular persons (and not heirs) benefit after the decedent. Such instruments include regulations of civil law but also e.g. banking law, social insurance law which are often comparable with nonprobate instruments (or willsubstitutes) under American law or German Sonderrechtsnachfolge.

Download or read book Foundations of Property Law written by Christian von Bar and published by Oxford University Press. This book was released on 2023-08-25 with total page 481 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foundations of Property Law: Things as Objects of Property Rights is an abridged translation of the first volume of Christian von Bar's Gemeineuropäisches Sachenrecht -a milestone in European private law theory, and in comparative property law more broadly. Radical in content and scope, the English version examines the dynamics of interaction between the objects, contents, and holders of property. The conceptual framework of 'property law' is presented as a domain of erga omnes monopoly rights that govern the relationship between persons and objects of value. Within that framework, a reciprocal relationship is illustrated between "property rights" and their objects; property rights play a role in constituting the very objects ("things") in which they are held. With comprehensive comparative analysis, insights are gleaned from all the jurisdictions of the European Union and the United Kingdom, presenting a critical evaluation of property law systems in both Common and Civil Law traditions. This book joins all the national legal systems in a single inquiry, treating their traditions and arguments with the respect they deserve and taking advantage of the knowledge embodied in the diversity of European private law. A scholastic work, offering deep and unique insights into the European property law systems, Foundations of Property Law will quickly become a go-to resource for anyone interested in European private law and comparative property law.
