Book excerpt: International cooperation on public health is inherently multi dimensional, with a focus on building effective health systems. Towards this goal, the World Health Organization (WHO), the World Intellectual Property Organization (WIPO) and the World Trade Organization (WTO) have been working closely together, along with other international partners, for almost two decades to support global endeavours to improve health outcomes. As part of their efforts to help countries develop the capacity to deal with multi-dimensional challenges in the public health sector, the three organizations have launched the second edition of the trilateral study on Promoting Access to Medical Technologies and Innovation. Access to essential medicines and the lack of research to address neglected diseases have been a major concern for many years. To promote innovation and to ensure equitable access to all vital medical technologies, such as medicines, vaccines and medical devices, policy-makers need a clear understanding of the innovation processes that lead to new technologies and the ways in which these technologies are disseminated. This publication seeks to improve understanding of the interplay between the distinct policy domains of health, trade and intellectual property, and how they affect medical innovation and access to medical technologies. This second edition captures new developments in key areas since the launch of the first study in 2013. Among the new topics covered in this edition are antimicrobial resistance and cutting-edge health technologies. The publication provides updated data on health, innovation trends in the pharmaceutical sector, and trade and tariffs relating to medical products. It includes an updated overview of access to medical technologies globally and key provisions in regional trade agreements. It also takes account of developments in intellectual property legislation and jurisprudence. Since this study was completed prior to the COVID-19 outbreak, a standalone section on COVID-19 was added at the start of the publication to map the multiple challenges posed by the pandemic in relation to the integrated health, trade and IP policy frameworks set out in the study. It guides the reader to the parts of the main text that are particularly relevant to the issues raised during the pandemic. The publication is the result of a collaborative effort by the WHO, WIPO and the WTO, drawing together the three secretariats' respective areas of expertise. It is intended to inform ongoing technical cooperation activities undertaken by the three organizations and to support policy discussions. Drawing on longstanding experiences in joint technical cooperation activities, the publication has been prepared to serve the needs of policy-makers as well as lawmakers, government officials, delegates to international organizations, non-governmental organizations and researchers.

Doté de flexibilités, le régime mondial des brevets devait être en mesure d'évoluer pour répondre aux préoccupations de santé publique. Malgré une réactivité initiale au début du millénaire, le régime s'est néanmoins depuis figé. Un quart de siècle après sa mise en œuvre, la pandémie de COVID-19 dirige le feu des projecteurs sur une gouvernance mondiale hésitante reposant sur un régime en apparence immuable. Si le droit international explique en partie la complexité de la régulation de cette interface, l'économie politique, quant à elle, offre des pistes d'explication à sa remarquable immuabilité. Empruntant une conception élargie des communautés épistémiques, cette recherche indique que l'interface entre la gouvernance des brevets et de la santé publique est plongée dans une compétition épistémique entre deux réseaux d'experts : l'un plus conservateur et prônant le statu quo de la gouvernance des brevets, et l'autre plus réformiste prônant plus de flexibilité face aux préoccupations de santé publique. Cette compétition persistante a accentué la polarisation entre les défenseurs de chaque perspective et, conséquemment, contribué à la stagnation des initiatives de réforme multilatérales. Le présent travail s'appuie sur des analyses de réseaux sociaux retraçant d'abord l'activité de chacune des communautés épistémiques et l'interactivité entre elles. Des entrevues semi-dirigées permettent ensuite d'interroger la manière et le degré selon lesquels la compétition épistémique est vécue par les membres de ces communautés et affecte les débats multilatéraux internationaux. L'assemblage théorique et méthodologique de cette recherche permet de jeter un regard novateur sur les communautés épistémiques et sur leur influence dans une interface de gouvernance. Plus encore, cette recherche contribue aux discussions nouvellement ravivées sur l'avenir de l'interface de gouvernance entre les brevets et la santé publique.

Book excerpt: L'accord sur les ADPIC entrée en vigueur en 1994, est la concrétisation la plus achevée de la nouvelle organisation du commerce international et de sa relation avec la protection de la technologie. Cet accord a eu pour principe d'établir des normes minimales de protection pour les inventions brevetées. Il a généralisé la protection des inventions technologiques par la propriété intellectuelle en intégrant dans le domaine du commerce international, les produits de santé publique. Désormais, le médicament est devenu un produit commercial protégé par le brevet. Toutefois, la brevetabilité du médicament pose problème d'autant plus que les normes minimales de protection des inventions technologiques font l'objet d'une liberté d'interprétation par l'ensemble des Etats membres de l'OMC. D'une part, les Etats membres issus des pays développés font une interprétation renforcée des mesures de l'accord sur les ADPIC. Ils font primer leurs intérêts commerciaux sur les intérêts de santé publique et restreignent de ce fait les droits des utilisateurs de médicaments brevetés. D'autre part, les pays en voie de développement font une interprétation restrictive des dispositions de l'accord sur les ADPIC. Ils limitent le domaine de la brevetabilité des médicaments, quand ils ne font pas une transposition insuffisante des dispositions de l'accord sur les ADPIC dans leurs accords régionaux. L'étude de la différence d'application de l'accord sur les ADPIC par les états membres de l'OMC permet de ressortir les limites de cet accord en matière de protection de la santé publique. Cette conclusion nous emmènes à souhaiter une réforme de l'accord sur les ADPIC. Cette fois-ci en faisant la promotion d'un nouveau système de règlementation qui accorde aux pays en voie de développement, la capacité de protéger aux mieux les droits des utilisateurs des inventions pharmaceutiques brevetés. En outre, des propositions juridiques complémentaires au système actuel de brevet ont été présentées et qui nous pensons participera à une protection efficace de la santé publique.
