These are analysed in the transboundary waters, joint bodies for transboundary water cooperation and activities related to the implementation of transboundary water cooperation. A chapter on selected basins takes an in-depth look at the same aspects at the basin level. In the concluding chapter, achievements in the period 2017-2020 are highlighted and detailed recommendations are provided. The analysis presented in the second report is primarily based on the answers provided by the Parties in the reporting template, and the use of other sources is both limited and secondary to those responses"--page v.

These experiences were gathered through an extensive consultation process under the Water Convention. At its seventh session (Budapest, 17-19 November 2015) the Meeting of the Parties to the Water Convention formally adopted the principles and encouraged countries to use them. The principles seek to facilitate the establishment and work of joint bodies and ultimately to contribute to reaching a high level of cooperation between riparian States. The principles are highly relevant in the light of the opening of the Water Convention to all United Nations Member States and can assist countries in implementing one of its main obligations.

The principles are classified in two main categories. The first category presents principles related with the establishment of joint bodies, their structure and functions, including issues such as their tasks, their competence and mandate. The second category describes principles related with the operational aspects of joint bodies such as procedural considerations, financial and human resources.

Book excerpt: Cooperation over transboundary rivers, lakes and aquifers is critical to ensuring that water resources are managed in an equitable and sustainable manner, and the achievement of SDG6 (water). Transboundary waters also create social, economic, environmental and political inter-dependencies that make cooperation a precondition to sustainable development, peace and security. As the only target in the 2030 Agenda for Sustainable Development that makes explicit reference to transboundary cooperation, target 6.5 can play a catalytic role across multiple SDGs and targets. It can generate multiple benefits for the protection of human health, renewable energy provision, sustainable agriculture, climate adaptation, ecosystem protection, and peace and security. This publication presents the results of the initial reporting exercise on indicator 6.5.2 carried out in 2017-2018. It offers valuable insights into the progress achieved in establishing operational arrangements for transboundary waters, and the gaps that remain; and highlights that an acceleration in strengthening transboundary water cooperation is urgently needed to be able to face growing water challenges and prevent conflicts on water use.

With the increasing focus on transboundary cooperation as a part of the Sustainable Development Goal Framework, there is global recognition of transboundary water cooperation as a tool for improved governance and management of transboundary surface and groundwaters. However, there is not an agreed upon definition of transboundary water cooperation in the literature or in practice. This book develops the Four Frames of Transboundary Water Cooperation, which is a neutral modular framework for developing context-specific explanatory definitions of transboundary water cooperation in basins and aquifers. The Four Frames of Cooperation are legal, institutional, relational, and outcome. However, we need to move beyond defining cooperation to understand better measures of the quality and effectiveness of cooperative processes. The Weighted Model of Effective Cooperation presents a first step in qualitatively evaluating the effectiveness of transboundary water cooperation. This model defines effective transboundary water cooperation and operationalizes a method to evaluate the effectiveness of cooperative processes over internationally shared waters. Effective cooperation emphasizes the relational and outcome frames of cooperation while working towards equitability and sustainability. Together, the Four Frames of Cooperation and the Weighted Model of Effective Cooperation will improve the understanding of cooperation and encourage a detailed evaluation of the quality, success, and effectiveness of cooperative processes. This book will be of great interest to students and scholars of water resource management, water governance, and environmental politics. It will also appeal to policymakers and professionals working in the fields of water conflict, water diplomacy, and international cooperation.

Book excerpt: At the UN General Assembly in 1997, an overwhelming majority of States voted for the adoption of the United Nations Convention on the Law of the Non-Navigational Uses of International Watercourses – a global overarching framework governing the rights and duties of States sharing freshwater systems. Globally, there are 263 internationally shared watersheds, which drain the territories of 145 countries and represent more than forty percent of the Earth's land surface. Hence, inter-State cooperation towards the sustainable management of transboundary water supplies, in accordance with applicable international legal instruments, is a topic of crucial importance, especially in the context of the current global water crisis. This volume provides an assessment of the role and relevance of the UN Watercourses Convention and describes and evaluates its entry into force as a key component of transboundary water governance. To date, the Convention still requires further contracting States before it can enter into force. The authors describe the drafting and negotiation of the Convention and its relationship to other multilateral environmental agreements. A series of case studies assess the role of the Convention at various levels: regional (European Union, East Africa, West Africa, Central Asia, Central America and South America), river basin (e.g. the Mekong and Congo) and national (e.g. Ethiopia and Mexico). The book concludes by proposing how future implementation might further strengthen international cooperation in the management of water resources, to promote biodiversity conservation as well as sustainable and equitable use.

This paper mines relevant past work to generate guidance for monitoring the proposed SDG target related to transboundary water cooperation. Potential measures of water cooperation were identified, filtered and applied in three countries (Botswana, South Africa and Zimbabwe). Six indicators were ultimately determined as being suitable for measuring water cooperation. As the SDG process turns its focus to the selection of indicators, the indicators proposed in this paper may merit consideration

Christina Leb's analysis of the duty to cooperate and the related rights and obligations highlights the interlinkages between this duty and the principles of equitable and reasonable utilisation and the prevention of transboundary harm. In doing so, she considers the law applicable to both international watercourses and transboundary aquifers, and explores the complementarities and interaction between the rules of international water law and the related obligations of climate change and human rights law.
