Book excerpt: The Constitution grants Congress the power to promote the progress of science and the useful arts through the intellectual property clause. Scholars and the courts understand “progress” to mean an increase in the creation and dissemination of copyrighted works and patented inventions It is assumed that an increase, whether quantitatively and qualitatively, in intellectual works will advance social welfare and cause economic progress. Progress, however, is quite different from growth or advancement in the collective body of knowledge or technological skill-set. Progress requires human commitment of energy and time towards forward movement and an improvement from the status quo. Such human commitment towards improvement generates entrepreneurial activities drawing upon innovative and creative applications of knowledge and skills towards a specific and directed output. This article argues that intellectual property laws need to have a more contemporary understanding of progress, one that reflects the reality and practicality of how progress actually unfolds and shows how construing progress as making an impact on social and economic welfare through entrepreneurial activities may be a more contemporarily appropriate understanding we should strive for.

It is a vital modern concept which underlies geographic explorations and scientific and technological inventions as well as the desire to harness nature in order to increase human beings’ ease and comfort. With the advent of Western colonization and to the great detriment of the colonized, the notion of progress began to perniciously and pervasively permeate across cultures. This book details the impact of the notion of progress on the Nagas and their culture. The interaction between the Nagas and the West, beginning with British military conquest and followed by American missionary intrusion, has resulted in the gradual demise of Naga culture. It is almost a cliché to assert that since the colonial contact, the long evolved Naga traditional values are being replaced by Western values. Consequences are still being felt in the lack of sense of direction and confusion among the Nagas today. Just like other Indigenous Peoples, whose history is characterized by traumatic cultural turmoil because of colonial interference, the Nagas have long been engaged in self-shame, self-negation and self-sabotage.

The PIRLS program encompasses trend studies designed to monitor progress in reading achievement in an internationally comparative context. PIRLS 2001 and PIRLS 2006 both assessed primary school students in their fourth year of schooling (Grade 4 in the majority of countries). Progress in Reading Literacy in National and International Context is the second book to explore the influence of findings from the PIRLS surveys on different education systems. It presents a compilation of insights from 12 of the 35 countries that participated in PIRLS 2006. These insights relate to the impact of PIRLS on the systemic, governmental, administrative, and school-level aspects of the education systems featured and exemplify how PIRLS has influenced research initiatives, policy development, and national capacity-building. The primary aim of this book and its predecessor (Progress in Reading Literacy: The Impact of PIRLS 2001 in 13 Countries, edited by Knut Schwippert and published in 2007) has been to explore the opportunities that PIRLS’ findings hold for the development of education systems.
