Book excerpt: Excerpt from Railroad Legislation as Developed Up to Date: December 10, 1919 It seems useful to take stock at this time of the prog ress made by the present Congress during its first ses sion toward the enactment of legislation necessary to meet the railroad emergency. The controlling necessity for additional railroad legislation is to reestablish rail road credit, which failed even before the War under the system of regulation in force, and to save from bank ruptcy and ruin many, and perhaps most, of the railroads of the country because of the extraordinary increases in wages and in prices of fuel and other materials during federal control. Unless railroad credit is reestablished, it will be impossible for the railroads to reasonably keep pace with the growth of the country or to finance any sub stantial part of their requirements for extensions and betterments, generally estimated at one billion dollars annually. Let us therefore examine what Congress has proposed to date, and determine how far it meets this fundamental necessity, and what the country faces if these proposals are really as far as Congress means to go in solving the railroad problem. I believe these suggested modifications in and amendments to the interstate-com merce act would make it a complete and effective measure for securing reasonableness of rates and fairness of practices in the operation of interstate railroad lines, without undue preference to any individual or class over any others; and would prevent the recurrence of many of the practices which have given rise in the past to so much public inconvenience and loss. The committee was appointed under the following joint order of the General Court of the year 1905: - Ordered That a joint special committee, to consist of four members of the Senate and eleven members of the House, be appointed to sit during the recess of the General Court, to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations, and to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations. This order is in terms very broad. It empowers the committee "to revise, consolidate and arrange the general laws of the Commonwealth pertaining to railroad and street railway corporations," and also "to consider the expediency of such legislation in amendment thereof and in addition thereto as will better protect the interests of the public and of the investors in said corporations." Were the committee to comply literally with the terms of this order, it would be obliged to deal with the whole subject of the railroad and street railway legislation of the Commonwealth, and all the intricate and difficult problems that that legislation presents. It became apparent at once to the committee that it would be impossible for it to undertake any such comprehensive task. It has therefore limited the scope of its inquiry, and also of its action.
