Book excerpt: This profile provides a statistical overview of persons with disabilities, as defined by the Employment Equity Act as a persons "who have a long term or recurring physical, mental, sensory, psychiatric or learning impairment and who consider themselves to be disadvantaged in employment by reason of that impairment, or believe that a employer or potential employer is likely to consider them to be disadvantaged in employment by reason of that impairment", aged 15 to 64 years. The data are presented for Canada, the provinces and the territories. The source of the data is the 1991 Health and Activity Limitation Survey (HALS'91). HALS is a postcensal survey, first conducted after the 1986 Census and repeated after the 1991 Census.

[...] In contrast, 29.3% of people with intellectual disabilities are 15 to 24 years compared with only 6.7% of others with disabilities but 20.9% of people without disabilities. [...] While 43.3% with intellectual disabilities have needs in this area that are fully met compared with 32.4% of others with disabilities, 45.6% with intellectual disabilities have some level of unmet need, with 39.7% receiving some help and 5.9% receiving none of the help needed.

This situation is in good part the result of policy choices made by the federal government over the past, such as the transfer - starting in the late 1990s - of the employment insurance funds for [...] The measures included, under the Canadian Human Rights Act, adding the duty of work accommodation for people with disabilities; under the Canadian Charter of Rights and Freedoms, adding equality rights, with specific mention of people with physical and mental disabilities; and employment equity legis- lation for four designated groups, one of which was people with disabilities. [...] Other measures promoting the participation of disabled persons in the workforce were the five-year National Strategy for the Integration of Persons with Disabilities, new employment equity legislation with mandatory elements and the pilot launch of the Opportunities Fund for People with Disabilities. [...] The trend of devolution most relevant to employment and people with disabi- lities involves the transfer of employment insurance part II, programming and design, to the provinces and territories. [...] Innovations in income support directed at workers and employment for people with disabilities include the introduction of the EI compassionate benefit, the earnings exemption and automatic reinstatement rules in the Canada Pension Plan Disability (CPPD) program, and the Working Income Tax Benefit, which also has a disability supplement.1 The 2014 federal budget announced a new generation of LMAPDs.

Part 1 discusses the evolution of key disability conceptual models & classification systems that have evolved over several decades, and the main disability data sources based on these models & systems. Part 2, the most detailed section, provides an inventory of key laws, programs, & tax measures that target persons with disabilities in four areas: antidiscrimination legislation; activities of daily living & assistance in the home; income; and employment & learning. Part 3 summarizes the key issues relating to defining disability across government including: the complexity of disability definitions; the confusion between disability definitions, program objectives, and their eligibility criteria; and the need for improved communication & awareness. The final part highlights key government actions and next steps to address the major issues.
