Book A Comprehensive Tax Guide For Clergy 2014 for 2013 Tax Returns

Download or read book A Comprehensive Tax Guide For Clergy 2014 for 2013 Tax Returns written by Ricky E. Carr and published by First Edition Design Pub.. This book was released on 2013-11-06 with total page 49 pages. Available in PDF, EPUB and Kindle. Book excerpt: In one high-profile case, a couple's substantial contributions to a church were denied tax deductibility by the Internal Revenue Service. The couple appealed the IRS decision. The Court upheld the IRS's denial of significant charitable contribution deductions. There was no disputing that the couple made the contributions, or that the contributions were made to qualified 501(c)(3) organizations, or even that the value of the contributions was at least as much as the couple had reported. However, the couple failed to comply in some way with substantiation requirements of the Tax Code and Regulations, so their contribution deductions were denied. Durden v. Commissioner, T.C. Memo. 2012-140 (May 17, 2012), involved a Texas couple who claimed a deduction of $25,171 for cash contributions to their church in 2007. The church sent a letter of acknowledgement in January of 2008, but that receipt lacked a statement of whether any goods or services were provided to the Durdens in exchange for their contributions. In 2009, the IRS sent a notice to the couple disallowing their charitable contribution deduction for 2007. The couple obtained a second letter from the church which did include the proper statements. Nevertheless, the IRS denied the deduction because the Durdens failed to get a proper receipt from their church. In the IRS's view, the first acknowledgement was lacking a statement of whether goods or services were provided by the church, and the second acknowledgement was not a "contemporaneous" receipt, because it was not received by the Durdens by the due date for filing their original return for the year. Because the Durdens did not have proper receipts, the judge agreed with the IRS that the Durdens failed to comply with the substantiation requirements of IRC 170(f)(8). This case should represent a reminder that churches and charities need to supply donors with proper receipts. This case makes it clear that, ultimately, it is the taxpayer's responsibility to comply with the requirements for disclosure and substantiation in order to take charitable contribution deductions for gifts they have made. However, churches and charitable organizations should be familiar with the reporting and substantiation requirements so that they can help their donors comply. Our goal is to empower the clergy with the awareness and strategies they need to avoid tax pitfalls, so they are able to remain focused on fulfilling the Great Commission. keywords: Comprehensive, IRS, Tax Return, Financial, Tax, Guide, Clergy, Ministers, Preparation, Strategies, Returns, Maximize

Book Elkins Comprehensive Tax Guide 2014 Edition

Download or read book Elkins Comprehensive Tax Guide 2014 Edition written by Chad M. Elkins and published by CreateSpace. This book was released on 2013-12 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Tax Guide is an easy to use and understandable reference for anyone, including tax professionals, who prepare 2013 income tax returns. The Guide follows the flow of a tax return, from filing status and requirements through tax credits. It is primarily for use in preparing individual and small business tax returns, with chapters that include detailed discussions on employee travel and entertainment expenses, depreciation, and carrying on a trade or business as a sole proprietor, partnership, farmer, and S-Corporation. It also includes informative language and examples on classifying workers as employees vs. independent contractors, and reasonable salaries for S-Corporation shareholders. A unique feature of this Guide compared to others on the market is a chapter devoted to dealing with the IRS, which alone is worth getting this Guide as a reference. It includes detailed information on applicable penalties for underpayment of taxes, failure to file, failure to pay, and how to avoid paying penalties and interest. It discusses how taxpayers can meet the eligibility requirements for the IRS "Fresh Start" program which is designed to help financially distressed taxpayers resolve tax problems more quickly and relieve them of certain penalties. Also, First-Time Penalty Abatement and the "Fast Track Settlement Program" are addressed, which are IRS initiatives designed to help taxpayers. The chapter on dealing with the IRS includes a section on IRS audits that talks about IRS notices and the Agency's latest concentration on its audit-by-mail program. It discusses how to survive an IRS audit, how to handle a dispute over a tax liability, how to prepare a request for appeals, closing agreements, offers in compromise, and what happens in Tax Court. Perhaps the most important chapter in this Guide is the one about the "Patient Protection and Affordable Care Act," also known as Obamacare. This chapter discusses in detail all of the compliance and tax provisions of the law, including the additional 0.9% Medicare surtax on high-income earners, the 3.8% surtax on "net investment Income" of high-income earners, and the 2.3% excise tax on medical devices. The individual and employer mandates are discussed in detail, including penalties, exemptions, the IRS role in implementing the mandates, and the latest implementation timelines. While some IRS regulations and court cases are referred to in this Guide, the aim was to keep such references to a minimum. The goal was to discuss, in plain English, what is required and not required by tax laws and regulations without the legal jargon as much as possible, and to give understandable examples where needed. We believe our goal has been achieved by publishing this tax book.
