The products produced in the mode of poiesis are ‘digressive’ in that they operate off track; they resist the main stream of every day prose. They do so for various reasons and in various respects. Mostly, they are explained historically, relative to historical contexts and, that is, contrary to what they are meant to resist. Instead, this book investigates the modes of resistance, their epistemology of production, in short, the logic of digression. The method addresses the singular exemplarity of art and literature; it elucidates the impact of poiesis as an epistemological challenge and redefines the analysis of literature and art as branches of an Historical Epistemology. Proceeding from the state of affairs in 20th century criticism and aesthetics (Benjamin, Adorno, Blumenberg, Merleau-Ponty), the epistemology of representation (Whitehead, Canguilhem, Bachelard, Rheinberger) is revised in, and with respect to critical consequences (Derrida, Marin, de Man, Agamben). From literary criticism and critical legal studies to the scenario of the life sciences, the essays collected here redirect the logic of research towards the epistemological grounds of an aesthetics underneath the hermeneutics of every day life.

What is the value of fictions, metaphors, figures and scenarios in adjudication? This book develops three models to help answer that question: inquiry, artefacts and imagination. Legal language, it is argued, contains artefacts – forms that signal their own artifice and call upon us to do things with them. To imagine, in turn, is to enter a distinctive epistemic frame where we temporarily suspend certain epistemic norms and commitments and participate actively along a spectrum of affective, sensory and kinesic involvement. The book argues that artefacts and related processes of imagination are valuable insofar as they enable inquiry in adjudication, ie the social (interactive and collective) process of making insight into what values, vulnerabilities and interests might be at stake in a case and in similar cases in the future. Artefacts of Legal Inquiry is structured in two parts, with the first offering an account of the three models of inquiry, artefacts and imagination, and the second examining four case studies (fictions, metaphors, figures and scenarios). Drawing on a broad range of theoretical traditions – including philosophy of imagination and emotion, the theory and history of rhetoric, and the cognitive humanities – this book offers an interdisciplinary defence of the importance of artefactual language and imagination in adjudication.

The Rome of imperial conquest or of civil war? By whom is it ruled? By the glorious conqueror who extended universal peace, the rule of law, and infrastructure – roads and aqueducts – or by the detested tyrant who imposed domination? Or worse, the corruptor of republican liberty and source of putrefying decadence? Rome always returns, but which Rome? France presents itself as a privileged locus for Rome’s return since the beginnings of its history. The perennial recourse to ancient Rome – as model or anti-model – binds together a cohesive tradition. The logic of this gesture asserts a unity beyond modern identity politics, which depend on defining a “them” against “us,” to resist nativist assumptions about national character, French, German, Italian, American, etc. All share the same polysemous inheritance, for good or ill. All are Roman and all resist Rome without needing to agree on what exactly is shared. The unity underlying the discourse, however, no longer depends on defining Rome as an origin. Instead, Rome’s figuration persists discursively, as a translation: to be translated time and time again.

In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms.

Edmond Cros is a leading French Hispanicist whose work is unique in Continental theory because it brings Spanish and Mexican texts into current literary debates, which have so far centered mainly on the French and German traditions. Equally distinctive is the nature of his work, which Cros terms sociocriticism. Unlike most sociological approaches to literature, which leave the structure of texts untouched, sociocriticism aims to prove that the encounter with "ideological traces," and with antagonistic tensions between social classes, is central to any reading of texts. Cros's method distinguishes between the "semiotic and "ideological" elements within a text, and involves the patient, exacting reconstruction of the concrete text from these elements, a process that enables the sociocritic to interpret its fault lines, its internal contradictions - in the end , its irreducibly social nature. As its title suggests, Theory and Practice of Sociocriticism is structured in two parts. Its opening chapters analyze sociological theories of discourse, including those of Foucault, Bakhtin, and Goldman; in the second part, Cros applies theory to practice in readings of specific works: the film Scarface, contemporary Mexican poetry and prose (Octavio Paz, Carlos Fuentes), and the picaresque novel of the Spanish Golden Age. In their foreword, Jurgen Link and Ursula Link-Heer differentiate sociocriticism from other social approaches to literature and show how Cros's method works in specific textual readings. They emphasize his resistance to the reductive modes and "misreadings" that dominate much of contemporary theory. Edmond Cros is a professor of literary theory and Hispanic studies at the Universite Paul Valery in Montpellier, France, and Andrew W. Mellon Professor of Hispanic Studies at the University of Pittsburgh. Jurgen Link teaches at the Ruhr-Universitat Bochum and Ursula Link-Heer at the Universitat Siegen, both in West Germany.
