Available in PDF, EPUB and Kindle. Book excerpt: The collective volume “Modern Forms of Work. A European Comparative Study” evokes the intent to embody a reflection focused on modern labour law issues from a comparative perspective. A first set of essays contains national reports on modern forms of work. The second group contains some reflections regarding critical issues on digitalization, platforms and algorithms, analysing the different facets of the galaxy of digital work. The third group of essays flows into the section entitled “new balances and workers’ rights in the digital era”, a crucial topic in the debate. The complex of the writings, despite the diversity of approaches and methods, reveals the existence of a dense and inexhaustible dialogue between young scholars, at European and extra-European level. The analysis of new forms of work – the offspring of transnational processes of globalization and technologization – forms a fertile ground for experimenting a transnational dialogue on which young researchers can practice with excellent results, as this small volume confirms.

Book Changing Industrial Relations Modernisation of Labour Law

Download or read book Changing Industrial Relations Modernisation of Labour Law written by Marco Biagi and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 500 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thirty-three distinguished authorities in the field of labour and industrial relations law gather here to enhance and complement the work of the late Marco Biagi, a man who, at the time of his violent and untimely death, had shown himself to be the most insightful and committed international scholar in this complex and controversial and, as it proved, even dangerous field. The topics covered range over many of Professor Biagi's special interests, including the following: the formulation of a new basis for labour law that could resolve new issues; employee protection in corporate restructuring; the trend toward individual 'enterprise bargaining'; a new European employment policy and what it might entail; the growing phenomenon of 'flexibilisation'; the effects of an aging workforce; the crucial nexus of free trade, labour, and human rights; the promise of EU enlargement; and protection of part-time workers. There is a lot of insight, innovation, and just clear thinking in this wide-ranging and far-reaching book. It will be of exceptional value to scholars, lawyers, and others concerned with the extensive and unpredictable changes under way in today's world of work.

Download or read book Equity and Law written by María José Falcón y Tella and published by BRILL. This book was released on 2008 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Equity is a multi-faceted subject, an authentic crossroads of problems. The perspective of this study is, as a result, a mix of focuses, which includes: the philosophy of law, general legal theory, justice theory, the history of law, comparative law, legal dogma, etc. In this book, as in various earlier studies of the author, she uses the "three-dimensional" method, which facilitates a stratified focus in agreement with three levels: facts, norms, and values. The subject of equity has never been analysed as completely as in this work. It includes a dynamic study of the different types of equity throughout history and in the different legal systems; the concept, content, limits, functions and types of equity; the relationship between equity and related ideas, and equity in all the branches of the legal order.

Book Preliminary Injunctions Germany England Wales Italy and France

Download or read book Preliminary Injunctions Germany England Wales Italy and France written by Torsten Frank Koschinka and published by Kluwer Law International B.V.. This book was released on 2015-10-08 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: Every legal system, at the outset of court proceedings, has rules aimed at safeguarding parties' interests during the time needed to obtain a judgment on the merits. However, as the European Commission put the case in a 1997 communication, 'a comparative survey of national legislation reveals that there are virtually no definitions of provisional/protective measures and that the legal situations vary widely. The only convergence that can be ascertained is between the function of such measures.' Recognizing that after almost twenty years the issues noted by the Commission have not found a satisfactory solution, here at last is a book that collects and compares the ideas behind the 'preliminary injunction' (an expression the authors use as a general term for a great variety of provisional and precautionary measures) with an eye to defining and organizing this small but very important aspect of the law. Although the analysis touches on relevant measures from many countries, the authors focus on the national legislation in four EU Member States – England, France, Germany, and Italy – to highlight the nature of the differences these kinds of measures entail. They compare and contrast such aspects as the following: – differences in civil procedure; - the types of measures that may be taken; - the terms on which preliminary injunctions, which are normally directly enforceable, may be ordered by a court; - the kind of assets that may be affected; - the relationship between proceedings in an interlocutory action and proceedings on the substance; - necessity of credible evidence that immediate and irreparable injury, loss, or damage will result if no preliminary injunction is granted; and - the role of protective measures in summary proceedings. The study also describes and examines the recent European order for payment (EC Regulation No. 1896/2006), the most significant existing transnational instrument aimed at granting preliminary protection of creditors' rights. This incomparable book represents a major contribution to a growing debate, particularly in Europe, on ways and means of securing equivalent protection for all litigants. Given the variety of legal systems and of measures available, the debate will have to focus on the functions served by provisional/protective measures, the minimum conditions to be satisfied, the adversary procedure requirement, the enforceability of the measures, and possible redress procedures. There is no more thorough and reliable resource available to clarify these issues for practitioners and interested policymakers everywhere.

Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient volume provides comprehensive analysis of the legislation and rules that determine civil procedure and practice in Italy. Lawyers who handle transnational matters will appreciate the book’s clear explanation of distinct terminology and application of rules. The structure follows the classical chapters of a handbook on civil procedure: beginning with the judicial organization of the courts, jurisdiction issues, a discussion of the various actions and claims, and then moving to a review of the proceedings as such. These general chapters are followed by a discussion of the incidents during proceedings, the legal aid and legal costs, and the regulation of evidence. There are chapters on seizure for security and enforcement of judgments, and a final section on alternative dispute resolution. Facts are presented in such a way that readers who are unfamiliar with specific terms and concepts in varying contexts will fully grasp their meaning and significance. Succinct, scholarly, and practical, this book will prove a valuable time-saving tool for business and legal professionals alike. Lawyers representing parties with interests in Italy will welcome this very useful guide, and academics and researchers will appreciate its comparative value as a contribution to the study of civil procedure in the international context.

Book Work Life Balance and the Economic Crisis

Download or read book Work Life Balance and the Economic Crisis written by Anthony Forsyth and published by Cambridge Scholars Publishing. This book was released on 2015-10-28 with total page 310 pages. Available in PDF, EPUB and Kindle. Book excerpt: No one can deny the significance attributed to the issue of reconciling work and private life by contemporary society, the EU and other international organisations. Its relevance is evident in the multifaceted nature of this topic and the need for each party to the employment contract to strike a proper balance between professional and personal responsibilities, based on the assumption that people can successfully harmonise their work with life. Following on from these considerations, this volume provides a detailed analysis of work-life balance and its regulation in a number of EU countries, emphasizing the consequences that the current economic crisis has brought about in this field.--

This book was released on 2020-04-09 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: Doctor at the court and academic of the Modena and Padua Universities, Bernardino Ramazzini (1633-1714) lived in the second half of the seventeenth century. Without renouncing to his vocation as a doctor, he visited the craft workshops to identify the threats to health, examined the diseases of workers and proposed a variety of preventive measures. Aware of the need to avoid extremes of all kinds, he recommended moderation in all types of behaviour. The expression «prevention is far better than cure» summarises his precept. Through the description of the context in which he lived and the analysis of his observations and proposals, the essay explores Ramazzini’s main works by revisiting his thinking in a contemporary way, highlighting the modernity of his anticipatory reflections and focusing on his visionary ideas.

Book A Thousand Little Machines A traverso and the Movement of 77

Download or read book A Thousand Little Machines A traverso and the Movement of 77 written by Franco Berardi and published by Agit Press. This book was released on 2024-03-18 with total page 114 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1977 youth revolts spectacular in their intensity, creativity and violence would send shockwaves throughout Italian society. These rebellions, belonging to the autonomia movement, were characterised by a mass refusal of wage-labour and powered by novel experiments in communication, in particular the printed word. Hundreds of revolutionary newspapers known as ‘movement sheets’ would circulate Italy during those years, acting as little machines to produce political subjectivity. This book contains the recollections of the autonomist militant, philosopher and media theorist Franco ‘Bifo’ Berardi on autonomia and the tumultuous events of ’77, told through the pages of A/traverso, the Bolognese movement sheet he produced with others between 1975 - 1981. In texts translated into English for the first time, presented alongside extensive archival material and stunning photographs, this book explores the subversion, exuberance and joy of the movement of ’77, while raising important questions about the role of creative collectivity and experimental communication for militants today. Texts by Franco ‘Bifo’ Berardi, Ryan Duffy, Dante Philp, Nick Thoburn, Jamila Squire & Seth Wheeler. Foreword by Bobby Gillespie, Primal Scream. Translated by Ivana Bevilacqua, Matthew Lee and Lukasz Risso. Cover design & layout by Tom Greenwood. Internal design by Tom Greenwood, Jamila Squire & Seth Wheeler.
