Book excerpt: La scarsa attenzione riservata al processo esecutivo dalla dottrina (almeno sino a tempi recenti) e il limitato spazio che esso occupa nella formazione del giurista medio sono fatti tanto noti quanto sorprendenti e sono altresì fonte di problemi ogni qual volta occorra ottenere per via giurisdizionale ed in modo forzoso la concreta soddisfazione di un diritto. Di qui l’esigenza di strumenti che consentano di meglio padroneggiare i molteplici e talvolta complessi strumenti che l’ordinamento fornisce a tutela del creditore. Questo formulario vuole essere, appunto, un utile strumento di lavoro: non è un’ambizione da poco se si considera la varietà delle situazioni che nel corso del processo esecutivo può accadere di dovere affrontare e che – spesso – comportano la soluzione di problemi di diritto non solo processuale ma anche sostanziale, negli ambiti più disparati. Uno strumento, ovviamente, va usato con criterio: le formule qui raccolte sono proposte nate dall’esperienza e vanno comunque utilizzate adattandole alla concreta situazione, tenendo ben presenti, in particolare, i diversi orientamenti riscontrabili su parecchie questioni cruciali e la necessità di adottare soluzioni che – per quanto possibile – evitino lo stesso insorgere di problemi. Per questo motivo, il sintetico commento che accompagna le formule ha mirato ad evidenziare i punti maggiormente controversi e a dare il massimo spazio possibile alla giurisprudenza in argomento (specie a quella più recente), fornendo così materiale utile per scelte più consapevoli, magari diverse da quelle qui suggerite. Per far progredire più rapidamente e più efficacemente il processo esecutivo anche in periodo di crisi si sono succeduti interventi legislativi – nel 2006, nel 2009, nel 2013, nel 2014, nel 2015 e anche nel 2016 – che hanno riscritto buona parte del libro terzo del codice di procedura civile. La necessità di rincorrere le continue novità del legislatore – da ultimo, il d.l. n. 59 del 2016, convertito dalla l. n. 119 del 2016 (che segue di poco l’entrata in vigore del d.l. n. 83 del 2015, convertito dalla l. n. 132 del 2015, il quale faceva breve seguito al d.l. n. 132 del 2014, convertito dalla l. n. 162 del 2014) – comporta costanti aggiornamenti sulle innovazioni, non sempre e non tutte adeguatamente meditate. Sulle problematiche applicative delle novelle si esprimeranno la giurisprudenza e la dottrina; in questo testo sono state comunque analizzate ed illustrate le principali questioni allo scopo di individuare pratiche soluzioni interpretative.

In The Fascist Effect, Reto Hofmann uncovers the ideological links that tied Japan to Italy, drawing on extensive materials from Japanese and Italian archives to shed light on the formation of fascist history and practice in Japan and beyond. Moving between personal experiences, diplomatic and cultural relations, and geopolitical considerations, Hofmann shows that interwar Japan found in fascism a resource to develop a new order at a time of capitalist crisis. Japanese thinkers and politicians debated fascism as part of a wider effort to overcome a range of modern woes, including class conflict and moral degeneration, through measures that fostered national cohesion and social order. Hofmann demonstrates that fascism in Japan was neither a European import nor a domestic product; it was, rather, the result of a complex process of global transmission and reformulation. By focusing on how interwar Japanese understood fascism, Hofmann recuperates a historical debate that has been largely disregarded by historians, even though its extent reveals that fascism occupied a central position in the politics of interwar Japan. Far from being a vague term, as postwar historiography has so often claimed, for Japanese of all backgrounds who came of age from the 1920s to the 1940s, fascism conjured up a set of concrete associations, including nationalism, leadership, economics, and a drive toward empire and a new world order.
