Book excerpt: This short study was prepared by the Toronto Refugee Affairs Council in February 1988 in connection with changes in Canadian refugee legislation. It is in three sections: screening, reviewing, and alternative model. Under the present refugee screening process, a person arriving in or already in Canada can claim refugee status up to the point when that person may be removed from Canada. Part A of this study examines restrictions the Bill places on the right of a person to have his or her claim determined upon the merits. The Bill would require that all refugee claimants be screened before being permitted access to the refugee determination procedure. Section 45 of the Bill provides that persons thought to be inadmissible must make the request for refugee status at the outset of the immigration inquiry, before any evidence is taken. Failure to do so would preclude his or her ability to make another request without any consideration of the claim. In order to have a claim met persons must satisfy several criteria. For example, if the claimant is thought to be a national of a country that is on a list prepared by Cabinet, he or she will not be eligible to have the claim determined. The authors of this study fear that political considerations may influence the list of countries and the refugee determination process. Part B reviews screening decisions and convention decisions. Those denied access to the determination process may seek review of the screening decision on questions of law by the Federal Court of Canada, with leave of a Federal Court judge within fifteen days after receiving the decision. A person issued a removal order must leave Canada within 24 hours even if they have the application for leave to appeal. For a review of the Convention refugee decision, leave of a judge is not required and the person is allowed to remain in Canada during the legal proceedings. The authors then examine violations of rights and obligations associated with limited review. Part C provides an alternative model to the objectives of the screening procedures.
