Book excerpt: Excerpt from Proceedings of the Constitutional Convention of the Proposed State of Oklahoma: Held at Guthrie, Oklahoma, November 20, 1906 to November 16, 1907 The Delegates elected to the Constitutional Convention to be held in accordance with an Act of Congress entitled "An Act to enable the people of Oklahoma and of the Indian Territory to form a Constitution and State Government and be admitted into the Union on an equal footing with the original states; and to enable the people of New Mexico and of Arizona to form a Constitution and State Government and be admitted into the Union on an equal footing with the original states," approved June 16th, 1906, met in the Convention Chambers in the City of Guthrie, Oklahoma, on Tuesday, the 20th day of November, A. D. 1906, it being the second Tuesday after the election, at the hour of two o'clock p. m. Henry S. Johnston, of Perry, Oklahoma, Delegate-elect from the 17th District, arose and spoke as follows: The hour having arrived for the opening ceremonies of this Convention you will arise and attend prayer. The Rev. Frank Naylor, of Pawnee, will lead our thoughts in supplication to the Divine Presence. The Rev. Frank Naylor then offered a prayer as follows: Almighty and everliving God, we are devoutly thankful to Thee for the Providence that has brought us to this good hour. We thank Thee that from the conditions of a most discouraging nature, and struggles with poverty and disappointment. Thou hast made it possible for the conditions that obtain here today. We have been sent here In an earnest endeavor to frame a great Constitution for a great people and for generations which shall follow us. Thou hast not forgotten us In the past, we are needy now and ask Thee to continue Thy protective care over us. God bless the great mass of men, women and children who are anxiously awaiting the work of this body. Bless the men all over our State who earn their bread by the sweat of their brow. Book excerpt: Social classes collide over morality and social propriety in a brand-new state Well before the Volstead (or National Prohibition) Act of 1919, Oklahoma was dry. Oklahomans banned liquor at their state’s inception in 1907 and maintained the ban even after the repeal of national prohibition. In this book, James E. Klein examines the social and cultural conflicts that led Oklahomans to outlaw liquor and discusses the economic and political consequences of the ban. Grappling with Demon Rum identifies who favored and who opposed prohibition, showing that its proponents were largely middle-class citizens who disdained public drinking establishments and who sought respectability for a young state still considered a frontier society. Klein tells how the Oklahoma Anti-Saloon League orchestrated a dry campaign to raise moral standards, reduce crime, and improve the quality of life, twice convincing voters to support prohibition. Going beyond the usual evangelical-versus-ritualist, rural-versus-urban, and ethnocultural oppositions used by other historians to explain prohibition, Klein shows that Oklahoma’s immigrant and Catholic populations were too small to account for those voting against the measure—or for the large customer base that supported bootleggers. He points instead to the large number of working-class Oklahomans who patronized saloons, whether legal or not, and focuses on class conflict in early efforts to control alcohol. He also describes the trials of enforcement officers who worked to plug leaks in statewide and later national prohibition. A cultural and social history of liquor in early Oklahoma, Grappling with Demon Rum provides a fresh look at crusaders against vice at the regional level. In portraying this conflict between middle- and working-class definitions of social propriety, Klein provides new insight into forces at work throughout America during the Progressive Era.

Book excerpt: Unlike many national constitutions, which contain explicit positive rights to such things as education, a living wage, and a healthful environment, the U.S. Bill of Rights appears to contain only a long list of prohibitions on government. American constitutional rights, we are often told, protect people only from an overbearing government, but give no explicit guarantees of governmental help. Looking for Rights in All the Wrong Places argues that we have fundamentally misunderstood the American rights tradition. The United States actually has a long history of enshrining positive rights in its constitutional law, but these rights have been overlooked simply because they are not in the federal Constitution. Emily Zackin shows how they instead have been included in America's state constitutions, in large part because state governments, not the federal government, have long been primarily responsible for crafting American social policy. Although state constitutions, seemingly mired in trivial detail, can look like pale imitations of their federal counterpart, they have been sites of serious debate, reflect national concerns, and enshrine choices about fundamental values. In A Life on Fire, Connie Cronley tells the story of Catherine Ann “Kate” Barnard (1875–1930), a fiery political reformer and the first woman elected to state office in Oklahoma, as commissioner of charities and corrections in 1907—almost fifteen years before women won the right to vote in the United States. Born to hardscrabble settlers on the Nebraska prairie, Barnard committed her energy, courage, and charismatic oratory to the cause of Progressive reform and became a political powerhouse and national celebrity. As a champion of the poor, workers, children, the imprisoned, and the mentally ill, Barnard advocated for compulsory education, prison reform, improved mental health treatment, and laws against child labor. Before statehood, she stumped across the Twin Territories to unite farmers and miners into a powerful political alliance. She also helped write Oklahoma’s Progressive constitution, creating what some heralded as “a new kind of state.” But then she took on the so-called “Indian Question.” Defending Native orphans against a conspiracy of graft that reached from Oklahoma to Washington, D.C., she uncovered corrupt authorities and legal guardians stealing oil, gas, and timber rights from Native Americans’ federal allotments. In retaliation, legislators and grafters closed ranks and defunded her state office. Broken in health and heart, she left public office and died a recluse. She remains, however, a riveting figure in Oklahoma history, a fearless activist on behalf of the weak and helpless.
