They became a key element in the formation and self-understanding of the New Left, and have been the subject of continuing controversy. Partly because of their rise to prominence during the political turmoil of the sixties, and partly because they draw on traditions rarely studied in the Anglo-American world, the works of these authors are often misunderstood. In this book David Held provides a much-needed introduction to, and evaluation of, critical theory. He is concerned mainly with the thought of the Frankfurt school—Horkheimer, Adorno, Marcuse, in particular—and with Habermas, one of Europe's leading contemporary thinkers. Several of the major themes considered are critical theory's relation to Marx's critique of the political economy, Freudian psychoanalysis, aesthetics, and the philosophy of history. There is also a discussion of critical theory's substantive contribution to the analysis of capitalism, culture, the family, and the individual, as well as its contribution to epistemology and methodology. Held's book will be necessary reading for all concerned with understanding and evaluating one of the most influential intellectual movements of our time.

It discusses the distinguishing and opposing pathologies produced by globalization: unlimited individualism or self-obsession, manifested as (Promethean) omnipotence and (narcissistic) indifference, and endogamous communitarianism or an ‘us’-obsession that results in conflict and violence. The polarization between a lack and an excess of pathos is reflected in the distorted forms taken on by fear. The book advocates a metamorphosis of fear, which may restore in the subject an awareness of vulnerability and become the precondition for moral action. Such awareness and the recognition of the condition of contamination caused by the other’s unavoidable presence teach us to fear for rather than be afraid of. Fear for the world means care of the world, and care, understood as concern and solicitude, is a new notion of responsibility, in which the stress is shifted to a relational subject capable of responding to and taking care of the other. From a global perspective, the proposed vision of care also compels us to explore a new paradigm of justice.

Distinct conceptions of global justice differ in their specific criteria of global justice. However, they agree that the touchstone is how well our global institutional order is doing, compared to its feasible alternatives, in regard to the fundamental human interests that matter from a moral point of view. We are responsible for global regimes such as the global trading system and the rules governing military interventions. These institutional arrangements affect human beings worldwide, for instance by shaping the options and incentives of governments and corporations. Alternative paths of globalization would have differed in how much violence, oppression, and extreme poverty they engender. And global institutional reforms could greatly enhance human rights fullfillment in the future. The importance of this global justice approach reaches well beyond philosophy. It enables ordinary citizens to understand their options and responsibility for global institutional factors, and it challenges social scientists to address the causes of poverty and hunger that act across borders. The present volume addresses four main topics regarding global justice: The normative grounds for claims regarding the global institutional order, the substantive normative principles for a legitimate global order, the roles of legal human rights standards, and some institutional arrangements that may make the present world order less unjust. Early chapters focus on classical thinkers like John Locke and Adam Smith, while later chapters provide analyses of present-day classical liberals, focusing especially on F.A. Hayek, Thomas Sowell, and Larry Arnhart, the most prominent advocates of ‘contemporary’ classical liberalism. Thematically, the volume falls into three parts. Part I examines foundational matters, arguing that Darwinism and classical liberalism hold incompatible visions of morality, human nature, and individual autonomy. This section also contends that the free market’s spontaneous order is fully compatible with a teleological (or non-Darwinian) view of the universe. Part II turns to contemporary applications, contending that Darwinism and classical liberalism are at odds in their views of (or implications about) limited government, vital religion, economic freedom, and the traditional family. This section also argues that, since its inception, Darwinism has attenuated core tenets and values of classical liberalism and Western civilization. Part III of the volume contains alternative views to those in the first two parts, adding critical diversity to the book. Respectively, these chapters hold that Darwinian evolution simply has little to say about classical liberalism; an evolutionary account of human volition is fully compatible with the individual choice presupposed in classical liberalism; and evolutionary naturalism, unlike religious alternatives, provides a strong foundation for freedom, morality, and the traditional family.

Book excerpt: That the recent turn in European Constitutional Review has effectively brought about a revolution in European law has been observed before. At issue are two major developments in European judicial review. On the one hand, the European Court of Human Rights has been collapsing traditional boundaries between constitutional law and private law with a series of decisions that effectively recognized the "horizontal" effect of Convention rights in the private sphere. On the other hand, the European Court of Justice has also given horizontal effect to fundamental liberties embodied in the Treaty on the Function of the European Union in a number of recent cases in a way that puts "established" boundaries between Member State and Union competences in question. This book takes issue with these developments by bringing to the fore a key issue that the horizontality effect debate has hitherto largely overlooked, namely, the question of sovereignty. It shows with detailed references to especially the American debate on state action and the German debate on Drittwirkung that horizontal effect cannot be understood consistently without coming to grips with the conceptions of state sovereignty that inform different approaches to horizontal effect.
