Available in PDF, EPUB and Kindle. Book excerpt: This book presents a comprehensive analysis of personal participation in criminal proceedings and in absentia trials. Going beyond the accused-centred perspective of default proceedings, it not only examines the consequences of absence in various types of criminal proceedings, but also the fair trial safeguards allowing personal contributions during trials, as well as in pre-trial inquiries, higher instances and transborder procedures. By pursuing an interdisciplinary approach and employing comparative-law methodologies, the book presents a cross-section of twelve European criminal justice systems with regard to the requirements set forth by constitutional, international and EU law.

Download or read book Spanish Administrative Law Under European Influence written by Ortega Álvarez Ortega and published by Europa Law Publishing. This book was released on 2010 with total page 218 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is devoted to the study of the Europeanization of Spanish administrative law, and its scope results, therefore, from the intersection of two basic notions. On the one hand, Europeanization is understood here as a top-down process of innovation suffered by national law as an outcome of the structural principles which govern the relations between European and national systems. On the other hand, the book focuses on some of the most important institutions of Spanish general administrative law, in order to give a wide and comprehensive insight into the transformations of the system, thus going beyond the description of the transformations experienced by the regulation of concrete sectors of administrative action. Specifically, the main topics discussed include regulation of administrative procedure, case law on the right to good administration, public procurement law, public services regulation, interim measures in judicial review, and the evolution of administrative sanctions.
Download or read book Cross Cultural Dialogue as a Conflict Management Strategy written by J. Martín Ramírez and published by Springer. This book was released on 2018-04-11 with total page 163 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contributes to the current knowledge and research on conflict and cross-cultural dialogue, emphasizing how respect, tolerance and dialogue may be quite effective tools for bridging the diverse cultures and, consequently, for solving many of the conflicts of today’s world, characterized by a dynamic interchange of populations with very diverse cultural and ethnic backgrounds. For this purpose, we rely on reputed scholars from ten different countries, and from different cultures and fields of expertise, which allows for diverse contributions from a valuable interdisciplinary perspective. The first section of the book deals with the correlation between cultural differences and conflict, while also showing how such conflicts can be prevented and, should they arise, managed and solved. The second section addresses a different, more specific issue: how cultural expression means and tools for cultural communication may lead to conflict whereas they may help to avoid it as well. Finally, the third section analyzes how legal and justice systems deal with cross-cultural conflicts as well as with situations which may lead to cross-cultural conflicts, thus assessing to which extent such systems contribute to avoid and/or solve such kind of conflicts.
Download or read book Football Gambling and Money Laundering written by Fausto Martin De Sanctis and published by Springer. This book was released on 2014-05-05 with total page 179 pages. Available in PDF, EPUB and Kindle. Book excerpt: Professional football means many things to many people. For players, a means to possible fame and fortune. For fans, a source of local or national pride, and perhaps the chance to score with a few bets. For criminal organizations, a cover for making millions in corrupt enterprises. In the world of gambling this is no different. Football, Gambling, and Money Laundering describes in impressive detail the scope of the problem, the layers of denial that allow sports-related financial crime to flourish, and the steps that are being taken--and that need to be taken--to combat illicit operations in the sports world. Expert analysis explains criminal activity in the context of football, and how sports governing bodies, the media, and others have created a culture that regularly turns a blind eye. International data and instructive legal case examples shed light on the role of the Internet in the spread of gambling and money laundering as well as the strengths and weaknesses of current law enforcement, legislative, and sports-based efforts in fighting corruption. Included in the coverage: • Criminal activity in the sports world • Financial crime and exploitation in football and gambling • Legal wagering and illegal betting, including online • Illegal and disguised payment instruments used by organized crime • International legal cooperation in combating money laundering • National and international proposals for improving the sports and gambling industries to prevent money laundering An authoritative reference to a growing and wide-reaching concern, Football, Gambling, and Money Laundering will find an interested audience among academics, prosecutors, judges, law enforcement officials, and others involved in efforts to curb corruption and money laundering in the world of football.
Download or read book Money Laundering Through Art written by Fausto Martin De Sanctis and published by Springer Science & Business Media. This book was released on 2013-06-13 with total page 225 pages. Available in PDF, EPUB and Kindle. Book excerpt: The art world has been discovered by criminals as an effective way for money laundering and other clandestine activities on an international level. Unfortunately, in most countries investigators, prosecutors, judges, and regulatory agencies are not equipped to accurately detect, investigate and prosecute this type of criminal activity. Also, regulation and international laws and treaties involving the art world have many loopholes that can potentially lead to the laundering of large sums of money. This book provides a bird’s eye view of novel ways in which money laundering happens through illegal activities involving art. It can serve as a guide for law enforcement, prosecutors, judges, and others involved in efforts to curb money laundering and financing of terrorism, revealing why somehow new techniques used by criminals have been neglected by law enforcement in most countries. Drawing from his own experience with the matter in both Brazil and in the United States, the author makes a case for broader institutional and regulatory improvement, extending beyond mere regulation of the art market.
Download or read book Security in the Global Commons and Beyond written by J. Martín Ramírez and published by Springer Nature. This book was released on 2021-04-10 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book deals with two areas: Global Commons and Security: inextricably melted together and more relevant than ever in a world which is ever globalized and... with an incognita looming on the horizon: the effects of the Coronavirus pandemic upon the International Relations and globalization. Global Commons have always been relevant. It was Mahan who argued that the first and most obvious light in which the sea presents itself from the political and social point of view, is that of a great highway; or better, perhaps, of a wide common... Nowadays, this view has been further developed and, in addition to the unique legal implications that the Global Commons introduce, they are viewed, more and more intently, as a common pool of resources. Or perhaps, not that common... Resources, the key word! Which has to be always supplemented by two key words: access and security. And still, another one: data, the cyberspace contribution to the equation.

Download or read book Closing of the American Mind written by Allan Bloom and published by Simon and Schuster. This book was released on 2008-06-30 with total page 403 pages. Available in PDF, EPUB and Kindle. Book excerpt: The brilliant, controversial, bestselling critique of American culture that “hits with the approximate force and effect of electroshock therapy” (The New York Times)—now featuring a new afterword by Andrew Ferguson in a twenty-fifth anniversary edition. In 1987, eminent political philosopher Allan Bloom published The Closing of the American Mind, an appraisal of contemporary America that “hits with the approximate force and effect of electroshock therapy” (The New York Times) and has not only been vindicated, but has also become more urgent today. In clear, spirited prose, Bloom argues that the social and political crises of contemporary America are part of a larger intellectual crisis: the result of a dangerous narrowing of curiosity and exploration by the university elites. Now, in this twenty-fifth anniversary edition, acclaimed author and journalist Andrew Ferguson contributes a new essay that describes why Bloom’s argument caused such a furor at publication and why our culture so deeply resists its truths today.

Available in PDF, EPUB and Kindle. Book excerpt: This edition of the World Bank has been revised and expanded by the Terminology Unit in the Languages Services Division of the World Bank in collaboration with the English, Spanish, and French Translation Sections. The Glossary is intended to assist the Bank's translators and interpreters, other Bank staff using French and Spanish in their work, and free-lance translator's and interpreters employed by the Bank. For this reason, the Glossary contains not only financial and economic terminology and terms relating to the Bank's procedures and practices, but also terms that frequently occur in Bank documents, and others for which the Bank has a preferred equivalent. Although many of these terms, relating to such fields as agriculture, education, energy, housing, law, technology, and transportation, could be found in other sources, they have been assembled here for ease of reference. A list of acronyms occurring frequently in Bank texts (the terms to which they refer being found in the Glossary) and a list of international, regional, and national organizations will be found at the end of the Glossary.

Download or read book Enduring Reform written by Jeffrey W. Rubin and published by University of Pittsburgh Press. This book was released on 2020-02-24 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last twenty years, business responses to progressive reform in Latin America have shifted dramatically. Until the 1990s, progressive movements in Latin America suffered violent repression sanctioned by the private sector and other socio-political elites. The powerful case studies in this volume show how business responses to reform have become more open-ended as Latin America's democracies have deepened, with repression tempered by the economic uncertainties of globalization, the political and legal constraints of democracy, and shifting cultural understandings of poverty and race. Enduring Reform presents five case studies from Mexico, Brazil, and Argentina in which marginalized groups have successfully forged new cultural and economic spaces and won greater autonomy and political voice. Bringing together NGO's, local institutions, social movements, and governments, these initiatives have developed new mechanisms to work 'within the system,' while also challenging the system's logic and constraints. Through firsthand interviews, the contributors capture local businesspeople's understandings of these progressive initiatives and record how they grapple with changes they may not always welcome, but must endure. Among their criteria, the contributors evaluate the degree to which businesspeople recognize and engage with reform movements and how they frame electoral counterproposals to reformist demands. The results show an uneven response to reform, dependent on cultural as much or more than economic factors, as businesses move to decipher, modify, collaborate with, outmaneuver, or limit progressive innovations. From the rise of worker-owned factories in Buenos Aires, to the collective marketing initiatives of impoverished Mayans in San Crist—bal de las Casas, the success of democracy in Latin America depends on powerful and cooperative social actions and actors, including the private sector. As the cases in Enduring Reform show, the democratic context of Latin America today presses businesspeople to endure, accept, and at times promote progressive change in unprecedented ways, even as they act to limit and constrain it.
Download or read book On the Take written by Lindy Muzila and published by . This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite broad international recognition of the criminalization of illicit enrichment, it has not been universally accepted as an anti-corruption measure. Instead, criminalization of illicit enrichment continues to generate extensive debate and controversy. Against this background, this volume aims to provide an analysis of how illicit enrichment works, and attempts to shed light on any contributions that it has made to the fight against corruption and the recovery of stolen assets. Rather than delving into the theoretical and academic debates around illicit enrichment, this study focuses primarily on the analysis of current practice, case law, and existing literature to offer a new perspective to the on-going discussions. More specifically, the volume addresses the legal framework upon which the concept of illicit enrichment rests, and the resulting policy implications of that legal framework. It also focuses on illicit enrichment as an anti-corruption mechanism, from its roots as a response to the problems inherent to prosecutions involving corruption, to an examination of elements and inchoate offenses relating to illicit enrichment under international conventions. It examines illicit enrichment jurisprudence in the global context. An extensive survey was carried out to determine the countries where the offense exists, what form it takes, how often it is used, and for countries where it doesn't, what other measures are used in its place. The authors neither recommend nor oppose the adoption of illicit enrichment provisions, but rather aim to assist jurisdictions considering such steps by highlighting key questions that might arise during implementation, including how the offense is defined and enforced domestically by States. Similarly, the authors do not endorse nor criticize any practice carried out by States in the implementation of the criminalization of illicit enrichment. Ultimately, it is also hoped that this study provides a basis for further discussion amongst policy makers and practitioners, and fuels upcoming discussions by the Conference of State parties of the UNCAC and its Working Groups
