Book Professional Ethics at the International Bar

Download or read book Professional Ethics at the International Bar written by Arman Sarvarian and published by OUP Oxford. This book was released on 2013-09-26 with total page 1705 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the past twenty years, the volume of international litigation and arbitration has increased exponentially. As the number of new international courts and tribunals has proliferated, the diversity and volume of advocates appearing before the international courts has also increased. With this increase, the ethical standards that apply to counsel have become a growing field of interest to practitioners of public international law. Problems threatening the integrity of the international judicial process and concerns about divergent ethical standards amongst counsel have multiplied in the international judicial system, prompting early attempts by senior members of the 'international bar' to articulate common ethical standards. Professional Ethics at the International Bar examines the question of how to articulate common ethical standards for counsel appearing before international courts and tribunals, and the legal powers and practical ability of international courts to prescribe and enforce such standards. It conducts original research into both the theory and practice of the issues arising from this nascent process of professionalization. Using various sources, including interviews with judges, registrars, and senior practitioners, it argues that the professionalization of advocacy through the articulation of common ethical standards is both desirable and feasible in order to protect the integrity and fairness of the international judicial process.

Book Jewish European migr Lawyers

Download or read book Jewish European migr Lawyers written by Leora Bilsky and published by Wallstein Verlag. This book was released on 2021-08-16 with total page 230 pages. Available in PDF, EPUB and Kindle. English: Jewish émigré lawyers, historians, archivists and activists and their individual approaches to International Humanitarian Law. Jewish-European émigré lawyers in the twentieth century were important agents of legal internationalism and served as carriers of intercultural concepts of international legal thought; concepts, which fed into postwar discourses, but were also often forgotten or marginalized. This interdisciplinary volume focusses on a range of international lawyers, historians, archivists and activists and their individual approaches towards International Humanitarian Law. It uses a biographical lens to analyze the impact of subjective experiences like academic socialization, ideological and religious viewpoints (Weltanschauung), social marginalization, political and racial persecution, and forced emigration. Moreover, it investigates the extent to which the emigrants' experiences shaped typical notions of twentieth century politics and law, such as universalism and particularism, cosmopolitanism and sovereignty, national self-determination, citizenship and statelessness, collective minority rights, and individual human rights.

Book The Impact of the European Convention on Human Rights on Private International Law

Download or read book The Impact of the European Convention on Human Rights on Private International Law written by Louwrens R. Kiestra and published by Springer. This book was released on 2014-09-11 with total page 335 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book the interaction between the rights guaranteed in the European Convention of Human Rights (ECHR) and private international law has been analysed by examining the case law of the European Court of Human Rights (the Court) and selected national courts. In doing so the book focuses on the impact of the ECHR on the three main issues of private international law: jurisdiction, applicable law and the recognition and enforcement of foreign judgments. Next to a list of cases consulted and a comprehensive bibliography, the book offers brief introductions to PIL and the ECHR for readers who are less familiar with either of the topics. This makes the book not only a valuable tool for specialists and practitioners in the fields covered, but at the same time a well-documented basis for students and starting researchers specializing in either or both directions.

Book The Routledge History of Human Rights

Download or read book The Routledge History of Human Rights written by Jean Quataert and published by Routledge. This book was released on 2019-09-05 with total page 653 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Routledge History of Human Rights is an interdisciplinary collection that provides historical and global perspectives on a range of human rights themes of the past 150 years. The volume is made up of 34 original contributions. It opens with the emergence of a "new internationalism" in the mid-nineteenth century, examines the interwar, League of Nations, and the United Nations eras of human rights and decolonization, and ends with the serious challenges for rights norms, laws, institutions, and multilateral cooperation in the national security world after 9/11. These essays provide a big picture of the strategic, political, and changing nature of human rights work in the past and into the present day, and reveal the contingent nature of historical developments. Highlighting local, national, and non-Western voices and struggles, the volume contributes to overcoming Eurocentric biases that burden human rights histories and studies of international law. It analyzes regions and organizations that are often overlooked. The volume thus offers readers a new and broader perspective on the subject. International in coverage and containing cutting-edge interpretations, the volume provides an overview of major themes and suggestions for future research. This is the perfect book for those interested in social justice, grass roots activism, and international politics and society.
