This book addresses the impact and implications of private policing on public streets, and begins with a look at private policing from conceptual, historical, economic, legal and functional perspectives. These approaches provide the background for the text, which focuses on a private policing patrol program in a community on the south side of Chicago. The text also demonstrates a number of substantive legal and public policy issues which directly or indirectly relate to the provision of security services; some people see the need for a "dual system" of policing--one for the wealthy and one for the poor--and others see the provision of private security as the primary protective resource in contemporary America. The author also examines how private policing is different from and similar to public policing.

Book excerpt: The feasibility of contracting out specific nonessential police services and the effect on the future of California law enforcement was examined using the Fresno Police Department as a model. Nonessential police services included parking enforcement, burglary alarm response, completion of minor incident reports, investigation and reporting of non-injury traffic accidents, prisoner transportation, guarding prisoners at hospitals, and the arrest and transportation of shoplifting suspects to detention facilities. The Nominal Group technique was used to gather data and project future events and trends concerning issues of the future capability of local law enforcement to provide nonessential police services by 2001, types of nonessential police services private industry will be providing to the public by the year 2001, and cost-effectiveness of privatization of nonessential police services. The study showed that California law enforcement agencies could benefit from contracting out essential police services. In particular privatization would reduce personnel expenditures, with up to 51 percent salary savings as well as problems associated with costs of recruiting, training, and disciplining in-house employees involved in the performance of nonessential tasks. The money saved could be used to fight violent crime, drug related problems, and other community concerns.

Defenders of the state's monopoly on lawmaking and law enforcement typically assume that any alternative arrangement would favor the rich at the expense of the poor--or would lead to the collapse of social order and ignite a war. Questioning how well these beliefs hold up to scrutiny, this book offers a powerful rebuttal of the received view of the relationship between law and government. The book argues not only that the state is unnecessary for the establishment and enforcement of law, but also that non-state institutions would fight crime, resolve disputes, and render justice more effectively than the state, based on their stronger incentives.

Book excerpt: Following a general review of the trend toward the privatization of traditionally public services, the report addresses the impact of privatization on law enforcement, with particular attention to California. A scenario for planned and unplanned cities in the year 2000 considers law enforcement patterns likely if we plan or fail to plan for the future. Interviews with appropriate persons consider some of the issues in the development of private security enterprises as a form of privatization. The report then considers public law enforcement's attitude and approach toward this trend. Possible models for public-private law enforcement cooperation are then discussed, with attention to the findings of the Hallcrest Report. The report's most significant finding is that public law enforcement is largely unaware of the trend toward privatization in law enforcement and consequently has not developed a policy toward dealing with it. The study develops a strategy for addressing the issue at the local, regional, and statewide levels.
