Book Contractual Relations

  • Author : David Campbell
  • Publisher : Oxford University Press
  • Release : 2022-09-29
  • ISBN : 019885515X
  • Pages : 465 pages

Download or read book Contractual Relations written by David Campbell and published by Oxford University Press. This book was released on 2022-09-29 with total page 465 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written by one of the leading contributors to the relational theory of contract, Contractual Relations authoritatively explains the form of the existing law of contract by relating it to its economic, legal, and sociological foundations. This volume demonstrates that economic exchange and legal contract rest on a moral relationship by which each party legitimately pursues its self-interest through recognition of the self-interest of the author. This essential relationship of mutual recognition is in stark contrast to the pursuit of solipsistic self-interest that is central to the classical law of contract. Self-interest of this sort is not morally defensible, nor does it enhance economic welfare. It is for these reasons that the classical law is legally incoherent. The fundamental inadequacies of the classical law's treatment of agreement, consideration, and remedy have emerged as the doctrines of the positive law of contract have been progressively developed to give effect to the relationship of mutual recognition. The welfarist criticism of the classical law has, however, failed to develop a workable concept of self-interest, and so is at odds with what must be retained from the classical law's facilitation of economic exchange and the market economy. The relational law of contract restates self-interest in a morally, economically, and legally attractive manner as the foundation of the social market economy of liberal socialism. Contractual Relations is a fundamental critique of the classical law of contract and the welfarist response to the classical law, and an important statement of the relational theory of contract. This is a thoughtful and essential work for academics and research students in law, economics, and sociology.

Book Public or Private Goods

Download or read book Public or Private Goods written by Brigitte Unger and published by Edward Elgar Publishing. This book was released on 2017-03-31 with total page 299 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book explores the core public tasks that the state has traditionally provided but which increasingly are being privatized and subsumed by the private sector. The night-watchman state role of providing security is instead offered by private prisons and security guards. Legitimized by the argument of efficiency gains, social security including public housing, pensions, unemployment insurance and health care are all being gradually privatized. This book argues that on the basis of efficiency, morality and equality there is still an overwhelming need for public intervention – the res publica. Although the state still funds and regulates core domains, it provides fewer and fewer visible goods. The authors show how this apparent invisibility of the state presents serious challenges for both income equality and democracy.

Book Saved for a Purpose

Download or read book Saved for a Purpose written by James A. Joseph and published by Duke University Press. This book was released on 2015-07-23 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: The son of a minister, James A. Joseph grew up in Louisiana’s Cajun country, where his parents taught him the value of education and the importance of serving others. These lessons inspired him to follow a career path that came to include working in senior executive or advisory positions for four U. S. Presidents and with the legendary Nelson Mandela to build a new democracy in South Africa. Saved for a Purpose is Joseph’s ethical autobiography, in which he shares his moral philosophy and his insights on leadership. In an engaging and personal style, Joseph shows how his commitment to applying moral and ethical principles to large groups and institutions played out in his work in the civil rights movement in Alabama and as a college chaplain in California in the turbulent 1960s. His time later as vice president of the Cummins Engine Company provided an opportunity to promote corporate ethics, and his tenure as Under Secretary of the Interior in the Carter Administration underscored the difficulty and weight of making the right decisions while balancing good policy analysis with transcendent moral principles. In 1996 President Clinton selected Joseph to become the United States Ambassador to South Africa. His recollections of working with Nelson Mandela, whom he describes as a noble and practical politician, and his observations about what he learned from Desmond Tutu and others about reconciliation contain some of the book’s most poignant passages. Saved for a Purpose is unique, as Joseph combines his insights from working to integrate values into America’s public and private sectors with his long engagement with ethics as an academic discipline and as a practical guide for social behavior. Ultimately, it reflects Joseph’s passionate search for values that go beyond the personal to include the ethical imperatives that should be applied to the communal.
