Book excerpt: This book examines the legitimation of Private Military and Security Companies (PMSCs), focusing on the controversy between PMSCs and nongovernmental organizations (NGOs). While existing studies disproportionately emphasizes the ability for companies and their clients to dominate and shape perceptions of the industry, this book offers an alternative explanation for the oft-cited normalization of PMSCs and the trend to privatize security by analyzing the changing relationship between PMSCs and NGOs. It uses the concept of ‘norm entrepreneurship’ to elucidate the legitimation game between these two dissimilar actors. Starting from the 1990s, the book shows that the relationship between PMSCs and NGOs has undergone a transition by literally moving from ‘the barricades to the boardrooms’. After years of fierce advocacy and PR campaigns against PMSCs, today both actors increasingly collaborate in multi-stakeholder initiatives, elevating the status of PMSCs from a scorned actor to a trusted partner in the regulation of the industry. The work offers a comprehensive explanation of when and why this kind of collective norm entrepreneurship is likely to occur. Book excerpt: Private Military and Security Companies (PMSCs) have constituted a perennial feature of the security landscape. Yet, it is their involvement in and conduct during the ongoing wars in Iraq and Afghanistan that have transformed the outsourcing of security services into such a pressing public policy and world-order issue. The PMSCs’ ubiquitous presence in armed conflict situations, as well as in post-conflict reconstruction, their diverse list of clients (governments in the developed and developing world, non-state armed groups, intergovernmental and non-governmental organizations, and international corporations) and, in the context of armed conflict situations, involvement in instances of gross misconduct, have raised serious accountability issues. The prominence of PMSCs in conflict zones has generated critical questions concerning the very concept of security and the role of private force, a rethinking of "essential governmental functions," a rearticulation of the distinction between public/private and global/local in the context of the creation of new forms of "security governance," and a consideration of the relevance, as well as limitations, of existing regulatory frameworks that include domestic and international law (in particular international human rights law and international humanitarian law). This book critically examines the growing role of PMSCs in conflict and post-conflict situations, as part of a broader trend towards the outsourcing of security functions. Particular emphasis is placed on key moral, legal, and political considerations involved in the privatization of such functions, on the impact of outsourcing on security governance, and on the main challenges confronting efforts to hold PMSCs accountable through a combination of formal and informal, domestic as well as international, regulatory mechanisms and processes. It will be of interest to scholars, policymakers, practitioners and advocates for a more transparent and humane security order. This book was published as a special issue of Criminal Justice Ethics.

Book excerpt: Since the 1990s, private military and security companies (PMSCs) have intervened in civil wars around the globe. International, legally registered corporate actors have assisted governments with a myriad of tasks including combat support, logistics, army and police training, intelligence analysis, and guard services. However, reports that such contractors have been responsible for human rights abuses have spurred the need to evaluate the industry's impact on conflicts. Are these contractors effective in curbing violence or does emphasis on profit and lack of accountability get in the way? And how can governments improve PMSCs' commitment to contractual obligations, including adherence to international humanitarian laws? This book identifies two market forces that impact PMSCs' military effectiveness: local or conflict-level competition and global or industry-level competition. Specifically, Seden Akcinaroglu and Elizabeth Radziszewski challenge the assumption that interventions by profit-driven coporations are likely to destabilize areas engaged in war, and provide data that private contractors do contribute to conflict termination under certain circumstances. They argue that competitive market pressure creates a strong monitoring system and that the company's corporate structure and external competitive environment in a given conflict help to explain the variance in accountability to clients. Including an analysis of data on international PMSCs' interventions in civil wars from 1990-2008, Akcinaroglu and Radziszewski show the impact of competition on companies' contribution to the termination of different types of civil wars.

Book excerpt: This work examines the ability of existing and evolving PMC regulation to adequately control private force, and it challenges the capacity of international law to deliver accountability in the event of private military company (PMC) misconduct. From medieval to early modern history, private soldiers dominated the military realm and were fundamental to the waging of wars until the rise of a national citizen army. Today, PMCs are again a significant force, performing various security, logistics, and strategy functions across the world. Unlike mercenaries or any other form of irregular force, PMCs acquired a corporate legal personality, a legitimising status that alters the governance model of today. Drawing on historical examples of different forms of governance, the relationship between neoliberal states and private military companies is conceptualised here as a form of a ‘shared governance'. It reflects states’ reliance on PMCs relinquishing a degree of their power and transferring certain functions to the private sector. As non-state actors grow in authority, wielding power, and making claims to legitimacy through self-regulation, other sources of law also become imaginable and relevant to enact regulation and invoke responsibility.

Book excerpt: The Governor's Dilemma develops a general theory of indirect governance based on the tradeoff between governor control and intermediary competence; the empirical chapters apply that theory to a diverse range of cases encompassing both international relations and comparative politics. The theoretical framework paper starts from the observation that virtually all governance is indirect, carried out through intermediaries. But governors in indirect governance relationships face a dilemma: competent intermediaries gain power from the competencies they contribute, making them difficult to control, while efforts to control intermediary behavor limit important intermediary competencies, including expertise, credibility, and legitimacy. Thus, governors can obtain either high intermediary competence or strong control, but not both. This competence-control tradeoff is a common condition of indirect governance, whether governors are domestic or international, public or private, democratic or authoritarian; and whether governance addresses economic, security, or social issues. The empirical chapters analyze the operation and implications of the governor's dilemma in cases involving the governance of violence (e.g., secret police, support for foreign rebel groups, private security companies), the governance of markets (e.g., the Euro crisis, capital markets, EU regulation, the G20), and cross-cutting governance issues (colonial empires, "). Competence-control theory helps explain many features of governance that other theories cannot: why indirect governance is not limited to principal-agent delegation, but takes multiple forms; why governors create seemingly counter-productive intermediary relationships; and why indirect governance is frequently unstable over time.

They are contracted by governments, businesses, and NGOs to provide armed security. Often mistaken as members of armed forces, they are instead part of a new protean proxy force that works alongside the military in a multitude of shifting roles, and overseen by a matrix of contracts and regulations. This book analyzes the growing industry of these private military and security companies (PMSCs) used in warzones and other high risk areas. PMSCs are the result of a unique combination of circumstances, including a change in the idea of soldiering, insurance industry analyses that require security contractors, and a need for governments to distance themselves from potentially criminal conduct. The book argues that PMSCs are a unique type of organization, combining attributes from worlds of the military, business, and humanitarian organizations. This makes them particularly resistant to oversight. The legal status of these companies and those they employ is also hard to ascertain, which weakens the multiple regulatory tools available. PMSCs also fall between the cracks in ethical debates about their use, seeming to be both justifiable and objectionable. This transformation in military operations is a seemingly irreversible product of more general changes in the relationship between the individual citizen and the state. Many of the PMCs operating in these countries, such as the Wagner Group, frequently cooperate with the Russian government—including the Kremlin, Ministry of Defense (particularly the Main Intelligence Directorate, or GRU), Foreign Intelligence Service (SVR), and Federal Security Service (FSB)—and perform a variety of combat, paramilitary, security, and intelligence tasks. However, many of these PMCs have a poor track record—including operational failures and human rights abuses—and there are opportunities to exploit PMC vulnerabilities. Although Russian PMCs present only one of a variety of national security threats and challenges facing the United States, this report assesses that they warrant a more substantive and coordinated response from the United States and its partners.
