Book Law Morality and the Private Domain

Download or read book Law Morality and the Private Domain written by Raymond Wacks and published by Hong Kong University Press. This book was released on 2000-09-01 with total page 357 pages. Available in PDF, EPUB and Kindle. Book excerpt: Are judges morally accountable? Is legal validity value-free? Do animals have rights? These are some of the questions considered in this collection of essays. Moral problems, argues Professor Raymond Wacks, pervade the legal system, and he shows how the judicial function, the sources of legitimacy, and the protection of rights have an inescapable ethical dimension. The second part of the book focuses on the private domain and the legal concept of privacy. The extent to which the law ought to preserve a distinctly private realm is a pressing concern in our surveillance society in which personal information is increasingly collected, transferred, and stored. This controversial and difficult subject is one into which Professor Wacks, a leading expert in this field, is uniquely qualified to offer important insights. Raymond Wacks' analysis will be of interest not only to lawyers, legal philosophers, and students of law, but also to the general reader seeking an understanding of the jurisprudential underpinning of rights and moral values, their legal recognition, and practical application. Raymond Wacks is Professor of Law and Legal Theory at the University of Hong Kong. He is an international authority on the legal protection of privacy, and has also published widely in the field of legal theory.

Book The Market or the Public Domain

Download or read book The Market or the Public Domain written by Daniel Drache and published by Routledge. This book was released on 2005-07-08 with total page 412 pages. Available in PDF, EPUB and Kindle. Book excerpt: Examining the powerful idea of the return, reconstitution and redeployment of the public domain in a post-Seattle and post-Washington consensus world order, this innovative book is the most forward-looking and comprehensive examination of the need to rethink the tenants of global free trade. In the past two decades, countries have focused on broadening and guaranteeing market access, and as the pendulum swings back for the market, the issue of investing in the public domain becomes a priority. The authors believe that devising new institutions of governance for a globalizing world requires fundamental change nationally and internationally. They argue that new public spaces, places and services are required to strengthen democracy and create sanctuaries in society where the market mechanism cannot reach. The public domain is an incipient concept that enables states to reduce the intrusiveness of markets and at the same time develop a strong national performance to reduce the inequality and social exclusion in an increasingly volatile global economy. This original volume boasts an impressive list of international contributors who have demonstrated innovation and leadership in their fields. It will strongly appeal to advanced students, academics and policy makers involved in the field of global governance and international political economy.

Book A History of the Mishnaic Law of Purities Part 12

Download or read book A History of the Mishnaic Law of Purities Part 12 written by Jacob Neusner and published by Wipf and Stock Publishers. This book was released on 2007-04-01 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of Jews from the period of the Second Temple to the rise of Islam. From 'A History of the Mishnaic Law of Appointed Times, Part 1' This volume introduces the sources of Judaism in late antiquity to scholars in adjacent fields, such as the study of the Old and New Testaments, Ancient History, the ancient Near East, and the history of religion. In two volumes, leading American, Israeli, and European specialists in the history, literature, theology, and archaeology of Judaism offer factual answers to the two questions that the study of any religion in ancient times must raise. The first is, what are the sources -- written and in material culture -- that inform us about that religion? The second is, how have we to understand those sources in reconstructing the history of various Judaic systems in antiquity. The chapters set forth in simple statements, intelligible to non-specialists, the facts which the sources provide. Because of the nature of the subject and acute interest in it, the specialists also raise some questions particular to the study of Judaism, dealing with its historical relationship with nascent Christianity in New Testament times. The work forms the starting point for the study of all the principal questions concerning Judaism in late antiquity and sets forth the most current, critical results of scholarship.

Book Takings

  • Author : Richard A. Epstein

Download or read book Takings written by Richard A. Epstein and published by Harvard University Press. This book was released on 2009-07-01 with total page 377 pages. Available in PDF, EPUB and Kindle. Book excerpt: If legal scholar Richard Epstein is right, then the New Deal is wrong, if not unconstitutional. Epstein reaches this sweeping conclusion after making a detailed analysis of the eminent domain, or takings, clause of the Constitution, which states that private property shall not be taken for public use without just compensation. In contrast to the other guarantees in the Bill of Rights, the eminent domain clause has been interpreted narrowly. It has been invoked to force the government to compensate a citizen when his land is taken to build a post office, but not when its value is diminished by a comprehensive zoning ordinance. Epstein argues that this narrow interpretation is inconsistent with the language of the takings clause and the political theory that animates it. He develops a coherent normative theory that permits us to distinguish between permissible takings for public use and impermissible ones. He then examines a wide range of government regulations and taxes under a single comprehensive theory. He asks four questions: What constitutes a taking of private property? When is that taking justified without compensation under the police power? When is a taking for public use? And when is a taking compensated, in cash or in kind? Zoning, rent control, progressive and special taxes, workers’ compensation, and bankruptcy are only a few of the programs analyzed within this framework. Epstein’s theory casts doubt upon the established view today that the redistribution of wealth is a proper function of government. Throughout the book he uses recent developments in law and economics and the theory of collective choice to find in the eminent domain clause a theory of political obligation that he claims is superior to any of its modern rivals.

Book excerpt: These 13 essays by noted American and German scholars provide a focused discussion of many of the issues raised by the integration of philosophical and psychological theories of moral development. The essays pivot around two key contributions, by Lawrence Kohlberg and his associates and by JA1⁄4rgen Habermas. Kohlberg's major work was a description of the stages of development of moral understanding in children. This book contains the final formulation of his view of the end point of moral development (Stage 6). Habermas's insightful response to that formulation, which seeks to fit Kohlberg's perceptions into the framework of a communicative ethics, is an important extension of his own moral theory. In three parts, the essays map out the relationship between philosophy and psychology in the study of the moral domain, explore the way the moral point of view is understood within Kohlberg's cognitive-developmental model, and discuss the place of moral development in terms of various models of personality and decision making. The contributors are Augusto Blasi, Dwight R. Boyd, Rainer Dobert, Wolfgang Edelstein, JA1⁄4rgen Habermas, Helen Haste, Monika Keller, Lawrence Kohlberg, Charles Levine, Mordecai Nisan, Gil G. Noam, Gertrud Nunner-Winkler, Bill Puka, Ernst Tugendhat, and Thomas E. Wren. Thomas E. Wren is Professor of Philosophy at Loyola University of Chicago. The Moral Domain is included in the series Studies in Contemporary German Social Thought, edited by Thomas McCarthy.

Book Visual Domain Adaptation in the Deep Learning Era

Download or read book Visual Domain Adaptation in the Deep Learning Era written by Gabriela Csurka and published by Morgan & Claypool Publishers. This book was released on 2022-04-05 with total page 190 pages. Available in PDF, EPUB and Kindle. Book excerpt: Solving problems with deep neural networks typically relies on massive amounts of labeled training data to achieve high performance/b>. While in many situations huge volumes of unlabeled data can be and often are generated and available, the cost of acquiring data labels remains high. Transfer learning (TL), and in particular domain adaptation (DA), has emerged as an effective solution to overcome the burden of annotation, exploiting the unlabeled data available from the target domain together with labeled data or pre-trained models from similar, yet different source domains. The aim of this book is to provide an overview of such DA/TL methods applied to computer vision, a field whose popularity has increased significantly in the last few years. We set the stage by revisiting the theoretical background and some of the historical shallow methods before discussing and comparing different domain adaptation strategies that exploit deep architectures for visual recognition. We introduce the space of self-training-based methods that draw inspiration from the related fields of deep semi-supervised and self-supervised learning in solving the deep domain adaptation. Going beyond the classic domain adaptation problem, we then explore the rich space of problem settings that arise when applying domain adaptation in practice such as partial or open-set DA, where source and target data categories do not fully overlap, continuous DA where the target data comes as a stream, and so on. We next consider the least restrictive setting of domain generalization (DG), as an extreme case where neither labeled nor unlabeled target data are available during training. Finally, we close by considering the emerging area of learning-to-learn and how it can be applied to further improve existing approaches to cross domain learning problems such as DA and DG.
