Book excerpt: Excerpt from The Elements of Mercantile Law As I have stated before, I have not attempted any original research, thinking my duty to the reader to be better performed if I made statements only on the authority of recognized writers. My indebtedness to these will be apparent, and I have referred to so great a number that it would be inadvisable to men tion them here. I may state, however, that on all points connected with Contracts gene rally I have steadily followed the opinions of, and have referred constantly to that great work, Benjamin on Sales and I have much used Lord Justice Lindley's work on Partner ship, and Maude and Pollock on Shipping. This book was released on 2017-12-05 with total page 170 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A d104 Book of Commercial Law, as Existing in California In law, more than in any other science, originality is not to be attained. Every principle in this book has been stated before, and perhaps stated better than it is here. The standard text-writers have been liberally con sultedfi Kent's Commentaries, Smith's Mercantile Law, Parson on Con tracts, and the California Codes, have been most freely referred to. The arrangement, the presentation of each subject, and the statement of principles are, however, new, and whatever of merit there may be in these is all that can be claimed for this book. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Principles of Mercantile Law: In the Subjects of Bankruptcy, Cautionary Obligations, Securities Over Moveables, Principal and Agent, Partnership, and the Companies' Acts These Lectures were delivered some time ago for the Institute of Bankers in Scotland, and they were taken down in shorthand as they were spoken. In preparing this volume for publication, I am aware that there remain many more traces of its origin in spoken speech than are usual in Law Lectures; but this I do not altogether regret. The forms of oral exposition suit the strictly practical aim which I have throughout had in view, to present the leading principles of some branches of mercantile law, with such explanations and illustrations from cases decided by the Courts, as seemed necessary to their operation being thoroughly understood. To help in this way towards a firm and intelligent grasp of these principles I have spared no pains; and I am encouraged to hope that my work, so far as it goes, may be of some practical use, not only by the reception accorded to the Lectures when they were delivered, but also by the fact of the present publication being made in compliance with a request from the Council of the Institute of Bankers. Book Commercial Law Classic Reprint

Download or read book Commercial Law Classic Reprint written by D. Curtis Gano and published by Forgotten Books. This book was released on 2017-10-16 with total page 402 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commercial Law The author of this work has aimed to select from the exten sive field of the law those fundamental principles, a knowledge of which the business man will most frequently find of value to him, and which the teacher of Commercial Law will regard most useful to his classes. It is not the purpose of this volume to make lawyers of its readers, but to teach them to discern the ways that lead from litigation, and to enable them to conduct their business dealings with an intelligent idea of their legal rights and limitations. Technical terms have been avoided as far as possible, and when it has been thought advisable to use them they have been fully defined either in the text or in the glossary. The latter contains a most complete list of the legal terms ordinarily em ployed, with concise yet sufficient definition. The subjects discussed have been arranged in the order in which it is deemed advisable for the teacher to present them. It is believed that all of the subjects with which the business man should become familiar have been included in the present volume, and are explained with sufficient detail to give the reader a correct knowledge of the law concerning them. In many instances different conclusions that have been arrived at by the courts in the several states have been pointed out in detail, that the student may understand the conflicts in the laws of the different jurisdictions. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Compendium of Mercantile Law This edition of Mr. Smith's excellent treatise on Mer cantile Law will be found to differ materially, and it is hoped for the better, from the last. The present Editor has carefully revised all the notes originally prepared by him, constituting much the larger portion of the American additions to the work. He has not taken as large a liberty with the contributions of Judge Gholson, but has appended to them a statement of the most important points which have been since adjudicated on their subjects, by the Eu glish and American courts. He has endeavored so to select, arrange and condense from the mass of learning before him, as to compress within the limits of this volume the most important expositions of commercial law by the American courts. With what success the task has been accomplished, he submits to the judgment of the profession. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commercial Law: A Practical Manual Covering the Fundamental Principles of Law as Applied to Business in General, With Special Reference to Common Law Affecting the More Usual Commercial Transactions HE purpose of the author in writing this article was to furnish a book of instruction for those unacquainted with legal principles, rather than to furnish a legal guide for trained men. However, because of the care with which the subjects have been treated, it is hoped that the work will be found to appeal to the latter as well as the former class of readers. 11] The most important subjects of the common law, arranged with a view of their logical development, are discussed. By common law, is meant the customs of the people, recognized by the written or unwritten decisions of the courts, as distinguished from legis lative acts, known as statute or written law. (11 The author has discussed those statutes only which are quite universally recognized. Students of business administration require a knowledge of the principles of common law. They do not require a knowledge of the great mass of statutes, differing in the different States and subject to frequent change. Even attorneys do not attempt to keep posted on the statutes of different States, but examine them only as occasion requires. A few statutes, such as the United States Bankruptcy Act and others of similar impor. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Principles of Commercial Law: A Treatise for the Use of Students in Business Colleges, and Others Business transactions consist chiefly of buying and selling, borrowing and lending, employing and serving, carrying mer' chandise and paying for the carriage of it. They include, also, all matters Of detail which are incidental to such deal ings; as, for instance, the statement of an account, the'mak ing of a note, the acceptance of a bill, the signing of a receipt, the cancellation of a debt. The main transactions of commerce consist of what the law calls agreements. The incidental transactions are connected with those agreements, and are necessary to carry them out. This being the case, it follows that a discussion of the true nature of an agreement is a proper introduction to the study Of commercial law. Book The Essentials of Business Law Classic Reprint

Download or read book The Essentials of Business Law Classic Reprint written by Francis M. Burdick and published by Forgotten Books. This book was released on 2018-02-05 with total page 328 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Essentials of Business Law This book has not been written for lawyers, nor for professional students of the law, but for boys and girls in our secondary schools. Its purpose is to show how the rules of law, governing ordinary business transactions, have been developed, and to tell what they are. Technical law terms have been discarded as far as possible. When they have been used, care has been taken to explain and illustrate their meaning, so as to render them easily intel ligible to every attentive student. The author believes that the average high-school boy or girl can acquire an accurate knowledge of the essential principles of business law if these are set forth in clear, lucid, popular language. He has endeavored so to present them in the following pages. He has no idea that a mas tery of this book will fit the student for a bar' examination, or will enable him to be his own lawyer. He has the con viction, however, that it will give the student a fair ao quaintance with those legal principles and ideas which are involved in ordinary business affairs, and that it will help him to know when he ought to consult a lawyer, in order to avoid business pitfalls.
