Book The Criminal Responsibility of Senior Political and Military Leaders as Principals to International Crimes

Download or read book The Criminal Responsibility of Senior Political and Military Leaders as Principals to International Crimes written by Héctor Olásolo and published by Bloomsbury Publishing. This book was released on 2009-05-15 with total page 400 pages. Available in PDF, EPUB and Kindle. Book excerpt: As shown by the trials of Slobodan Milosevic, Charles Taylor and Saddam Hussein, the large-scale and systematic commission of international crimes is usually planned and set in motion by senior political and military leaders. Nevertheless, the application of traditional forms of criminal liability leads to the conclusion that they are mere accessories to such crimes. This does not reflect their central role and often results in a punishment which is inappropriately low in view of the impact of their actions and omissions. For these reasons, international criminal law has placed special emphasis on the development of concepts, such as control of the crime and joint criminal enterprise (also known as the common purpose doctrine), which aim at reflecting better the central role played by senior political and military leaders in campaigns of large scale and systematic commission of international crimes. The Rome Statute of the International Criminal Court and the case law of the ICTY and the ICTR have, in recent years, played a unique role in the achievement of this goal.

Book A Gender based Approach to Parliamentary Discourse

Download or read book A Gender based Approach to Parliamentary Discourse written by Catalina Fuentes Rodríguez and published by John Benjamins Publishing Company. This book was released on 2016-12-01 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: Does gender condition politicians’ discourse strategies in parliament? This is the question we try to answer in A Gender-based Approach to Parliamentary Discourse: The Andalusian Parliament. This book, written by experts in the field of discourse analysis, covers key aspects of political discourse such as gender, identity and verbal and nonverbal strategies: intensification, enumerative series, non-literal quotations, pseudo-desemantisation, lexical colloquialisation, emotion, eye contact and time management. It provides a large number of examples from a balanced gender parliament, the Andalusian Parliament, and it focuses mainly on argumentation, since parliamentary discourse is above all argumentative. This book will prove invaluable to students and teachers in the field of discourse analysis, and more specifically of political discourse, and will also be very useful to politicians and anyone interested in communication strategies. As of January 2019, this e-book is freely available, thanks to the support of libraries working with Knowledge Unlatched.

Book Building a Future on Peace and Justice

Download or read book Building a Future on Peace and Justice written by Kai Ambos and published by Springer Science & Business Media. This book was released on 2008-12-04 with total page 566 pages. Available in PDF, EPUB and Kindle. Book excerpt: Results of the 2007 Nuremberg Conference on Peace and Justice: Tensions between peace and justice have long been debated by scholars, practitioners and agencies including the United Nations, and both theory and policy must be refined for very practical application in situations emerging from violent conflict or political repression. Specific contexts demand concrete decisions and approaches aimed at redress of grievance and creation of conditions of social justice for a non-violent future. There has been definitive progress in a world in which blanket amnesties were granted at times with little hesitation. There is a growing understanding that accountability has pragmatic as well as principled arguments in its favour. Practical arguments as much as shifts in the norms have created a situation in which the choice is increasingly seen as "which forms of accountability" rather than a stark choice between peace and justice. It is socio-political transformation, not just an end to violence, that is needed to build sustainable peace. This book addresses these dilemmas through a thorough overview of the current state of legal obligations; discussion of the need for a holistic approach including development; analysis of the implications of the coming into force of the ICC; and a series of "hard" case studies on internationalized and local approaches devised to navigate the tensions between peace and justice.

Book Out of the Ashes

Download or read book Out of the Ashes written by Koen Feyter and published by Intersentia nv. This book was released on 2005 with total page 543 pages. Available in PDF, EPUB and Kindle. Book excerpt: Over the last decade, the issue of reparation for victims of gross and systematic human rights violations has given rise to intense debates at the national and the international level. Discussions particularly arise in post-conflict situations characterised by serious violations of human rights, such as genocide, crimes against humanity, war crimes, and other forms of injustice of the past. Crucial questions include: what harm inflicted to victims warrants reparation? when and how to repair the harm? who is eligible for reparation and who has the duty to repair? These and other questions raise many challenging issues for theory and practice. This volume contains the contributions presented at an international conference in Brussels, in February 2005, on the right to reparation for victims of serious human rights violations. It also includes the final report of a research project undertaken jointly at the Universities of Antwerp (UA) and Leuven (K.U.Leuven) between 2000 and 2004 on the right to reparation in international law for victims of gross and systematic human rights violations, both from a legal and a socio-political perspective. The present volume is aimed at academics, policy-makers, national and international courts and tribunals, the legal professions, and civil society at large.

Book International Humanitarian Law and Human Rights Law

Download or read book International Humanitarian Law and Human Rights Law written by Roberta Arnold and published by BRILL. This book was released on 2008-07-31 with total page 608 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book addresses the current issue of the applicability and application of international human rights law and international humanitarian law in times of armed conflict. Scholars chronologically argued that only international humanitarian law was applicable, that both legal regimes were applicable, and eventually that international humanitarian law was the lex specialis of human rights law. The most recent trend is to state that international humanitarian law and human rights law are merging into a single set of rules, a proposition that is the focus of the investigations carried out in this book. The book examines general issues relating to applicability and the implementation of the two legal regimes as well as provides case studies focusing on specific rights or persons. [The cover of this publication displays a patchwork symbolizing the merger between international humanitarian law and human rights. Neither the publisher nor the editors intended the design to reproduce the protected Red Cross emblem. Any resemblance to the Red Cross emblem is purely coincidental]

Book Refuge from Inhumanity War Refugees and International Humanitarian Law

Download or read book Refuge from Inhumanity War Refugees and International Humanitarian Law written by David Cantor and published by Martinus Nijhoff Publishers. This book was released on 2014-07-10 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book contributes to a long-standing but ever topical debate about whether persons fleeing war to seek asylum in another country – ‘war refugees’ – are protected by international law. It seeks to add to this debate by bringing together a detailed set of analyses examining the extent to which the application of international humanitarian law (IHL) may usefully advance the legal protection of such persons. This generates a range of questions about the respective protection frameworks established under international refugee law and IHL and, specifically, the potential for interaction between them. As the first collection to deal with the subject, the eighteen chapters that make up this unique volume supply a range of perspectives on how the relationship between these two separate fields of law may be articulated and whether IHL may contribute to providing refuge from the inhumanity of war.
