El proceso penal de menores, como un sistema complejo, se articula sobre unos principios propios y diferenciados de los que caracterizan el proceso de adultos. Entre estos, el principio de interés superior del menor, y el principio de oportunidad juegan un papel transformador en el tratamiento jurisdiccional del menor infractor, informando cada una de las fases y posibilidades del proceso, condicionando a su vez la actuación de las partes y del Juez. Se trata de un proceso con autonomía propia en el que convergen un conjunto de opciones y sensibilidades, que han de dar lugar a un adecuado equilibrio entre la necesidad de justicia de una sociedad moderna y responsable, la responsabilidad penal de los menores infractores, y la protección de los mismos en dicha sociedad. Con este fin, ve la luz la presente obra, que pretenden, desde la óptica de los principios y garantías que lo rigen, acercar el sistema de justicia penal, y el proceso penal de menores, a todos aquellos que, desde los distintos perfiles profesionales, desarrollan un trabajo responsable y comprometido para dar una respuesta adecuada a la criminalidad e intervención social con menores, construyendo de esta forma una sociedad más justa. --

No obstante, tiene una especial particularidad. Dada la interdependencia con el derecho penal de los mayores de edad, y también su especialidad, hemos construido un A-Z de principios y subprincipios rectores que determinan y guían las decisiones que deben ser tomadas en materia del derecho penal de la adolescencia. La redacción de la Ley 1098 de 2006 tiene una muy interesante particularidad, puesto que se hace desde la perspectiva de las normas principios y no de las normas reglas, aspecto que hace de su correcta interpretación el éxito de la aplicación de una legislación tan sensible como determinante para el futuro de una sociedad moderna. Los principios y subprincipios se incardinan de tal manera que unos parecen repetir o reiterar lo que ya otro u otros ha señalado. Empero, no se trata de detectar allí contradicciones o antinomias normativas, sino una imposición de ejercicios de armonización y sincronización en su aplicación. El norte se orienta, principalmente, hacia los artículos 1, 2, 4, 93 y 94 de la Carta Política y el Orden Público Internacional de los Derechos Humanos. Por demás, se actualiza el texto con las normas jurídicas, doctrina y jurisprudencia que han tenido discusión en el entretanto de la segunda edición y de esta actualización. Particularmente es importante señalar que este tomo se refiere al principio de oportunidad en sentido estricto, pero no es menos cierto que dentro de tal conceptualización también cabe una definición en sentido amplio, en la cual se recogen múltiples mecanismos alternativos de solución de conflictos que tienen como denominador común la voluntad de las partes involucradas en los mismos, lo que no es más que un desarrollo del derecho procesal consensual, como lo ha establecido la Corte Constitucional en su Sentencia T-142 de 2019, luego de estudiar los antecedentes normativos y jurisprudenciales de los consabidos instrumentos: Con fundamento en lo anterior, es dado concluir del Acto Legislativo 03 de 2002, por el cual se modifican los artículos 116 y 250 de la Constitución ?? Política? , las siguientes particularidades: (i) se trata de un principio que se aplica mediante figuras procesales tales como las preclusiones que profiere la Fiscalía cuando hay conciliación, por indemnización integral, desistimiento, transacción o bien aplicándolo en la sentencia anticipada o audiencia especial; (ii) constituye ?un mecanismo apto para canalizar la selectividad espontánea de todo sistema penal?; (iii) permite simplificar, acelerar y hacer más eficiente la administración de justicia penal, descongestionándola de la pequeña y mediana criminalidades; y (iv) bajo la estricta regulación legal, se le permitiría a la Fiscalía, en determinadas circunstancias, prescindir total o parcialmente del ejercicio de la acción penal o limitarla a alguna de las personas que intervinieron en la conducta punible.

Book excerpt: Con la aprobación de la L.O. 5/2000, de 13 de enero, reguladora de la responsabilidad penal de los menores, se hace efectiva la voluntad del legislador, manifestada en la Exposición de Motivos de la derogada L.O. 4/1992, de 5 de junio, de establecer una renovada legislación en materia de justicia de menores. Para ello, ha sido preciso enfrentarse a un importante reto como es el de combinar las modernas orientaciones en torno a la reforma de la justicia penal con las específicas necesidades de este ámbito jurídico, dotando de la necesaria flexibilidad al sistema para hacer efectivos sus principios rectores de valor superior del interés del menor y educativo, sin menoscabo de las garantías jurídicas fundamentales. De este modo, se establece por vez primera en nuestro ordenamiento una regulación completa del tratamiento sustantivo y procesal de los menores a los que se les imputa la comisión de un ilícito penal, así como de las consecuencias jurídicas aplicables, tanto en lo relativo a la responsabilidad penal de estos sujetos, como a la civil derivada de los daños y perjuicios causados por el delito.
