Anteriormente, la estructura del gobierno federal constitucional era tan distinta de la de los Estados, que cada uno podía estudiarse y discutirse con entera prescindencia del otro; pero los puntos de contacto y de dependencia entre uno y otro han aumentado tanto, por las enmiendas recientes a la Constitución Federal, que ahora se impone un nuevo procedimiento. Algunos principios generales de derecho constitucional, que antes se dejaban exclusivamente a la protección de los Estados, caen hoy dentro de la esfera del poder federal; y toda exposición que de ellos se haga, para que sea provechosa, tiene que poner de manifiesto la parte que ocupan tanto en el gobierno federal, como en la de los Estados. Es esto lo que se ha tratado de hacer en la presente obra y el lector descubrirá bien pronto que las meras teorías, han sido objeto de poca atención y que los principios sentados son los que han sido establecidos por los tribunales o de otro modo, en el ejercicio práctico del gobierno".
