Book excerpt: This book is dedicated to the consolidation and to the expansion of theoretic systems thinking as a necessary integration of the general reductionist and analytical attitude dominant in our culture. Reductionism and analytical approaches have produced significant results in many fields of contemporary knowledge giving a great contribution to relevant scientific discoveries and to their technological application, but their validity has been improperly universalized as the only and best methods of knowledge in every domain. It is nowadays clear that analytical or mereological approaches are inadequate to solve many problems and that we should introduce – or support the diffusion of - new concepts and different research attitudes. A good candidate to support such a shift is the well known theoretical approach based on the concept of “system” that no more considers the elementary constituents of an object, but the entity emerging from the relations and interactions among its elementary parts. It becomes possible to reconstruct several domains, both philosophical and scientific, from the systemic point of view, introducing fresh ideas in the research in view of a general rational vision of the world on more comprehensive basis. This book contributes to the diffusion and evolution of systemic thinking by focusing on two main objectives: developing and updating the systemic approach in disciplines currently using it and introducing the systemic perspective in humanistic disciplines, where the approach is not widely used. The Systemic Turn in Human and Natural Sciences: A Rock in the Pond is comprised of ten chapters. The chapter authors adopt a trans-disciplinary perspective, consisting in the recognition and harmonization of the special outlooks that together, within the general systemic paradigm, gives an ideal unity to the book.

Book excerpt: The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” – the first attempt on this subject – deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). They provide an overview of the legal differences between geographical areas, and offer numerous examples of how states and their courts have resolved disputes involving private international law elements. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

With a focus on expressions of modality, the study adopts a corpus-based Descriptive Translation Studies approach to analyse the translation strategies used in a bilingual English/Italian parallel corpus of European Union legislation and identify the most frequent translational patterns. The book outlines the principles at the basis of the multilingual policy at the European Union and provides a detailed outline of the context in which the drafting and translation processes take place as a key to understanding the translational choices. The impact of sometimes contrasting factors such as the conventions of legal drafting at the European Union and those within the target culture, the principle of equal authenticity and the attention to the quality and readability of legislative texts is revealed in the analysis. Evidence in support of the theories concerning translation universals is also found and their implications for EU legal translation are discussed. The results lead to the formulation of several hypotheses as regards the norms governing the translation of EU legislative texts. The book also reflects on the impact that the translational choices have on the development of European Union legal language as an independent variety. This volume will be of interest to researchers and students in the fields of Legal Translation Studies and Linguistics, as well as practising translators.
