Nel primo, sarà affrontato brevemente il tema della crisi d’impresa, approfondendone il significato e analizzando le cause generatrici di questa e i possibili rimedi per affrontarla. Ha senso, infatti, intraprendere una qualsiasi operazione di risanamento o continuarne una già avviata solo se esistono i presupposti di una sopravvivenza, quanto meno parziale, dell’azienda. Il secondo capitolo riporta un breve riepilogo di tre diversi strumenti previsti dal legislatore che, seppur profondamente diversi tra loro, hanno in comune il fine di evitare la dichiarazione di fallimento e garantire, dunque, la continuità e la sopravvivenza d’impresa. Sono, dunque, esaminate brevemente le soluzioni negoziali alla crisi d’impresa, inserite nella legge fallimentare prima con il D.L. n. 35 del 14/03/2005, poi D.Lgs n. 5 del 09/01/2006 e ancora con il D.L. n. 78 del 31 maggio 2010 e il decreto sviluppo 83/2012. Il terzo capitolo affronta, infine, le problematiche concernenti il trattamento contabile e l’informativa integrativa da fornire in merito ad un’operazione di ristrutturazione del debito, analizzando le novità introdotte dall’OIC n.6 dall’Organismo Italiano di Contabilità. Nell’ultima parte del lavoro viene affrontato il trattamento fiscale delle componenti reddituali scaturenti da tali procedure, ossia: le sopravvenienze attive derivanti dalla riduzione o dall’eliminazione dei debiti d’impresa, la simmetrica deducibilità delle perdite nei confronti dei creditori che hanno sottoscritto gli accordi e le plusvalenze derivanti dalla cessione di beni. L'autore Francesco Ausiello nasce nel 1978 a Capua. Laureato in Economia Aziendale presso la Seconda Università degli Studi di Napoli, si abilita come Dottore Commercialista e Revisore Contabile e diventa Dottore di ricerca in Economia presso l’Università degli Studi di Cassino e del Lazio Meridionale. Dopo aver conseguito varie specializzazioni ha lavorato prima nell’area contabile e marketing di diverse aziende private e, poi, dal 2005 presso la pubblica amministrazione.

Book excerpt: PERBACCO (a free Italian acronym for Life-cycle Performance, Innovation and Design Criteria for Structures and Infrastructures Facing Æolian and Other Natural Hazards) is a research project partly funded by the Italian Ministry for University (MIUR) in the PRIN (Progetti di Ricerca di Interesse Nazionale) framework, for the years 2004-05.Within the project, a first attempt has been made to integrate different disciplines aiming at an overall optimization of the performance of a wide range of wind exposed structures and infrastructures, with consequent benefi cial impact on the society.The overall objectives were (a) to provide unifi ed concepts for "expected performance" and "risks induced by æolian and other natural hazards", to be applied to structures and infrastructures over their whole life-cycle, such to be acceptable to stakeholders in the construction process (i.e. from the owner to the end-user), (b) to provide models and methodologies for dynamic monitoring of the performance of structures and infrastructures, to be integrated in appropriately designed procedures, and (c) to collect, refi ne, fi le and disseminate the knowledge available on a European basis, concerning the performance of wind-exposed structures and facilities, in a way such to be of use to Construction Industry. This volume summarises the main results obtained during the Project, with each Section addressing a different class of problems, to which many research Units have contributed. A list of papers containing the main results of the research activities carried out within the Project is also provided in each Section.
